EXTRAJUDICIAL PARTITION OF ESTATE

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT made end and entered into this 27th day of
March 2021, in Quezon City, by and between:

ANTONIO ANCHETA, MERCIDITA ANCHETA


BALMORES, ROSEMARIE MORADO ANCHETA, CONSUELO
ANCHETA GRAVADOR, ISIDRO ANCHETA, NENITA ANCHETA
PORTILLANO and HENRY ANCHETA, all of legal age, Filipino,
and residing at Blk 35 Lot 2 Ilang-Ilang St., Maligaya Park Subd.,
Brgy. Pasong Putik, Quezon City;

WITNESSETH, that:

WHEREAS, we are the sole heirs of the deceased Maria N.


Ancheta who died on February 18, 2017 at Maligaya Park Subd.,
Novaliches, Quezon City, copy of his death certificate is hereto
attached as Annex “A”;

WHEREAS, Maria N. Ancheta, died intestate, without Will or


Testament, and without any outstanding debts in favor of any person
or entity;

WHEREAS, Maria N. Ancheta is the absolute owner and


registered owner of a parcel of land located at Blk 35 Lot 2 Ilang-
Ilang St., Maligaya Park Subd., Brgy. Pasong Putik, Quezon City,
covered by Transfer Certificate of Title No. N-224095, respectively, of
the Registry of Deed of Quezon City and more particularly described
as follows:

“A parcel of land (Lot 2-B of the subd plan (LRA)


psd 376701 approved as a non-subdn. proj. being a
portion of Lot 2 Blk 35, (LRC) Psd-9707; (L.R.C) Record
No. 6563). Situated in the Barrio of Q. City M. Mla. Is. of
Luzon. Bounded on the NE, pts 1 to 2 by Lot 2-A of the
subdn. plan; on the SE., pts. 2 to 3 by Lot 3; on the SW.,
pts. 3 to 4, by Lot 1; both of Blk 35, (LRC) Pcs-9707; and
on the NW., pts. 4 to 5 and 5 to 1, by Rd Lot 53, (LRC)
Psd 9707 Beginning at a pt. marked “1” on plan being
N. 69 deg. 42’W., 1144.31 m. from LM No. 13, Tala
Estate; thence S. 40 deg. 48’E., 19.43 m. to pt. 2; thence S.
57 deg. 34’W., 17.19 m. to pt. 3; thence N. 32 deg. 23’W.,
24.50 m. to pt. 4; thence 84 deg. 31’E., 7.40 m. to pt. 5;
thence N. 71 deg. 29’E., 7.98 m. to the pt. of beginning,
containing an area of THREE HUNDRED THIRTY
THREE SQUARE METERS AND FIFTY SQUARE DEC.
(333.50) more or less. All pts. referred to are indicated
on the plan and are marked on the ground; as follows:
pts. 3 to 5, by PLS and the rest by P.S. cyl. conc. Mons.
15x60 cm., bearings true; decl. 0 deg. 48’E., date of
Original Survey, during 1907 and that of the subdn.
survey, executed by Filbert E. Baccay. Geodetic
Engineer, on March 4, 2001”

WHEREAS, pursuant to Rule 74, Sec 1 of the Revised Rules of


Court of the Philippines, and being with full capacity to contract, we
do hereby adjudicate unto ourselves the parcel of land described
above in equal shares.

WHEREAS, above-mentioned names/persons have an equal


share of forty seven and fifty (47.5) square meters each of the total
three hundred thirty three and fifty (333.50) square meters.

WHEREAS, names/persons mentioned-above must enter in an


agreement in which if one or more of them wants to sell their shared
property thus, by signing in the said sale agreement.

FURTHER, we do hereby SELL, TRANSFER, CONVEY and


DELIVER, by way of absolute sale, unto the above-said sole heirs
assigns and successors ONLY in interest of the property above
described with all the improvements existing thereon;

That we hereby warrant our valid title to and peaceful


possession of the property herein and further declares that the same
is free and clear of all liens and encumbrances of any kind
whatsoever.
IN WITNESS WHEREOF, we hereunto set our hand and seal
this 27TH day of March 2021 at Quezon City.

Mercedita Ancheta Balmores, Rosemarie Morado Ancheta, Consuelo
Ancheta Gravador, Isidro Ancheta, Nenita Ancheta Portillano and
Henry Ancheta, who was satisfactory proven to me their identity
through Comelec ID, Senior Citizen ID, PWD ID, UMID and Birth
Certificate who is personally known to me and the same person who
executed and voluntarily signed the foregoing EXTRAJUDICIAL
SETTLEMENT which the acknowledged before me as their free and
voluntary act and deed.

The foregoing instrument which relates to an Extrajudicial


Settlement of Estate of a parcel of land consisting of four (4) pages on
which this acknowledgement is written, has been signed on the left
margin of each and every page by the parties and the witnesses.
