WHEREAS, the 1987 Philippine Constitution provides that the right of the people
to information on matters of public concern shall be recognized, access to official
records, and to documents and papers pertaining to official acts, transactions, or
decisions, as well as to government research data used as basis for policy development,
shall be afforded the citizen;

WHEREAS, the 1987 Philippine Constitution likewise declares that the State shall
give priority to education, science and technology, arts, culture, and sports to foster
patriotism and nationalism, accelerate social progress, and promote total human
liberation and development;

WHEREAS, RA 7743, otherwise known as An Act Providing For The Establishment


Of Congressional, City And Municipal Libraries, promotes the moral and intellectual well-
being of the people, elevate the literacy level of every Filipino to the end that illiteracy
is eradicated, and recognize the vital role of knowledge and information in nation-
building;

WHEREAS, RA 9246, otherwise known as the "The Philippine Librarianship Act of


2003" declares that the State recognizes the essential role of librarianship as a
profession in developing the intellectual capacity of the citizenry thus making library
service a regular component for national development;

WHEREAS, RA 9470, otherwise known as the "National Archives of the


Philippines Act of 2007" declares the policy of the State to protect, conserve, promote
and popularize the nation's historical and cultural heritage and resources;

WHEREAS, this Sanggunian has enacted Ordinance No. 08, Series of 1992, which
transferred the supervision of the City Public Library from the City Mayor's Office to the
Office of the Sangguniang Panlungsod, thereby making the Secretary to the Sanggunian
the custodian of the local archives and the local library, pursuant to Sec. 469 of RA
7160 otherwise known as the Local Government Code of 1991;

WHEREAS, under the present organizational structure and plantilla of personnel


of the Local Government Unit of General Santos City, the management and supervision
of the Public Library is under the Office of the Sangguniang Panlungsod and its
personnel are appointed by the City Vice-Mayor;

WHEREAS, this Sanggunian deems it necessary to amend certain provisions of


Ordinance No. 10, Series of 2005 to make it more responsive, relevant, and dynamic to
further strengthen the structure and role of the City Public Library towards pursuing the
intends of RA 7743;

WHEREAS, this Sanggunian further deems it essential and imperative to


modernize the City Public Library by making it more attuned to the latest technological
advancement available in the digital information age thus enabling efficient and
effective delivery of its services to the public;

WHEREAS, this Sanggunian furthermore deems it crucial to provide utmost


priority for the preservation of the city's public documents and records, not only as
fundamental instruments for efficient and effective governance but also as essential tool
for the preservation of the city's history and cultural memory pursuant to the declared
policy of RA 9470;

NOW, THEREFORE, on motion of the City Councilor Rosalita T. Nunez, MNSA,


Ph.D., duly seconded by the City Councilors Ramon R. Melliza and Shandee Theresa 0.
Llido - Pestano, be it-

RESOLVED, as it is hereby resolved, to enact this Ordinance:

AN ORDINANCE MODERNIZING AND STRENGTHENING THE STRUCTURE AND ROLE


OF LIBRARIANSHIP OF THE GENERAL SANTOS CITY PUBLIC LIBRARY

Be it ordained by the 17" Sangguniang Panlungsod of the City of General Santos,


that:

Section 1. Short Title.- This Ordinance shall be known as the "Modernization of


the General Santos City Public Library Ordinance of 2015."

Section 2. Definition of Terms.- For the purpose of this Ordinance, the following
terms shall be understood hereinafter to mean as:

a. Archives — refer to public records, papers, periodicals, books or other items,
articles or materials, whether in the form of electronic, audio-visual or print,
which by their nature and characteristics have enduring value, that have been
selected for permanent preservation.

b. Public Records — refer to records or classes of records, in any form, in whole


or in part, created or received by a government agency in the conduct of its
affairs, and have been retained by that government agency or its successors
as evidence or because of the information contained therein.

c. Practice of Librarianship — refers to the performance of the library's functions,


which shall include, but not limited to the following:

1) Selection and acquisition of multi-media sources of information which


would best respond to clientele's need for adequate, relevant and timely
information;

2) Cataloguing and classification of knowledge or sources of information into


relevant organized collections and creation of local databases for speedy
access, retrieval or delivery of information;

3) Development of computer-assisted/computer-backed up information


systems which would permit online and network services;

4) Establishment of library system and procedures; dissemination of


information; rendering of information, reference and research assistance
archiving; and education of users;

5) Teaching, lecturing and reviewing in library, archives and information


science subjects, including subjects given in the licensure examination;

6) Rendering of services involving technical knowledge/expertise in


abstracting, indexing, cataloguing and classifying or preparing of
bibliographies, subject authority lists, thesauri and union catalogues/lists;

7) Preparation, evaluation or appraisal of plans, programs and/or projects for


the establishment, organization, development and growth of libraries or
information centers, and the determination of library requirements for
space, buildings, structures or facilities;

8) Provision of professional and consultancy services or advice on any aspect


of librarianship; and

9) Organization, conservation, preservation and restoration of historical and


cultural documents and other intellectual properties.

Section 3. Policy Statement.- The Local Government Unit of General Santos City
generally adheres to the fundamental essence of developing the intellectual capacity of
its local inhabitants by way of giving more importance to the city's historical and cultural
heritage. Towards this end, this Sanggunian sees the need to:

a. Modernize the practice of librarianship in the General Santos City Public


Library pursuant to RA 9246, otherwise known as "The Philippine
Librarianship Act of 2003";

b. Strengthen the structure and role of the City Public Library as a permanent
division of the Sangguniang Pan/ungsod of General Santos City pursuant to
the relevant provision of RA 7160, RA 7743, General Santos City Ordinance
No. 08, Series of 1992, and Ordinance No. 10, Series of 2005;

c. Provide the Office of the City Vice Mayor additional powers and functions for
the efficient and effective management and supervision of the City Public
Library;

d. Establish the Records, Archives, and Artifacts Section to conserve, promote,


protect the historical and cultural heritage of General Santos City;' and

e. Effect such other appropriate or necessary rules and regulations essential to


carry-on the foregoing principles.

Section 4. Organizational Structure of the City Public Library

Section 5. Powers and Functions of the Vice Mayor as Head of the City Public
Library. The City Vice Mayor shall undertake the following powers and functions as
Head of the City Public Library:

a. Exercises general management and control over all programs, projects, and
activities of the City Public Library;

b. Directs the formulation of plans for the operations thereof with the consensus

c. Initiates and proposes policy measures for the effective governance of the
City Public Library from time to time;

d. Represents the City Public Library in all its business transactions and signs in
its behalf all contracts, obligations, bonds and such other agreement upon
the consent and concurrence of the Sangguniang Panlungsod;

e. Exercises such other related powers and perform such other related duties as
may be deemed necessary or appropriate towards the efficient and effective
management of the City Public Library.

Section 6. Power and Function of the Secretary to the Sangguniang Panlungsod.-


The Secretary to the Sangguniang Panlungsod will assist in carrying out the different
functions and program of activities of the City Vice Mayor as enumerated in Section 5.

Section 7. Powers and Functions of the City Librarian. Adopting the applicable
provisions under Section 5 of RA 9246 for the purpose of this Ordinance, librarianship
shall deal with the performance of the librarian's functions, which shall include but shall
not limited to the following:

a. Manages, supervises and oversees the effective, efficient and quality


operation of the City Library in coordination with the City Vice Mayor;

b. Exercises supervision and control over all the following programs and
activities of the City Library in coordination with the City Vice Mayor;

c. Selects and acquires multi-media sources of information which would best


respond to clientele's need for adequate, relevant, and timely information;

d. Catalogues and classifies knowledge or sources of information into relevant


organized collections and creation of local databases for speedy access,
retrieval or delivery of information;

e. Develops computer-assisted/computer-backed information systems which


would permit online and network services;

f. Establishes library system and procedures; disseminate information; render


information, reference and research assistance; archiving; and educate users;

g. Renders services involving technical knowledge/expertise in abstracting,


indexing, cataloguing and classifying' or the preparation of bibliographies,
subject authority lists, thesauri and union catalogues/lists;

h. Organizes, conserves, preserves and restores historical and cultural


documents and other intellectual properties;

Section 8. Composition.- The General Santos City Library Board shall be


composed of:

the Department of Education (DepEd)
Representative from the Technical Education and Skills
Development Authority (TESDA)
Representative from the Commission on Higher Education (CHED)

Section 9. Powers and Functions.- The General Santos City Public Library
Board shall have the following powers and functions:

a. To promulgate and determine policies for the effective and efficient operation
and maintenance of the GSC Public Library;

b. To serve as an advisory committee to the Sangguniang Panlungsod on library


matters, such as but not limited to the necessity for the application of local
appropriations for public library purposes;

c. To find ways and means in increasing the book and non-book collections of
the General Santos City Public Library and in improving the facilities of the
library;

d. To provide recommendations and suggestions on the selection of library


materials, library rules and regulations and other library problems;

e. To promote and strengthen partnership between the Library and the


community;

f. To make and accept donations in behalf of the City Library.

Section 10. Local Procedures Establishing the City Public Library as a Repository
of the Historic Archives and Legislative Traditions of the Sangguniang Panlungsod.-
Adopting pertinent provisions from Article III (Records Management and Archives
Administration) of RA 9470, the City Public Library shall use the following as guidelines
in establishing its own efficient and effective local procedures:

a. Establishment of Archives and Records office/Limits.- The City Public Library


shall establish its archives and records office/unit and a Records officer on an
archivist shall be designated by the City Librarian from the current personnel
of the City Public Library.

b. Inventory of Public Records.- The City Public Library in coordination with the
Office of the Sangguniang Panlungsod and the Records Division shall
regularly conduct an inventory of their public records and shall be mandated
to keep the following data in their respective registry:

1) All public records under its custody;

2) Public records disposed of with authority;

3) Develop, update, and add other rules and procedures applicable and suitable
for the efficient and effective conduct of its operations if necessary.

Section 11. Allocation of Fund.- In the next ensuing fiscal year after this
Ordinance shall have become effective, the Sangguniang Panlungsod shall cause the
appropriation of funds necessary for the City Public Library to efficiently and effectively
carry out the provisions of this Ordinance, and to include therein all necessary
operational or program support expenditures.

Section 12. Special Trust Fund.- There is hereby established a special trust fund,
to be known as the City Public Library Trust Fund (CPLTF), which shall consist of the
following:

a. An initial budgetary allocation of Two Million Pesos (P2,000,000.00),


appropriated in the budget year immediately following the approval of this
Ordinance;

b. Monetary gifts and grants conditionally or unconditionally donated for the


purposes of the CPLTF by third parties, including but not limited to, private
or individual donors, non-government organizations, people's
organizations, charitable institutions, other Local Government Units, and
development bodies;

c. Income of any nature earned by, or of accruing to the City Public Library;

d. Proceeds of any action by the Library Board; and

e. Moneys accruing to the City Public Library for any other reason and which
the Vice Mayor has the power to accept as authorized by the Board.

Unless otherwise provided by some general law, special act, or ordinance, all
income and monetary gifts or grants received by the City Public Library must be
deposited in the special trust fund and not subsequently expended without further
appropriation specific for its purpose.

Section 13. Amendatory Clause.- The provision of Ordinance No 10, Series of


2005, orders, memoranda and other issuances in so far as inconsistent with the
provisions of this Ordinance are hereby repealed or modified accordingly.

Section 14. Suppletory Clause.- The provisions of R.A. 7743 otherwise known
as An Act providing for the Establishment of Congressional City, and Municipal Libraries
and Barangay Reading Centers throughout the Philippines, Appropriating the Necessary
Fund therefore and for Other Purposes; R.A. 9246 or the "The Philippine Librarianship
Act of 2003."; and R.A. 9470 otherwise known as the "National Archives of the
Philippines Act of 2007," including their Implementing Rules and Regulations insofar as
applicable, shall be considered suppletory to this ordinance.

Section 15. Separability Clause.- If, for any reason or reasons, any part or
provisions of this Ordinance shall be held to be unconstitutional or invalid, other parts
or provisions hereof which are not affected thereby shall continue to be in full force
and effect.

Section 16. Effectivity. - This Ordinance shall take effect immediately ten (10)
days after its complete publication in any newspaper of general circulation within the
city.

Regular Session held on March 24, 2015.
