1 GUIDELINES ON THE PREPARATION OF DEVOLUTION TRANSITION PLANS

2 OF LOCAL GOVERNMENTS IN SUPPORT OF FULL DEVOLUTION

5 1.0 Rationale

7 1.1 Section 2 (a) of Republic Act 7160 (Local Government Code) provides
8 that, “…State shall provide for a more responsive and accountable local
9 government structure instituted through a system of decentralization
10 whereby local government units shall be given more powers, authority,
11 responsibilities, and resources. The process of decentralization shall
12 proceed from the national government to the local government units.”
13 Section 3 (d) of the LGC further provides that “the vesting of duty,
14 responsibility, and accountability in local government units shall be
15 accompanied with provision for reasonably adequate resources to
16 discharge their powers and effectively carry out their functions; hence,
17 they shall have the power to create and broaden their own sources of
18 revenue and the right to a just share in national taxes and an equitable
19 share in the proceeds of the utilization and development of the national
20 wealth within their respective areas.”

22 1.2 The Supreme Court ruling on the Mandanas-Garcia petitions
23 (GR199802 and 208488) ordered the national government to include all
24 collections of national taxes in the computation of the base of the just
25 share of local governments (LGUs). This will significantly increase the
26 national tax allotment of LGUs, expand their fiscal capacity staring
27 FY2022, which shall enable them to fully and effectively discharge their
28 powers and responsibilities and assume a stronger role in implementing
29 the functions and services devolve to them under Section 17 of the Local
30 Government Code (LGC) and other laws on devolution.

32 1.3 The increase in LGU national tax allotment starting FY2022 will not be
33 accompanied with additional functions and services other than those that
34 are already devolved to them under Section 17 of the LGC and other
35 laws on devolution. LGUs are however expected to gradually scale up
36 their services and to start to fully assume the devolved functions,
37 services and facilities that are to be handed over to them by NGAs
38 starting FY 2022 as NGAs begin to shift their focus from direct service
39 delivery to setting delivery standards, capacitating, and monitoring LGU
40 performance.

42 1.4 To prepare for their full assumptions of devolved functions and services
43 all provinces, cities and municipalities shall develop a Devolution
44 Transition Plan (DTP). The DTP shall serve as the LGU’s roadmap to
45 ensure systematic and coherent actions towards its full assumption of
46 devolved functions and services starting in FY2022 up to FY2024. The
47 DTP is a handy reference for LGUs in carrying out their organizational
48 strengthening efforts in the next three years, and for monitoring the
49 progress of its assumption of devolved functions and services.

51 LGUs are encouraged to use their DTPs to leverage support from NGAs
52 on their capacity development needs and guide the design and
53 implementation of NGA devolution transition activities. LGUs may further
54 use their DTPs to seek support from other stakeholders: the
55 nongovernment organizations, people’s organizations, the business
56 sector and the academic institutions on areas such as capacity building,
57 service delivery and development programs.

59 2.0 Devolved Services and Facilities.

61 2.1 Section 17 of the LGC specifies the basic services and facilities that are
62 devolved for each level of local government (Annex A).

64 2.2 There shall be no additional functions to be devolved to LGUs other than
65 those already provided in Section 17 of the Local Government Code and
66 other pertinent laws on devolution.

68 3.0 Principles Guiding the LGU Devolution Transition Plan
69
70 3.1 Consistent with Sections 3, 25,34 and 35 of the LGC, the development
71 of LGU Transition Plan shall be guided by the following principles:

73 a) Local governments are primarily responsible for providing direct
74 service delivery to their constituencies and will assume a greater
75 responsibility and accountability in ensuring that the level and
76 quality of service delivery especially for devolved services, is not
77 diminished.
78 b) Local governments shall endeavor to be self-reliant. They are
79 expected to strengthen their capacity to take stewardship of their
80 increased fiscal resources; enhance their organizational capability
81 for service delivery; and institute transparent, accountable, and
82 participatory mechanisms to better achieve national and local
83 development objectives.
84 c) Local governments are encouraged to establish robust partnership
85 with NGAs and the private sector as providers of technical
86 expertise, information resources, and innovations and governance
87 models on service delivery.

89 4.0 LGU Preparations to Full Devolution

91 4.1 All provincial, city and municipal local governments shall prepare their
92 respective devolution transition plan (DTP). The LGU-DTP will have the
93 following components: a) Inventory of services and facilities undertaken
94 and implemented by the LGU; 2) Organizational effectiveness proposal
95 under the full devolution set-up; and 3) Strategy/approach towards
96 meeting the service delivery standards set by NGAs and defining LGU
97 contributions to Philippine Development Plan outcomes.

99 The DTPs of provincial governments shall include their oversight and
100 functional support to their component cities and municipalities in

101 accordance with Sections 3, 29 and 465 (xiii) of the LGC. Likewise, the
102 DTPs of cities and municipalities shall include their oversight support to
103 their component barangays pursuant to Sections 3, 32 and 444 (xiii) of
104 the LGC. This is to ensure harmonization and vertical integration of
105 development requirements across levels of LGUs.

107 4.2 During the preparation of their DTPs, LGUs may coordinate with the
108 appropriate field offices of NGAs as applicable, to understand the
109 capacity requirements of functions and services to be fully devolved; to
110 seek technical expertise and capacity building support for their full
111 assumption of the devolved functions and responsibilities; and to ensure
112 the integration of LGU capacity development requirements in the NGA-
113 DTPs.

115 4.3 The Local Chief Executive (LCE) shall oversee the preparation of the
116 LGU-DTP. The LCE may create an ad hoc committee or organize a team
117 responsible for the preparation of the LGU-DTP. The Committee or team
118 may include representatives from key LGU offices that will assume the
119 functions and services to be fully devolved by NGAs.

121 4.4 The Department of Interior and Local Government (DILG) will oversee
122 and guide the LGUs in the preparation of their DTPs.

124 5.0 Contents of the LGU Devolution Transition Plan

126 5.1 The content of the LGU-DTP shall include the following:

128 a) Inventory of LGU functions, services, and facilities. The
129 inventory shall be based on the functions and responsibilities
130 devolved to LGUs under Section 17 of the LGC, and other pertinent
131 laws on devolution. Subject to their capacity and resources, LGUs
132 shall identify, prioritize, and adopt a phased approach in
133 implementing those functions and services that they have yet to
134 fully assume, beginning FY 2022 until FY2024 when the transition
135 to full devolution is expected to be completed. LGUs are
136 encouraged to share this inventory with concerned NGAs to inform
137 the design and implementation of their devolution transition
138 activities, their registry of service delivery standards for devolved
139 functions and services, and their LGU capacity development
140 strategy. (Annex A-1).

142 b) Organizational effectiveness proposal (OEP). The OEP shall
143 include the organizational interventions needed to be carried out by
144 the LGU to strengthen its capability and be able to respond to
145 changes in its functions and scope of operations because of full
146 devolution. The OEP shall have two components:

148 1. Organizational structure and staffing pattern (OSSP). The
149 modifications in the LGU organizational structure and staffing
150 pattern shall be determined by the functions and services it will

151 fully assume starting FY2022 up to FY2024. In designing the
152 OSSP, LGUs shall be guided by Section 76 of the LGC, the Civil
153 Service Commission Memorandum Circular 19, s. of 19921, and
154 the limitations on the use of LGU funds under Section 325 (a) to
155 (f) of the LGC. Position titles and corresponding salary grades
156 under the revised/modified staffing pattern shall follow DBM
157 Budget Circular 2018-42. The new or modified OSSP shall be
158 approved by the respective Sanggunian concerned, and a copy
159 of which shall be provided to the Civil Service Commission for
160 review. (Annex B).

162 2. Capacity development agenda (CapDev agenda). LGUs shall
163 prepare a time-bound capacity development agenda to enable
164 them to absorb, implement and manage the fully devolved
165 responsibilities, starting FY2022 until 2024 when the transition
166 to full devolution is expected to be completed.

168 The CapDev agenda shall be anchored on Local Government
169 Academy’s (LGA) six capacity development pillars which is the
170 framework for assessing the LGU capacity development
171 requirements to be able to perform its fully assumed functions,
172 fulfill its accountabilities and produce desired results. The LGA
173 will issue a separate guideline on the preparation of CapDev
174 agenda. (Annex C).

176 LGUs with updated CapDev agenda as component of their
177 updated Comprehensive Development Plan (CDP), shall
178 likewise review and adjust it in consideration of the functions
179 and services they will fully assume starting FY2022. The
180 updated CapDev agenda shall be approved by the respective
181 Sanggunian concerned, and a copy of which shall be shared to
182 LGA as input to their LGU capacity development strategy.

184 c) Strategy to meet service delivery standards, and contributions
185 to Philippine Development Plan outcomes. LGUs shall outline
186 their strategy to meet the service delivery standards developed by
187 concerned NGAs and its approach to monitoring LGU contribution
188 to Philippine Development Outcomes.

190 1. Service delivery standards. In preparation to full devolution,
191 concerned NGAs are developing a registry/ /inventory of service
192 delivery standards for devolved functions, services, and
193 facilities “to ensure that LGUs abide by common standards in
194 the delivery of services pertinent to them.”3 Concerned NGAs
195 will disseminate the registry/inventory to LGUs for guidance and

199 LGUs shall utilize this registry/inventory to ensure consistency
200 in the quality of their services delivery and enforce quality
201 assurance and compliance; to manage performance reporting
202 and performance improvement; to inform LGU plan formulation
203 (CLUP, CDP), budgeting, procurement activities and human
204 resource management; to create incentives for innovations; and
205 to shape the expectations the public have of LGU services.

208 2. Contributions to Philippine Development Plan. In view of their full
209 assumption of devolved functions and services, LGUs shall review
210 and update their local development plans, sectoral thematic plans,
211 and investment programs to ensure the vertical alignment of local
212 development priorities with regional and national priorities; and the
213 horizontal linkage between the LGU plan, investment program and
214 the budget, in accordance with DILG-NEDA -DBM-DOF Joint
215 Memorandum Circular No. 1 s. 20164 and DILG MC 2019-1895.
216 LGUs are likewise encouraged to identify and implement local
217 programs, projects and activities that will contribute to the
218 achievement of the targets under the Philippine Development Plan
219 pursuant to DILG-NEDA Joint Memorandum Circular No. 1 s.

222 LGUs shall use the performance monitoring framework (Annex E)
223 to plan, manage and document their data collection efforts. This will
224 ensure that LGUs collect comparable data on a regular basis, and
225 the data they collect will serve the purpose of the various
226 performance assessment/monitoring tools and reports produce by
227 LGUs, e.g., Seal of God Local Governance (SGLG), Governance
228 Assessment Report (GAR), Community-Based Monitoring System
229 (CBMS), Provincial Results Matrices (RM), and Citizen Satisfaction
230 Index System (CSIS), among others.

232 6.0 Sharing and communicating the Devolution Transition Plan to
233 institutional stakeholders and partners.

235 6.1 LGUs shall submit their DTPs within one hundred twenty (120) after the
236 approval and issuance of the Executive Order. Component
237 municipalities and cities shall submit their DTPs to their provincial
238 governments for the harmonization of their capacity development needs
239 at the provincial level. Provinces and highly urbanized cities shall submit
240 their DTPs to DILG provincial offices.

241 6.2 DTPS shall have the proper endorsement of respective Sanggunian
242 before submission to provincial government, with respect to component
243 cities and municipalities, and to DILG with respect to provinces and
244 highly urbanized cities. All DTPs shall be submitted in hard copy and in
245 electronic form.

247 6.3 LGUs are encouraged to share their DTPs to concerned NGAs to guide
248 and direct NGA assistance on areas where LGUs need more capacity
249 development support, and to aid NGAs in monitoring LGUs’ full
250 assumption of devolved functions and services.

252 6.4 LGUs may also share and communicate their DTPs with their
253 institutional partners such as the NGOs, the people’s organizations, the
254 business sector, and the academic institutions to seek support and
255 engage them in cooperative undertakings during the devolution
256 transition period particularly in the areas of service delivery, capacity
257 building, or development of livelihood programs as prescribed under
258 Sections 3(l) and 35 of the LGC.

This matrix on service delivery standards was based on Annex C-1 of NGA DTP, modified for the LGU DTP.

This matrix contains the registry/inventory of service delivery standards for devolved services which concerned NGAs will disseminate to the LGUs for their reference and guidance and will be used by LGA as inputs to the LGU Capacity
Development Plan1.
