26CALL-TO-ORDER: The 28th Regular Session of the Sangguniang Bayan of San Jose, Batangas started
27with a call-to-order from the Presiding Officer, Hon. Noel J. Virtucio at 09:00 AM, Monday, February 3, 2020;

29ROLL CALL: The Secretary called the roll and recorded Hon. Timoteo H. Quizon as non-attending who
30was on Official Business. Noting that the majority Members of the Sanggunian are in attendance as attested
31by the Secretary, the Presiding Officer thereby declared the session open to transact official business;

33READING AND CONSIDERATION OF THE MINUTES OF THE PREVIOUS SESSION: On motion of Hon.
34Ruel F. Ilao and concurred into by all Members present, the Body dispensed with the reading of the Minutes
35of the 28th Regular Session as copies thereof were already given to each and every member beforehand.
36After some minor corrections, the foregoing minutes was considered ratified on motion of Hon. Ruel F. Ilao
37and seconded by Hon. Alex A. Mendoza;

39UNFINISHED BUSINESS:
40  On Item Nos. 1, 2 and 3, the following various appropriation ordinances and budgets will be reported
41 to the plenary once the review and recommendation of the Local Finance Committee thru the
42 Municipal Budget Office have been forwarded to the Committee on Finance, Budget and
43 Appropriations, to wit:

91 JOSE, BATANGAS, PROVIDING FUNDS THEREFOR AND FOR OTHER PURPOSES will be
92 entered in the Calendar of Business under Business for the Day in the next session;

94  Item No. 5, the Administrative Complaint filed by Hon. Marino M. Larisma, Punong Barangay of
95 Barangay Bigain South, against Sangguniang Barangay Member, Hon. Emil M. Makalintal of the
96 same Barangay – the Hearing/Trial relative thereto will be conducted by the Ad Hoc Committee
97 tentatively scheduled for next week;

99  Item No. 6, Proposed Ordinance entitled: AN ORDINANCE FOR AN EFFICIENT AND EFFECTIVE
100 IMPLEMENTATION OF THE CSR/MNCHN STRATEGY IN THE MUNICIPALITY OF SAN JOSE,
101 BATANGAS will be calendared in the succeeding session for its Second Reading;

103  Item No. 7, the Sangguniang Barangay Ordinance of Santo Cristo, Kapasyahan Bilang 42-2019 –
104 Isang Kapasyahan na Nagtatakda ng Alituntunin ng mga Nagmamay-ari o Nag-aalaga ng Aso o
105 Anumang Uri ng Hayop sa Nasasakupan ng Barangay – is for further review by the Committee on
106 Ordinances and Legal Matters;

108  Item No. 8, the request of Dr. Arlene Briones for reclassification of land from Agricultural to
109 Commercial, situated in Barangay Aya, San Jose, Batangas with an area of 2,000 square meters
110 has been deferred pending submission of some documentary requirements;

112  Item No. 9, the Sangguniang Kabataan Supplemental Comprehensive Barangay Youth
113 Development Plan 2019 – 2021 and Annual Barangay Youth Investment Plan 2020 of Barangay
114 Don Luis is still under review by the Committee to which the said matter was referred to;

116 At this juncture, Hon. Godfrey A. Umali moved for the suspension of the rules to allow the Request of
117EC Sports Complex (Cockpit Arena) for the renewal of franchise be moved from Unassigned Business to
118Committee Report in the Order and Calendar of Business for the reason that the Committee Report is
119readily available to be rendered by the Committee on Games and Amusement. The motion was seconded
120by Hon. Ronald I. Apritado and there being no objection, the same was considered by the Body.

122 The Suspension of the Rules was then moved to be lifted on motion of Hon. Ruel F. Ilao and seconded
123by Hon. Jerick P. Mercado.

125  Item No. 11, the Proposed Revision of the Market Code which was requested and initiated by the
126 Market Administrator is still under review wherein a Committee Hearing is being conducted by the
127 Committee on Ordinances and Legal Matters and Committee on Games and Amusement;

134  The Proposed Ordinance sponsored by Hon. Ruel F. Ilao, entitled: An Ordinance Enjoining All
135 Parents, Guardians and Applicants in the Registration of Live Birth to Plant a Tree for Mother Earth
136 and the New Born Child was presented to the Body by its proponent. The reading of the proposed
137 measure was dispensed with as copies thereof were already given to the Body. Hon. Ruel F. Ilao
138 moved that the said proposal be subjected to a Public Hearing on a scheduled to be determined by
139 the Sanggunian;

141  Next, the proposed measure sponsored by the Hon. Godfrey A. Umali, entitled: AN ORDINANCE
142 PROVIDING FOR THE SPEED LIMITS FOR ALL KINDS OF MOTOR VEHICLES WITHIN THE
143 TERRITORIAL JURISDICTION OF THE MUNICIPALITY OF SAN JOSE, BATANGAS,
144 PROVIDING PENALTIES FOR THE VIOLATION THEREOF, COLLECTION OF ROAD CRASH
145 DATA AND APPROPRIATING FUNDS FOR THIS PURPOSE was referred to the Committee on
146 Ordinances and Legal Matters for final review and refinement;

149UNASSIGNED BUSINESS:
150  Item No. 3.1.1, the request of the Municipal Mayor for authority to negotiate with the lot owner/s of
151 the property covered by Tax Declaration – ARP No. 20-0166-00013 relative to the intention of this
152 local government to purchase real property for the proposed construction of a Multi-Purpose
153 Building for the enhancement of public infrastructure and community affairs services of this
154 Municipality was considered for forthwith approval. Hon. Ronald I. Apritado moved for the passage
155 of a resolution granting such request on its First, Second and Final Reading. There being no
156 objection, the following is passed as:

161  Item No. 3.1.2, a complaint filed by the residence along the provincial road in Barangay Tugtug

166 Government to the books of Barangay Government of Lumil was referred to the Committee on

190 Hon. Godfrey A. Umali, Vice-Chairman of the Committee on Games and Amusement, rendered the
191Committee Report which was embodied hereunder as:

195 At this point, Hon. Godfrey A. Umali moved for the adoption of the foregoing Committee Report and
196passage of a SB Resolution granting provisional franchise in favor of the EC Sports Center (Cockpit Arena).
197 This was objected into by Hon. Ruel F. Ilao as he manifested certain findings and observations on the
198rendered Committee Report. He pointed out that in accordance with Section 66.e.ii of Ordinance No. ____,
199which provides the requisites for the renewal of franchise for the operation of cockpit arena, the applicant
200have not yet submitted the audited financial statement and lease contract with the operator or any legal
201instrument that will support the partnership agreement with the latter.

203 There being an objection, the Honorable Presiding Officer put the foregoing motion into votation wherein

223QUESTION HOUR:
224  Hon. Godfrey A. Umali: reiteration on the water supply problem in Barangay Don Luis and Dagatan
225 wherein, to date, it has not been rectified nor remedial action from the LGU’s Waterworks Section;
226  Hon. Alex A. Mendoza: asked if there is a possibility to amend the truck ban ordinance in the
227 Municipality of San Jose, Batangas. The Body apprised him that that the said regulation has
228 already been amended accordingly.

230ANNOUNCEMENTS:
231  Schedule of Committee Hearing with the Market Administrator, Mr. Alden M. Limbo is scheduled on
232 Thursday, February 6, 2020, 09:00 AM at the SB Session Hall;
233  Hon. Alex A. Mendoza: draw lots for the awarding of stalls in the Public Market will be conducted on
234 Tuesday, February 4, 2020.
