Membership in Mandatory Standing Committees.

The appointing authority who is usually the


Municipal Vice Mayor or the Regular Presiding Officer shall appoint the Chairman and
Members of the Standing Committees of this Sanggunian including the Local Special Bodies.
SECTION __. Interim Presiding Officer - It shall, however, be the privilege of the Regular
Presiding Officer or the Presiding Officer Pro Tempore pursuant to Section __ hereof, to
relinquish the chair in favor of any sanggunian member if said presiding officer wants to
participate in a floor discussion or to leave the session hall for a short period.

Committee on Labor and Employment - Passage of legislation which shall include but
not limited to matters related to labor; manpower development; maintenance of industrial
cooperation; labor education, standards and statistics; organization of labor market,
including recruitment, training & placement of workers and employment, manpower
promotion; and development of labor intensive technology.

The composition of which shall be determined by a majority vote of the Sanggunian members
present constituting a quorum
Restrictions to Committee Chairmanships and Memberships. - No Sanggunian member shall be
elected Chairman of more than ___ (__) committees and not more than ___ (__) membership in
other committees.
Section __. Executive Session. The Executive Session of the Sangguniang Bayan shall be held
behind closed doors. An Executive Session shall be held when requested by a Member who
shall explain his or her reasons for the request and the same is duly seconded. The public shall
be excluded from the gallery and the doors of the session hall shall be closed. The Minutes of
the proceedings in an Executive Session shall be recorded in a separate book and shall be treated
as confidential. The Presiding Officer and the Members of the Sanggunian as well as the
officials or persons who took part in the Executive Session are strictly prohibited from divulging
or revealing any of the confidential matters taken up in the session and all actuations which have
taken place therein. Any member who violates the prohibition of the secrecy may, by a majority
vote or discretion of the Regular Presiding Officer, be excluded from attending executive
sessions.

Section __. The Sangguniang Bayan of San Jose, Batangas adopts its Official Seal consisting of
the following symbols and representations, viz:
 Circle – represents continuous flow and connection between the Sangguniang Bayan and
the people of the Municipality of San Jose, Batangas;

 The words: “Sangguniang Bayan; Municipality of San Jose, Batangas” – represents the
legislative branch of the Municipality of San Jose, Batangas;

 1765 – represents the founding year of the Municipality on April 26, 1765;

 2022 – represents the year of the adoption of the Official Seal of the Sanggunian;

 Colors: Blue, Red, White, and the Three Stars and a Sun – represents allegiance to the
Republic of the Philippines;

 Seventeen Green and Sixteen Yellow Sunrays – represents the thirty-three Barangays of
the Municipality of San Jose, Batangas;

 Scroll and Quill Pen – symbolizes duty of the Sanggunian to enact measures for the
benefit of the common good;

 Scale of Justice – represents the idea of the fair distribution of law, with no influence of
bias, privilege or corruption; and

 Gavel and Block – symbolizes the authority and right to act officially in the capacity of
Chair or Presiding Officer. It is used to call for attention or to punctuate rulings and
proclamations. It is customarily struck to indicate the opening (call to order), keep the
session or meeting itself calm and orderly, and the closing or adjournment of
proceedings, meeting or session. It also reminds every Member of the Sanggunian of
their duties and responsibilities as legislators;

Section __. Absence of the Secretary to the Sanggunian – In the absence of the Secretary to the
Sanggunian in a Special or Regular Session, the Regular or the Temporary Presiding Officer, as
the case may be, shall designate a Temporary Secretary.
Section __. Creation of Mandatory Standing Committees. The Sangguniang Bayan shall create
the following Standing Committees and its respective legislative jurisdiction of which shall be
provided hereunder:

Rule XVI
Suspension of the Rules
Section __. _______________. The number of votes required in order to suspend the Rules of
the Sanggunian shall be two-thirds (2/3) vote of the members present there being a quorum. If
no objection is raised, it shall be presumed that a unanimous vote/consent of the members was
taken. Otherwise, the number of votes required in this Section shall be strictly complied with.
Section. __. The Chairman of the Committee on Rules and Privileges shall move for the
suspension of the rules. In the absence of the Chairman, the Vice Chairman or any Member of
the Sangguniang Bayan may move for the suspension of the rules.
Section __. The following circumstances may justify the suspension of the rules:
 Time is of the essence;
 Such denial of the motion for the suspension of the rules may:
o Cause irreparable damage to life, limb and property;
o Gravely hamper the delivery of basic services; or
o Adversely affect peace and order or security;
 Urgent financial or budgetary requirement; and
 In such circumstances which will prejudice the interest of the public and general welfare.

Section __. It shall be understood that once a particular rules is suspended for a specific purpose,
only such particular rule is suspended and the other rules of the Sangguniang Bayan remain in
full force and effect.
