MEMORANDUM OF AGREEMENT

KNOW ALL MEN BY THESE PRESENTS: 

  
       This Memorandum of Agreement made and executed this
___day of _____________ at Iligan City by and between:
 
  THE LOCAL GOVERNMENT OF ILIGAN CITY, with office
address at Iligan City Hall, Buhanginan Hill, Pala-o, Iligan City, duly
represented in this act by MAYOR CELSO G. REGENCIA,
authorized under SP Resolution No. _______, hereinafter referred to
as the FIRST PARTY;
 
- and -
  
ILIGAN CITY NATIONAL SCHOOL OF FISHERIES, duly
represented in this act by its School Principal, MR. RONILLO APAS,
SR., with office address at Buru-un, Iligan City, hereinafter referred to
as the SECOND PARTY;
 
                                            WITNESSETH:
  
       WHEREAS, the FIRST PARTY aims to maximize and develop
the talents of the youth of Iligan City into productive skills thru its
Sports Development Program;
 
       WHEREAS, the SECOND PARTY has an existing standard
swimming pool facility funded by the local government (FIRST
PARTY) which purpose is to develop our students and youths
swimming skills with the following objectives: (a) to provide an
opportunity for students and youth to engage in a whole-some,
lifesaving, lifetime sport, and recreational activity of swimming;  (b) to
promote physical fitness and good patterns of physical development
and to encourage proper conditioning and health habits;  (c) to
provide opportunities for social, emotional, and educational
development and to encourage peer and family participation; and, (d)
to promote the involvement in age-group programs and provide an
opportunity for students and youth to compete in organized swimming
competitions;
 
        WHEREAS, the SECOND PARTY is ready and willing to
support the Sports Development Program of the FIRST PARTY thru
the utilization of the former’s swimming facility;
 
        WHEREAS, the FIRST PARTY and SECOND PARTY agree to
be partners in making best use of the talents of the youth of Iligan
City by encouraging them to be involved in the sports of swimming.

 NOW THEREFORE, for and in consideration of the foregoing
premises and subject to the following terms and conditions, both
parties have agreed as follows:
 
1.  That the term of this Agreement shall be ______ (____) years
from and after the execution of this Agreement, renewable upon
mutual agreement of the parties.
 
2.   That the SECOND PARTY shall allow the FIRST PARTY to
conduct its swimming training or competition at the latter’s swimming
pool.
 
3.  That the FIRST PARTY shall recruit and allow indigent youth of
Iligan City with potential and talent in the sports of swimming to
participate in its regular training program free of charge;
 
4.  That the FIRST PARTY shall assist indigent youth of Iligan City
participating in its program, to obtain athletic scholarship in various
colleges and universities in the country.
 
6.  That the SECOND PARTY undertakes to support the various
sports programs of the FIRST PARTY, such as but not limited to
participation in the LGU sponsored sports competitions. 

7.  That the FIRST PARTY shall be bound by the existing Rules and
Regulations of the SECOND PARTY swimming pool facility.
 
8.  That the FIRST PARTY hereby declares that the SECOND
PARTY shall not be liable for all kinds of accidents/injuries that may
arise during the training of the former at the latter’s premises.  It
further declares that the FIRST PARTY shall be responsible for
whatever injuries or damages it may incur during the training.

9. That the FIRST PARTY shall submit an annual calendar of

activities which shall be approved by the SECOND PARTY. In case
of conflict of schedule, the SECOND PARTY has priority to use the
facility.
 
     IN WITNESS WHEREOF, the parties have hereunto set their hand

bottom and on the lefthand margin of the first page thereof, by the
parties and their instrumental witnesses, and sealed with my notarial
seal.
