1. DEFINITIONS
“Agency” means The Regional Municipality of Peel, Peel Regional Police, Peel
Housing Corporation o/a Peel Living and any other government or agency or
board on behalf of which The Regional Municipality of Peel is acting and for the
purposes of the performance of the Contract shall mean the municipality or entity
awarding the Contract. For purposes of the Contract, “Agency” shall include
“Owner”.

“Bidding System” means the electronic system used by the Agency for its
public tenders, bids and request for proposals and requests for prequalification at
the following website: peelregion.bidsandtenders.ca, which is required to be
used for all dissemination of information by or on behalf of the Agency and all
submissions from Bidders for this Document.

“Document” means this Request for Prequalification document describing the


goods and/or services to be purchased and requesting Respondent qualifications
and includes, without limitation, those documents referenced on the index of the
Document and such addenda as may be issued by the Agency from time to time.

“Prequalified List” means the list of Respondents which have been deemed
prequalified by the Agency, through this Request for Prequalification process.

“Prequalified Respondent” means a Respondent who is prequalified as a result


of this Request for Prequalification process to submit a Bid for the Work identified
herein.

“Prequalification Submission” means the document as completed and


submitted by the Respondent in response to this Request for Prequalification.

“Procurement Representative” means the person named as the Procurement


Representative or designate on the Document.

“Projects” shall mean the Various Valve Replacement Projects – 500mm and
600mm in Diameter, for or which the Agency is seeking to prequalify
Respondents through this Request for Prequalification process.

“Region of Peel” has the same meaning as the Agency.

“Respondent” means any entity responding to this Request for Prequalification.

“RFPQ” means this Request for Prequalification.

2. INTRODUCTION
It is the intention of the Region of Peel (otherwise referred to as the Agency) to
prequalify through this Document (the “Prequalification Document”) a list of
Respondents who will be eligible to bid on the anticipated tender call for the
Various Valve Replacement Projects – 500mm and 600mm in Diameter, (the
“Projects”). The projects included are grouped together as a result of one or more
of the following; complexity, methodology and/or project value. Each project will
be tendered individually.

The Agency seeks experienced Respondents capable of supplying the services


required for these projects. Due to the nature and complexity of the work
involved, the Agency will be inviting only those Respondents who are most
experienced and qualified to bid on and undertake the specified scope of work.

The purpose of this document is to identify and select by means of


prequalification, Respondents who will then be invited to submit a bid on the
proposed work. By prequalifying Respondents, the Agency is still intent on
ensuring a competitive bidding process.

The prequalification process will be based on evaluating the information provided


by prospective Respondents against criteria set out in Section 6.3, Evaluation
Criteria and Scoring. Reference checks and requests for any additional
information will be made by the Agency without limitation in its sole discretion.

Respondents who are placed on the Prequalified List will be invited to submit a
tender for the proposed Project.

The Agency shall have no obligation to procure any goods or services from any
Respondent simply as a result of the Respondent’s participation in this Request
for Prequalification and possible inclusion in the Agency’s Prequalified List.

The Agency reserves the right to discontinue and/or re-issue the prequalification
process at any time without penalty and without incurring any financial obligation
to any respondent.

3. INFORMATION AND COMMUNICATIONS


Any questions or information required regarding this Document must be
submitted via the Agency’s Bidding System by clicking the ‘Submit a Question’
button for the selected prequalification opportunity at least four working days prior
to closing. Do not submit your questions via e-mail.

Any Respondent who requests and/or receives any information, with regards to
this Document, by any person(s) other than the Procurement Representative or
designate, may be disqualified from further consideration.

It is recommended that Respondents add noreply@bidsandtenders.ca to their


“safe senders” lists in their e-mail systems and monitor their spam/ clutter/ junk
filters to ensure they do not miss automatically generated messages sent by
bidsandtenders.ca that relate to this prequalification opportunity.

4. DATE AND PLACE FOR RECEIPT OF PREQUALIFICATION SUBMISSIONS


ELECTRONIC PREQUALIFICATION SUBMISSIONS ONLY shall be received by
the Agency through the Bidding System and must be received no later than the
Bid Closing Date and Time identified in the Agency’s Bidding System.

Prequalification Submissions submitted and/or received by any other method will


be disqualified by the Agency unless instructed otherwise by published addenda
in respect of the Document.

Only documents found on the Agency’s Bidding System are to be considered


“official” documents. The Agency accepts no responsibility for the accuracy or
completeness of information found on other websites. The onus is on the
Respondent to check the Bidding System to verify they have received all relevant
information. The Respondent risks submitting a prequalification submission
which does not comply with the Agency’s requirements for prequalification and is
therefore disqualified.

It is the Respondent’s sole responsibility to ensure their Prequalification


Submission is received by the time and date specified within the Document. The
receipt of Prequalification Submissions can be delayed due to a number of
factors including, but not limited to, “internet traffic”, file transfer size, and
transmission speed. The Respondent should allow sufficient time to upload its
Prequalification Submission, including any attachments. Late Prequalification
Submissions will not be accepted by the Agency’s Bidding System.

A Prequalification Submission will only be considered to be submitted once it has


been RECEIVED by the Agency in its Bidding System, regardless of when the
Prequalification Submission was submitted by the Respondent.

Respondents will be sent a confirmation e-mail by the Agency's Bidding System


to the e-mail address provided by the Respondent when it registered as a Plan
Taker in the Bidding System for the Document advising that its Prequalification
Submission was submitted successfully. Respondents should not consider its
Prequalification Submission to have been submitted until it has received the
confirmation e-mail.

The Agency is not responsible for any incomplete or misdirected Prequalification


Submissions due to electronic technical problems arising out of the Respondent's
use of the Agency's Bidding System. Respondents are to submit a request to the
Bidding System’s at https://bidsandtenders.zendesk.com/hc/en-us/requests/new.
Respondents are required to provide a point-by-point response to each section of
the Prequalification document. Submissions are to be accompanied by a cover

letter, signed by an authorized official and include the name of the Respondent’s
contact person.

5. REQUIREMENTS OF THE REQUEST FOR PREQUALIFICATION PROCESS

5.1 Accessibility for Ontarians With Disabilities


All of the Agency’s vendors must comply with the Accessibility for
Ontarians with Disabilities Act 2005, and its Regulations thereunder with
regard to the provision of goods or services to persons with disabilities.
The respondent selected to deliver the goods and/or services through the
subsequent tender or proposal call will be required to acknowledge that
pursuant to the Accessibility for Ontarians with Disabilities Act 2005, the
Region of Peel must, in deciding to purchase goods or services through
its procurement process, consider accessibility for persons with disabilities
to such goods or services. This legislation can be accessed through the
following link to the Government of Ontario’s website:

at peelregion.ca/purchasing, “Additional Information for Bidders” and view
the accessibility standards.

5.2 Reporting and Review of Material Changes in a Prequalification


Submission
Respondents have an ongoing obligation at all times to report any
material change in their Prequalification Submission, or any other form
submitted in connection with this RFPQ.

If at any time following the release of the Prequalified List, there is a


material change to information provided in a Respondent’s
Prequalification Submission, the Prequalified Respondent shall
immediately provide details of such change in accordance with any
requirements the Agency may impose, in its discretion, at that time.
Failure to respond to an Agency request for updated information may
result in the Respondent being removed from the Prequalified List and not
being permitted to respond to any future bidding opportunities associated
with this Request for Prequalification.

5.3 No Honorarium
All costs and expenses incurred by each Respondent in the preparation
and delivery of its Prequalification Submission or in providing any
additional information in connection with the evaluation of its
Prequalification Submission or otherwise shall be borne solely by that
Respondent. The Agency shall not be liable to pay any costs or expenses
of any Respondent or prospective Respondent or to reimburse or
compensate a Respondent or prospective Respondent in any manner
whatsoever under any circumstances for the preparation and delivery of
its Prequalification Submission, for provision of any clarifications or
information requested or required by the Agency pursuant to this process
or for any other reason, including in the event of the rejection of any or all
Prequalification Submissions or if the Agency decides not to proceed with
any subsequent procurement process. For clarity, the Agency assumes
no obligation, responsibility, or liability whatsoever to compensate or

reimburse all or part of the costs or expenses incurred or alleged to have
been incurred by any party considering a response to this Request for
Prequalification, all of which costs and expenses shall be borne solely by
the relevant party.

5.4 Claims
Each Respondent acknowledges that it does not have any claim against
the Agency or any of its Representatives if the Agency, for any reason
whatsoever:
(i) does not select any Prequalified Respondent;
(ii) suspends, cancels or modifies the procurement process,
this Document or the Work (including modification of the
nature or scope of the Work, the procurement process or
both) or takes any other action or exercises its discretion or
judgment, in each case, as contemplated in the RFPQ
Documents;
(iii) accepts any compliant or non-compliant Prequalification
Submission;

Each Respondent waives any and all claims against the Agency
whatsoever, including claims for consequential or indirect loss including
loss of profits, loss of revenue or loss of opportunity, if the Respondent is
not prequalified.

5.5 Agency Rights


5.5.1 The Agency shall have no obligation to procure any goods or
services from any Respondent as a result of the Respondent’s
participation in this Request for Prequalification and possible
prequalification.
5.5.2 The Agency reserves the right to exercise complete, absolute and
unfettered discretion in all aspects of the conduct of the
procurement process, the assessment and evaluation of the
Prequalification Submissions including the determination of
criteria, the ranking of the Prequalification Submissions and the
selection, if any, of Prequalified Respondents, without incurring
any liability, penalty or cost whatsoever to any Respondent or
prospective Respondent, including for any costs, expenses, losses
or damages incurred by any Respondent or prospective
Respondent, and without giving any reasons therefor.
5.5.3 Notwithstanding anything else in this Document, the Agency
reserves the right, at any time, in its discretion and without
limitation to any other rights of the Agency hereunder or otherwise
at law:
(i) to change the dates, schedule, deadlines, processes and
requirements set out in the Document, or to change the
scope of the Projects;
(ii) to cancel this Request for Prequalification or the Work,
without stating reasons therefor, either before or after the
Prequalification Submission Deadline or before or after any
Respondents may have prequalified;

(iii) to elect not to proceed with this procurement process or the
Projects for any reason whatsoever;
(iv) to waive non-compliance by any Respondent;
(v) to accept or reject any or all Prequalification Submissions,
including to reject a Prequalification Submission if it is
qualified in any manner;
(vi) to change the limits, scope and details of the Work;
(vii) to re-issue the same Request for Prequalification or a
different request for prequalification document in relation to
the Work;
(viii) to disqualify any Respondent or Respondent Team
Member that (i) does not meet any requirement of this
Request for Prequalification or that contravenes any
prohibition or requirement that is contained in this
Document in respect of the conduct of Respondents, or (ii)
has or may have an economic or other interest that
conflicts with or could reasonably be perceived to conflict
with or be contrary to the objectives of the Work or the
procurement process, whether or not such interest
constitutes a conflict of interest, or (iii) has information
which might provide it with an unfair advantage over other
Respondents;

in each case, without incurring any liability for costs, expenses or


damages incurred by any Respondent or prospective Respondent.

5.5.4 Without limiting any other rights that may be exercised by the
Agency pursuant to this Document or otherwise at law, the Agency
reserves the right, in its discretion, to consider, in its evaluation of
any Prequalification Submission, without limitation:
(i) information obtained through reference checks made
pursuant to this RFPQ process;
(ii) past performance history of any Respondent, completion
history (including extended completion dates), litigation
history (including construction liens filed by subcontractors
for non-payment), claims history and environmental
compliance history of any Respondent, and to reject a
Prequalification Submission if same is not satisfactory to
the Agency;
(iii) if the Respondent has, in the last five years, been
disqualified from any other procurement process as the
result of any convictions related to inappropriate bidding
practices or unethical behaviour or the Respondent has
been convicted or incurred any administrative penalties or
liability related to inappropriate bidding practices or
unethical behaviour in relation to a public or broader public
sector tender or procurement in any Canadian or other
jurisdiction; or
(iv) if the Respondent or any of their respective directors or
officers has, in the last five years, been the subject of an

adverse ruling or conviction involving fraud, fraudulent
misrepresentation or professional conduct.

5.5.5 Should a Respondent give or offer any gratuity to or attempt to


bribe any staff, elected official or representative of the Agency, or
to commit collusion or fraud, the Agency shall be at liberty, without
liability, penalty or cost, to reject or disqualify and give no further
consideration to such Respondent’s Prequalification Submission.

5.5.6 By submitting a Prequalification Submission, each Respondent


represents and declares that:
(i) no member, officer or employee of the Agency or its
Council has or will have an interest, directly or indirectly, in
the performance of any resulting contract by the
Respondent, or in the supplies, work or business in
connection with the said contract, or in any portion of the
profits thereof, or in any monies to be derived therefrom;
(ii) neither the Respondent nor any of their respective
Representatives will:
(a) make any public comment, respond to questions in a
public forum, or carry out any activities to publicly
promote or advertise their qualifications, interest in or
participation in this Request for Prequalification process
without the Agency’s prior written consent, which
consent may be arbitrarily withheld or delayed; or
(b) engage in any way whatsoever in any form of political
or other lobbying; and
(c) the Prequalification Submission is not made in collusion
with any other Respondent making a Prequalification
Submission for the same goods and services and is, in
all respects, fair and without fraud.

5.6 Conflict of Interest/Unfair Advantage


5.6.1 By submitting a Prequalification Submission, each Respondent
represents and warrants that neither it nor any of its respective
representatives has any actual, apparent or potential conflict of
interest or existing business or other relationship with the Agency
or any party that gives rise or might give rise to an unfair
advantage (a “Conflict of Interest”). Each Respondent
acknowledges that it is within the Agency’s discretion to determine
whether a Conflict of Interest exists. By submitting a
Prequalification Submission, each Respondent thereby releases
and forever discharges the Agency from any and all liability related
to any determination the Agency may make regarding Conflicts of
Interest, including any disqualification, prohibition, rejection or
contract termination which may result therefrom.

5.6.2 Each Respondent shall:


(i) avoid any actual, apparent or potential Conflict of Interest
in connection with the procurement process, including in
connection with the preparation of its Prequalification

Submission, and in its performance of its obligations under
any contract entered into in connection with or resulting
from the procurement process;
(ii) disclose to the Agency without delay any actual, apparent
or potential Conflict of Interest that arises during the
procurement process or in connection with the
performance of its obligations under any contract entered
into in connection with or resulting from the procurement
process, providing additional clarifying information to the
Agency as required so that the Agency may assess the
impact of the Conflict of Interest on the integrity of the
procurement process; and,
(iii) comply with any requirements prescribed by the Agency, in
its discretion, to mitigate or resolve any Conflict of Interest
in the event that, in the Agency’s judgment, such Conflict of
Interest is capable of being mitigated or resolved.

5.6.3 In addition to all other rights in this Document or otherwise


available at law or in equity, the Agency may, in its discretion,
immediately disqualify a Respondent from the procurement
process or may terminate any contract entered into in connection
with or resulting from the procurement process, without liability,
penalty or cost, upon giving notice to the Respondent if:
(i) the Respondent or any of their respective representatives
fails to disclose or has failed to disclose any Conflict of
Interest;
(ii) the Respondent fails to comply with any requirements
prescribed by the Agency, in its judgment, to mitigate or
resolve a Conflict of Interest; or
(iii) in the Agency’s judgment, the Respondent’s Conflict of
Interest cannot be mitigated or resolved.

5.7 Materially False, Incorrect or Misleading Information


The Agency may, in its discretion, independently verify any information in
any or all of the Prequalification Submissions. The Agency, without
liability, penalty or cost, may, at any time during the Request for
Prequalification process, reject any Prequalification Submission or
disqualify any Respondent if, in the discretion of the Agency, such
Prequalification Submission contains materially false, incorrect or
misleading information. The Agency also has the right to disqualify any
Respondent and/or to reject the Prequalification Submission of any
Respondent that has failed to disclose information that would be
reasonably likely, if disclosed, to materially affect the Agency’s evaluation
of the relevant Prequalification Submission. The Agency has no
obligation whatsoever to verify independently any information contained in
any Prequalification Submission.

5.8 Litigation Prohibition


The Agency reserves the right, without liability, penalty or cost, to
disqualify any Respondent and to reject the Prequalification Submission
of any Respondent where such Respondent has advanced a claim or has

instituted a legal proceeding against the Agency or against whom the
Agency has a claim or has instituted a legal proceeding, with respect to
any previous contract, procurement or business transaction.

5.9 Debriefing
Any Respondent that has not been approved to proceed further in this
prequalification process may request a debriefing from the Agency
following receipt of notification that it has not been prequalified. Any
information provided by the Agency in good faith during a debriefing shall
not be used against the Agency or any of its Representatives in any way
whatsoever, including the commencement of any legal action.

5.10 Confidentiality, MFIPPA, Ownership of Prequalification


Submissions, Public Disclosure
5.10.1 Each Respondent agrees to protect and maintain the
confidentiality of all personal or other information that the
Respondent accesses or of which the Respondent acquires
knowledge as a result of the services in connection with the Work,
and agrees to use, collect, disclose, retain, protect and dispose of
the personal information only in accordance with applicable law.
No Respondent shall disclose any such information except with
the Agency’s prior written consent. The provisions of any
indemnity contained in this Document or any contract entered into
between a Respondent and the Agency relating to the RFPQ
Documents, the procurement process or the Work shall apply to
any breach of the privacy or confidentiality requirements set out in
this Section 5.10 [Confidentiality, MFIPPA, Ownership of
Prequalification Submissions, Public Disclosure]. Each
Respondent shall ensure that its representatives, and anyone else
for whom it is responsible in law adhere to the requirements of this
Section 5.10 [Confidentiality, MFIPPA, Ownership of
Prequalification Submissions, Public Disclosure] regarding privacy
and confidentiality.

5.10.2 The Agency, and the Agency’s responsibilities under this


Document and any resulting contract, are subject to all applicable
privacy and freedom of information legislation including the
Municipal Freedom of Information and Protection of Privacy Act,
R.S.O. 1990 c.M.56, as amended (“MFIPPA”) with respect to the
collection, use, disclosure, retention and protection of confidential,
sensitive or personal information under the Agency’s custody and
control. Respondents are advised that the Agency may be
required to disclose the Documents, the Request for Proposal or
Request for Tender and all or part of any or all Prequalification
Submissions and proposals/tenders and information contained
therein and documents provided to the Agency by any Respondent
in connection with this procurement process, and any resulting
contract and associated documents pursuant to MFIPPA.
Respondents are further advised that MFIPPA may provide
protection for confidential and proprietary business information and
are strongly advised to consult their own legal advisors as to the

appropriate way in which confidential or proprietary business
information should be marked as such in their Prequalification
Submissions.

5.10.3 Subject to the provisions of MFIPPA, the Agency will use


reasonable commercial efforts to safeguard the confidentiality of
any information identified by a Respondent as confidential but
shall not be liable in any way whatsoever to any Respondent if
such information is required to be and is disclosed pursuant to
MFIPPA or other applicable law.

5.10.4 The Prequalification Submissions, along with all correspondence,


documentation and information provided to the Agency by any
Respondent in connection with or arising out of the Prequalification
Submission, once received by the Agency, shall become the
property of the Agency.

5.10.5 Each Respondent acknowledges that the Agency cannot


guarantee it can honour requests to keep Respondent information
confidential in light of requirements of applicable law, and also in
light of the need for transparency and public disclosure where
release of Respondent information in public reports to Council
related to the Procurement Process or the Projects is necessary.

5.10.6 The Agency is committed to an open and transparent Procurement


Process while understanding the Respondents’ need for protection
of confidential commercial information. To assist the Agency in
meeting its commitment, Respondents shall cooperate and extend
all reasonable accommodation.

5.11 Agency’s Discretion and Judgment


All references in the Documents to the Agency’s “discretion” means the
Agency’s sole, absolute, unfettered, unqualified, subjective discretion and
all references to the Agency’s “judgment” means the Agency’s sole,
absolute, unfettered, unqualified, subjective judgment.

5.12 Acceptance of Terms


Each Respondent, by submitting a response to this Request for
Prequalification, agrees to accept the decision of the Agency’s evaluation
committee as final, and each Respondent represents that they have read,
completely understand, and accept, the terms and conditions contained
herein in full.

5.13 No Contract “A”


This Request for Prequalification is not an offer to enter into any contract
of any kind whatsoever. This Request for Prequalification is not intended
to create a bidding contract (often referred to as “Contract A”).

5.14 Renewal Process Clause


The Agency reserves the right, without liability, penalty or cost, to at any
point, review and augment the list of Projects indicated herein. Should the

Agency decide to add additional Project(s) after the close of the
Prequalification process, they will be of similar size and scope as the
Projects stated in this Prequalification Document and those Respondents
that are successfully prequalified through this call shall be invited to
submit a bid response for the additional Project(s).

The Prequalified List resulting from this prequalification process may be


subject to an annual refresh, at the sole discretion of the Agency. The
intent of the annual refresh would be to give Bidders who are not already
prequalified, the opportunity to be added to the Prequalified List. The
Agency reserves the right in its sole discretion to add newly Prequalified
Bidder(s) annually; based upon the results of the annual refresh, should it
occur.

6. PREQUALIFICATION EVALUATION METHODOLOGY AND SCORING


6.1 Evaluation Process
The Agency will evaluate the Prequalification Submissions in accordance
with the following steps:

6.1.1 Step 1: Substantial Completeness and Compliance Review


Each Prequalification Submission will be subject to a substantial
completeness and compliance review to assess whether the
submission is substantially complete and compliant with the
requirements of the Document. The substantial completeness and
compliance review will assess whether the Prequalification
Submission contains all material information and forms required to
be submitted hereunder.

6.1.2 Step 2: Evaluation of Rated Criteria


The Agency will evaluate the Prequalification Submissions that
have successfully passed the substantial completeness and
compliance review. Prequalification Submissions will be
evaluated and scored in accordance with the evaluation of rated
requirements identified in Section 6.3 Evaluation Criteria and
Scoring.

6.1.3 Step 3: Reference Checks


At the Agency’s discretion, Prequalification Submissions may be
subject to reference checks. Where reference checks are
completed, scores may be adjusted, as required, based on
information obtained through the reference checks.

6.1.4 Step 4: Scoring Thresholds for Prequalification


The Prequalification Submissions which achieve a score of 65
points or more based on Section 6.3 Evaluation Criteria and
Scoring will be placed upon the Prequalified List. A Respondent
that scores less than 65 points will not be prequalified for the
Projects.

6.1.5 Step 5: Identification of the Prequalified Respondents

Based on the process identified in Step 4 herein, the Agency will
notify the Prequalified Respondents and will post the results on
the Agency’s Bidding System.

6.2 Clarifications of Prequalification Submissions


At any time during the evaluation of a Prequalification Submission, the
Agency may request a Respondent to provide clarification of any part of
its Prequalification Submission. The Agency’s evaluation of a
Prequalification Submission will consider any clarifications provided in
writing by a Respondent in response to an Agency request. The Agency
is not obligated to seek clarification from any Respondent.

6.3 Evaluation Criteria and Scoring

6.3.1 Prequalification Submissions will be evaluated by an evaluation


committee based on the following categories. The disclosure of
the allocated weightings for each category is provided to assist
Respondents in preparing a Prequalification Submission that best
meets the requirements of the Agency.

6.3.2 Maximum points for each category will be awarded by the


evaluation team in cases where the Respondent’s submission
response for a given evaluation category clearly meets the
experience requirements set out in this document for that
category. No additional points will be awarded for Respondent’s
submission responses that exceed the experience requirements
set out in the document for a given category.

6.3.3 A Respondent must achieve 65 points or more out of 100 in order


to be prequalified for the Projects. A Respondent that scores less
than 65 points will not be prequalified for the Projects.

6.3.5 Final determination of the Prequalified List shall be based on the
information provided by Respondents in response to this
Prequalification Document and which, at the sole and absolute
discretion of the Agency’s evaluation committee, meets all the
prequalification criteria.

7. DETAILED SCOPE OF WORK FOR VARIOUS PROJECTS


The Agency has identified the following Projects as described in the Detailed
Scope of Work and without limiting the Scope of Work for the projects. The
Respondent shall refer to the Scoping Maps (where available) in Appendix 10.1
to review the various Projects and project areas where provided.

7.1 Project Area 1 – Queen Street East from Bramalea Road to West
Drive and West Drive from Queen Street East to Clark Boulevard
7.1.1 Scope
The proposed work includes replacement of three 600mm
diameter butterfly valves, and the addition of one 600mm diameter
valve on the existing 600mm CPP watermain in this area. The
work will also include, but not be limited to, replacement of 600mm
CPP pipe (to accommodate the valve replacements), exploratory
work, daylighting, WM assets investigation, flushing and draining
watermain and chambers.

7.1.2 Special Constraints


• Working near and adjacent to overhead and / or underground
high voltage hydro utilities;
• Managing high traffic areas and large arterial roads including
dealing with construction through busy intersections;
Implementing detours and coordinating with local municipality’s
transit
• Significant coordination efforts with operation’s staff,
businesses, residential buildings, transit and stakeholders;
• Working after hours, nighttime and on holidays.
• The need to deploy multiple crews to complete all work during
one single isolation operation in a compressed schedule.
• Estimated Tender Schedule: August 2021.

replacements the Vendor may be required to replace drain valves
and Air Release valves within existing chambers.

7.2.2 Special Constraints


• Managing high traffic areas and large arterial roads including
dealing with construction through busy intersections.
• Significant coordination efforts with operation’s staff,
businesses, residential buildings, transit and stakeholders.
• Working after hours, nighttime and on holidays.
• The need to deploy multiple crews to complete all work during
one single isolation operation in a compressed schedule.
• Tender Schedule: July-2021 Contractor must be available to
perform the work immediately after contract award.
• Estimated Tender Schedule: August 2021.

7.3.1 Scope
The Hurontario LRT (HuLRT) project is under construction, which
includes the relocation and upgrades of the Region of Peel’s water

to the valve replacement contract to allow the vendor to support
the Hurontario LRT construction from 2021 to 2024. Support
services may include:

• Watermain repairs on large diameter watermains.

• Large diameter valve replacements or repairs to allow the


HuLRT contractor to complete future connections.

• Assist Region of Peel operations when complete large


diameter watermain shutdowns.

• Flushing and cleaning out existing valve chambers as


required.

7.3.2 Special Constraints


• Managing high traffic areas and large arterial roads including
dealing with construction through busy intersections.
• Significant coordination efforts with operation’s staff,
businesses, residential buildings, transit and stakeholders;

construction from 2021 to 2024.

7.4 Project Area 4 – Goreway Drive from Steeles Avenue East to


Brandon Gate Drive
7.4.1 Scope
The proposed work includes replacement of two 500mm diameter
butterfly valves within existing valve chambers on Goreway Drive.
The work will also include, but not be limited to, replacement of
500mm CPP pipe, exploratory work, daylighting, and WM assets
investigation.

7.4.2 Special Constraints


• Managing high traffic areas and large arterial roads.
• Significant coordination efforts with operation’s staff,
businesses, residential buildings, transit and stakeholders.
• Working after hours, nighttime and on holidays.
• The need to deploy multiple crews to complete all work during
one single isolation operation in a compressed schedule.

8. REQUEST FOR INFORMATION


The Prequalification Submission shall include all of the information requested in
this Request for Information section. The information is to be uploaded in the
appropriate upload area in the Online Bidding System Forms. Each response to
a request for information should clearly identify the section of the Request for
Information to which it is responding (by number and heading). Failure to provide
an adequate response to each of the rated requirements will result in the
Respondent receiving a fail for that criteria. Information provided by the
Respondent will be used for the sole purpose of determining the Respondent’s
experience and qualifications. Information submitted is subject to verification,
and further pertinent information may be obtained from references.

8.1 Respondents are required to prepare a comprehensive response in the


Online Bidding System Forms for all Items in this section. Failure to
provide an adequate response in the Online Bidding Forms may result in
disqualification.

8.2 Respondents are required to achieve a “Pass” on all General Contractor –


Mandatory Submission Information as set out in Section 8.5. Provided
that all the Respondent’s supplied mandatory information receives a pass,
their Prequalification Submission will be further evaluated according to the
criteria and respective weightings indicated in Section 6.3, Evaluation and
Scoring.

8.3 Information provided by the Respondents will only be used for the sole
purpose of determining the Respondent’s experience and qualifications.

8.4 Information submitted will be subject to verification, and further pertinent


information may be obtained from references. Reference checks by the
Owner will not be limited to those listed in the Respondent's
Prequalification Submission.

Only those Respondents whose submissions fully comply with the


requirements of Section 8.5, General Contractor – Mandatory Submission
Information and who receive an evaluation score of 65 points of more, as
determined by the Agency’s evaluation committee, shall be prequalified for
these Projects.

8.5 General Contractor - Mandatory Submission Information
8.5.1 WSIB Certificate of Clearance (Upload)
Provide a current Certificate of Clearance from the Workplace
Safety and Insurance Board valid at the time of closing of this
document. If the Respondent does not ordinarily carry on business
in the Province of Ontario, the Respondent shall provide
equivalent documentation from the jurisdiction in which it ordinarily
carries on business.

8.5.2 Bonding (Upload)


Provide a letter from the Respondent’s Bonding or Surety
Company stating that the Respondent has the capacity to obtain a
standard Performance Bond and Labour and Material Payment
Bond, each in the amount of 50 per cent of the Contract value,
which for the purposes of this prequalification is estimated up to
$3,000,000.

8.5.3 Insurance (Upload)


Provide a letter from the Bidder’s Insurance Company outlining the
Bidder's ability to obtain Commercial General Liability Insurance
and Automobile Liability Insurance as specified below:
(i) During the term of the Contract, the successful Vendor will
be required to maintain in full force and effect and at its
own expense, the following insurance coverage:
(ii) Commercial General Liability shall be with limits of not less
than $5,000,000;
(iii) Automobile Liability Insurance in an amount not less than
$2,000,000;
(iv) The Bidder’s Insurance Company shall have the capacity
to name the Agency, consultants, planners, project
managers, Bidder's subcontractors, and also other persons
which the Agency may reasonably require to be added, as
Additional Insured parties, for all policies of insurance
required by the Contract.
(v) All policies of insurance shall be written with an insurer
licensed to do business in Ontario; and
(vi) be provided in form and content acceptable to the Agency
acting reasonably;
(vii) be non-contributing with, and will apply only as primary and
not excess to any other insurance available to the Agency;
and, contain an undertaking by the insurers to notify the
Agency in writing not less than 30 days before any material
change, cancellation, lapse or termination of the policies.
(viii) Notwithstanding anything else in this Document, the
Agency reserves the right, at any time, in its discretion and
without limitation to any other rights of the Agency
hereunder or otherwise at law, to change the insurance or
bonding requirements set out in this Document, for any
Projects associated with this Request for Prequalification
process.

8.6 Contractor Past Project Experience Requirements
8.6.1 Respondents shall submit evidence of all the following Contractor
experience obtained within the previous 7 years (at the time of
closing of this Prequalification Document) in their Prequalification
Submission.

Respondents shall note that the Respondent’s experience


and qualifications will be rated against the criteria provided.
Failure to meet all criteria across all weighted categories will
not be basis for an automatic pass or fail. Rather, a
Respondent must achieve 65 points or more to be
prequalified for the Projects.

(i) Completed three (3) linear infrastructure (AWWA C301


Concrete Pressure Pipe watermain) projects where the
Vendor fulfilled the role of General Contractor in an urban
area and within the municipal right-of-way, and the sum
construction value of the three projects is equal to or
greater than $5,000,000.

(Contractor Experience – Table 1)

(ii) Completed a minimum of two (2) modifications, and or


alterations on existing AWWA C301 Concrete Pressure
Pipe watermains where the Vendor fulfilled the role of
General Contractor in an urban area and or within the
municipal right-of-way, and where the vendor replaced
existing deficient isolation valve (mainline valve, i.e.: Gate
or Butterfly Valve).

Please note that the replacement of 300mm diameter


or smaller valves will not be considered in this
evaluation.

Should the Respondent have experience in replacing


valves 400mm diameter or larger as an additional scope to
other WM contracts, then please specify where the valve
replacement took place and under which contract.

(Contractor Experience – Table 2)

(iii) Completed a minimum of two (2) open cut projects where


the Respondent fulfilled the role of General Contractor on a
major arterial road, and was responsible for high level
traffic coordination and generation of TMPs or TPP, and
Traffic Detour plans were prepared. The projects shall also
demonstrate the Respondent’s ability to deal with specific
challenges as described in Section 7.

NOTE: Evaluation of Respondent experience will not be based on projects
currently underway, but solely on projects completed as of the date of
closing of this Prequalification Document.

It is a requirement that any Respondent referencing a Region of Peel


project to demonstrate their related experience must have Successfully
Completed the project. The Agency defines Successfully Completed as
receiving a Satisfactory Score (score of 70 and above) from the Agency as
detailed in the Agency’s Contractor Evaluation System procedures
(Procedure F35-27).

The Agency’s Contractor Evaluation System, Procedure F35-27, Item 27.7,


will apply in full force and effect during this Prequalification process, and
the latest version will apply.

The successful Vendor for the subsequent Project will be subject to the
Agency’s Contractor Evaluation System during the construction Project.

at any time and Vendors prequalified under this process agree to adhere to
the changes the Agency may make.

8.7 Open Cut Contractor Key Project Personnel Qualification


Requirements
Respondents shall submit evidence of the following staff experience
information in their Prequalification Submission at time of prequalification
Document closing:

8.7.1 Respondents shall name one (1) proposed Project Manager, one
(1) proposed Site Superintendent, and shall list a minimum of
four (4) crews, two (2) of which can be sub-contractors, under
Key Project Personnel Proposed for the Projects. The Project
Manager and Site Superintendent must each have a minimum of
ten (10) years in those respective roles of Project Manager
and Site Superintendent. Under those roles, they shall list
relevant experience in large diameter watermain (where pipe
material was CPP), at the time of closing of this Prequalification
Document.

Note that the Project Manager and Site Superintendent must be


two separate individuals.

watermain projects where at least one project must have a
minimum construction value equal to or greater than
$3,000,000.

(Contractor Site Superintendent Experience – Table 1)

(ii) Involvement as Site Superintendent for at least two (2)


modifications, and or alterations on existing AWWA C301
Concrete Pressure Pipe watermains where the Vendor
fulfilled the role of General Contractor in an urban area and
or within the municipal right-of-way, and where the vendor
replaced existing deficient isolation valve (mainline valve,
i.e.: Gate or Butterfly Valve).

Please note that the replacement of 300mm diameter


or smaller valves will not be considered in this
evaluation.

Should the Site Superintendent have experience in


replacing valves 400mm diameter or larger as an
additional scope to other Watermain contracts, then please
specify where the valve replacement took place and under

8.7.4 Respondents shall list a minimum of four (4) crews, two (2) of
which can be sub-contractors, crew members shall have
experience working on CPP watermain construction projects. Each
crew shall have a minimum of:
• One (1) Foreman (10 Years experience)
• One (1) Pipelayer (7 Years experience)
• Sufficient number of machine operators and
laborers to support the crew (minimum 2 operators
and 2 laborers)

It is a requirement that the four (4) crews can work simultaneously


to replace multiple valves (up to 5 valves) in one watermain
isolation event (up to 12 hours period).

Respondents shall provide a Curriculum Vitae for the Project


Manager and Site Superintendent. All Curriculum Vitae’s must be
uploaded in pdf format.

The Curriculum Vitae’s shall only include project experience that is


tailored to the requirements of this Document. The resumes shall
include: projects, year completed, description of project (how it
qualifies for the applicable criteria in the Document), and their
roles/responsibilities in the projects.

Maximum points for proposed personnel experience will be awarded by


the evaluation team in cases where the Respondent’s Prequalification
Submission response for personnel experience clearly meets the
experience requirements set out in this Document for that category. No
additional points will be awarded for Respondent’s submission responses
that exceed the experience requirements set out in the Document for
proposed personnel experience.

The Agency understands there may be changes to the proposed Project


Team Key Project Personnel that are beyond the Vendor’s control by the
time the Agency issues the Tender for the Projects. The Vendor must
advise the Agency of any change to the Project Team Key Project
Personnel. Any changes will require the prior written approval of the
Agency. A Notice to Proceed on any project will not be issued by the
Agency unless the Project Team Key Project Personnel have been
approved by the Agency. The Project Team Key Project Personnel shall
include those staff listed in Appendix 10.2 Online Bidder Prequalification
Forms (Tables) – General Contractor Key Project Personnel Table.

8.8 Clarifications of Prequalification Submissions


At any time during the evaluation of a Prequalification Submission, the
Agency may request a Respondent to provide clarification of any part of
its Prequalification Submission. The Agency’s evaluation of a
Prequalification Submission will consider any clarifications provided in

8.7.4 Construction Crews Experience and Availability

Respondents shall list a minimum of four (4) crews, two (2) of which can be sub-contractors, each crew shall have a minimum
of: One (1) Foreman, One (1) Topman, One (1) Pipelayer, One (1) Pipelayer Assistant, and Three (3) Operators.

Each crew member shall have a minimum of 10 years of experience working on CPP watermain construction. It is a
requirement that the four (4) crews can work simultaneously to replace multiple valves (up to 5 valves) in one watermain
isolation event (up to 12 hours period)
