Purdue University Residences Contract

2021-2022

 Terms. The Student agrees to make payment of the assessed rates to the University for the assigned room/apartment and selected meal plan, if applicable, for the term of this
University Residence Contract [“URC”] according to the University’s payment plan, administered by the Bursar’s Office. Bills will be issued on the schedule determined by the
Bursar’s Office and will be payable ten (10) days after the bill is issued. Assessed rates for beginning students will vary according to the specific room assignment within the
ranges shown on the accompanying “rate chart” which is incorporated herein. In the event a student signs this URC after the beginning of the academic year, the Student will
be charged the Daily Rate (the total amount due under this contract) ÷ (the number of days between the Starting Date and the Final Date) from the date the URC is executed
by the Student.

If the Student is a recipient of financial aid, including Guaranteed Student Loans, up to one semester’s housing payments plus any past due amounts will be deducted from the
available financial aid funds and credited to the Student’s housing bill at the beginning of each semester. This procedure will be followed for all students. A loss or reduction in
the Student’s financial aid award is not a reason for cancellation of this University Residences Contract [“URC”].

ONCE THE STUDENT SIGNS AND RETURNS THIS CONTRACT, THE STUDENT WILL BE EXPECTED TO FULFILL ALL CONDITIONS STATED IN THE CONTRACT
FOR THE ENTIRE PERIOD OF THE CONTRACT.

 Room/Apartment Assignment. University Residences reserves the rights of room/apartment assignment and of reassignment for the benefit of the individual student or the
group. University Residences endeavors to assign students to housing based upon the housing preference of the individual Student. However, a specific housing assignment
based upon the Student’s preference is not guaranteed or implied. University Residence’s inability to honor housing preferences or preliminary room/apartment assignments
shall not constitute a breach of this contract. University Residences reserves the right to change room/apartment assignments for any reason deemed appropriate. Students
who are assigned to temporary overflow accommodations at the beginning of the contract term agree to move when a room becomes available and accept the rate appropriate
to the new assignment. Assignment to temporary overflow accommodations does not constitute a breach of this contract. In the event of a national or regional emergency,
University Residences reserves the right to reassign a Student and to increase the occupancy of rooms.
 Improper Check Out. Student agrees a fee of $50.00 will be assessed by University Residences for failure to properly check out of the assigned room at the end of the contract
term.
 Use of Room/Apartment. The Student agrees that the room/apartment assigned shall be used solely as a personal residence related to the Student’s enrollment at Purdue
University’s West Lafayette campus and, in no event, shall the Student conduct any commercial activity. The Student agrees to keep their assigned room/apartment sanitary
and safe at all times. The Student agrees to pay a reasonable cleaning fee if the Student fails to clean the assigned room/apartment after reasonable notice of the need to do
so from University Residences. Where furniture is provided, it shall not be removed from the assigned room/apartment without prior approval. University Residences reserves
the right to enter the Student’s room/apartment for routine maintenance and for emergency purposes consistent with the Student’s constitutional right to be free of unreasonable
search and seizure. The Student agrees to be responsible for all damage to University property in the Student’s room/apartment. Additionally, the Student agrees University
Residences may assess a general breakage charge for damage to common areas in cases where the identity of the responsible individual is not known. The Student agrees a
general breakage fee may be assessed to a floor, unit, wing or the entire housing unit to which the Student is assigned.
 Loss or Damage to Property. The University shall have no responsibility for the theft, destruction, or loss of property belonging to or in the custody of the Student, from any
cause whatsoever, whether such losses occur anywhere in University Residences or in baggage handling related to shipment. Students are encouraged to carry their own
renter’s or personal property insurance.
 General Provisions.
a. A Student must be affiliated with the University as an enrolled student or through employment at Purdue University’s West Lafayette campus to be eligible to live in
University Residences. The execution and performance of the provisions of this contract by the University are conditioned upon the Student’s fulfilling and maintaining
the admission requirements, registration requirements, and financial requirements of Purdue University and University Residences.
b. The Student agrees that compliance with the terms of this University Residences Contractand all of the rules and regulations (as may be in force from time to time) of
Purdue University, including those of University Residences, and of the University Residences student organizations (including payment each semester of dues
established by the student organizations), is a condition of this contract. Violation of any term of this URC or any rule or regulation of Purdue University and/or
University Residences shall entitle the University, at its sole option and without notice, to cancel this contract. An election by the University not to exercise this
option under this section shall not preclude or waive the exercise of that option in the event of continuing or subsequent violations.
c. While University Residences will consider all roommate requests, they are not guaranteed and are dependent on space availability. It is possible that roommate requests
may be assigned together, but in a triple, quad or apartment.
d. The Student agrees to accept responsibility for the actions of the Student and for the actions of their guests.
e. Smoking is not permitted anywhere within University Residences.
f. University Residences’ Student Conduct Policies STRICTLY PROHIBITS illegal drugs (www.housing.purdue.edu/ResidentialLife/urguidelines.html). The Student's
violation of University Residences' policy regarding illegal drugs may result in cancellation of this URC.
g. University Residences’ Student Conduct Policies STRICTLY PROHIBITS weapons (www.housing.purdue.edu/ResidentialLife/urguidelines.html). The Student's
violation of University Residences' policy regarding weapons may result in cancellation of this URC.
h. The University reserves the right not to enter into and/or to terminate a URC for anyone who, in the sole discretion and judgment of University Residences, represents
a threat to the health or safety of University students, employees, or others in the University Residences' community.
i. The University reserves the right, in its sole discretion and judgment, to determine that past behavior including but not limited to criminal activity is such that the
interests of the University, University Students and employees and the University Residences' community, would best be served by the termination of a URC. It is the
policy of University Residences that convicted sexual offenders shall not reside in University Residences. If the University becomes aware that a student has a record
of criminal conviction(s) or other actions that could pose a risk to person or property and/or could be injurious or disruptive to the University Residences' community
environment, the University may not accept or may cancel the URC.
j. The Student agrees not to sell, sublease, or assign this URC to any one.
k. The Student agrees to pay charges assessed under this URC as provided in the Term, Early Occupancy and Late Check Out, Improper Check Out, Use of Room, Meal
Plan when applicable, Voluntary Cancellation and Non-Voluntary Cancellation Fees sections.
l. The University reserves the right to cancel this URC due to the inability or refusal of the Student to adjust to the concept and requirements of living in a student
residence environment.
m. If the Resident breaches or violates any provision in this Contract, the University may cancel this Contract without advance notice. In that event, the Resident shall
immediately vacate the apartment and shall pay to the University the Voluntary Cancellation Fee.
n. While living in University Residences, all students are responsible for their own care including maintaining personal hygiene as well as management of medical and
mental health conditions or illnesses. Students with disabilities who require reasonable accommodations from University Residences should contact the Disability
Resource Center Office at (765) 494-1247 or at drc@purdue.edu. Disability-related personal needs are the responsibility of individual students. Students are expected
to use the various resources available to provide care for themselves. Students who demonstrate the inability or refusal to care for themselves and/or who cause harm
to themselves or others may be asked to adhere to an action plan or have their URC terminated.
 Voluntary Cancellation by the Student. The Student may voluntarily cancel this URC until the last day of fall semester finals for the spring semester, upon paying the
Voluntary Cancellation Fee. Cancellation for any reason other than 1) withdrawal from the University, 2) being dropped by the University, or 3) cancellation by the University
pursuant to the General Provisions section of this URC shall be considered voluntary. The Voluntary Cancellation Fee shall be calculated as follows:

 The Daily Rate = (the total amount due under this contract) ÷ (the number of days between the Starting Date and the Final Date)
 Voluntary Contract Cancellation Amount = [(the Daily Rate) x (the number of days between the Starting Date and the cancellation date)]
+ [(.75) x (the Daily Rate) x (the number of days between the cancellation date and the Final Date)]
 Voluntary Cancellation Fee = (Voluntary Contract Cancellation Amount) – (the amount previously paid by the Student under this contract)

If the amount previously paid by the Student under this contract exceeds the Voluntary Contract Cancellation Amount, the University will refund the excess to the Student.
 Non-Voluntary Cancellation of Contract. If the Student cancels this URC because the Student withdraws from the University, ceases to be an enrolled student for other
reasons, including graduation or completion of the student’s academic program, or is dropped by the University, the Student will be charged a $500.00 service charge. If
cancellation under this section occurs at the end of the first semester, the $500.00 service charge will be waived if check out is completed immediately after the close of the
final examination period.

If the Student cancels this URC under this section, and if the Student subsequently re-enrolls at the University within 330 days following the Starting Date, the Student will be
deemed to have voluntarily cancelled this URC pursuant to the voluntary cancellation section. At the time of re-enrollment, the Student shall therefore pay the Voluntary
Cancellation Fee calculated under the voluntary cancellation, less any Non-Voluntary Cancellation Fee which the Student shall have paid under this section.

If the University cancels this URC pursuant to the general provisions section of this URC, the Student shall be charged the Voluntary Cancellation Fee as calculated in
voluntary cancellation section of this URC except the cancellation date may be set as a term of the conduct decision.
 Hold. The Student hereby agrees that for so long as there are any sums due the University and related to this URC, the University, at its sole option, may hold the Student’s
academic records. For purposes of this URC, the term “hold” shall mean that the University may lawfully refuse to surrender transcripts of the Student’s grades, courses, and
diploma and may refuse to permit the Student to enroll or register at the University for any academic term. This section shall not be construed as a waiver by the University of
its right to maintain any legal action against the Student in a court of competent jurisdiction. In the event the University files such legal action, the Student shall be liable for
the University’s attorneys’ fees and any judgment entered shall be without relief from valuation and appraisement laws.
 Rates Subject to Change. Rates are subject to change by the Board of Trustees of Purdue University at the beginning of any semester or session. The Student shall either
reject such new rates in writing within ten (10) days after notice thereof has been forwarded to the Student or be conclusively deemed to have accepted such rate increase.
 Late Arrival. Unless a Student requests an extension of the arrival period in writing from University Residences, University Residences is not obligated to hold a space
reservation past 12:00 noon on the first day of classes. If the Student fails to check in prior to 12:00 noon of the first day of classes, and appears subsequently, assignment
elsewhere will be made if space is available. If no space is available, the Resident is subject to forfeiture of the application deposit.
 Abandonment. University Residences may determine in its sole discretion that the Student has abandoned the assigned room if 1) the Student, in University Residences'
reasonable judgment, appears to have moved out; or 2) either the URC Term has expired or the Student has not been in the room for five (5) consecutive days while any
amount owed under this URC is due and unpaid. If the Student has abandoned the Student's room/apartment, then University Residences may remove and dispose of the
Student's personal property.
 Governing Law. This Agreement is to be governed by and construed in accordance with the laws of the State of Indiana. If any of the terms or conditions hereof conflict with
such law, then such terms or conditions shall be deemed inoperative and null and void insofar as they may be in conflict therewith and shall be deemed modified and
amended to conform to such law. Venue for any action hereunder shall be Tippecanoe County, Indiana, and the Student hereby consents to service of process from such
courts.
 Severability. The invalidity of any provision of this URC or of its application to any person or circumstance as determined by any governmental agency or court, shall in no
way affect the validity of any other provision hereof and all the terms of this URC shall be valid and enforceable to the fullest extent permitted by law.
 Headings. The headings preceding each paragraph herein are inserted merely as a matter of convenience, and shall not be deemed to be a part of the URC terms.

and ending with the last day on which final examinations are held for the academic year. The Resident agrees to make monthly payments of the assessed rates for the apartment to
the University’s Bursar’s Office for the Term of this Purdue Village Contract [“Contract”] according to the University’s payment plan, administered by the Bursar’s Office. Bills will be
issued by the Bursar’s Office and will be payable within ten (10) days of the date the bill is issued. The monthly payment for any partial month at the beginning or end of the Term will
be prorated according to the number of days in such month. Other charges which are arranged or contracted for by the Resident through the University shall be added to and payable
at the same time as the next bill. This billing cycle is subject to change by the University. New rates are effective July 1 for the following year. In the event that a Resident signs this
contract after the beginning of the academic year, the Resident will be charged the Daily Rate (the total amount due under this contract) ÷ (the number of days between the Starting
Date and the Final Date) from the date the contract is executed by the Resident.

The Resident agrees that this Contract is contingent upon the Resident’s affiliation with Purdue University’s West Lafayette campus, either as a student or as an employee. If the
Resident loses his or her affiliation with the University during the Term, the Resident will be permitted to continue to reside in the apartment until the end of the calendar month in
which the Resident’s affiliation with the University ends, contingent upon the Resident’s payment of a $500.00 processing fee and keeping current with monthly payments due through
the end of such month and upon the Resident’s continuing compliance with the other terms and conditions of this Contract. At the end of such month, this Contract will be automatically
terminated. Subject to availability of apartments, an extension of this Contract may be available through the summer months if a Resident will graduate at the end of the summer
session or is registered for classes for the next semester, or if the Resident otherwise continues his or her affiliation with the University. Those Residents who desire such an extension
should contact the Purdue Village Main Office.

Early Occupancy and Late Check Out. The Resident must obtain prior approval from University Residences to occupy the apartment before the beginning of the Term or after the

one (1) bedroom apartment. No more than eight (8) family members, including the Resident, may reside in a two (2) bedroom apartment. Visitors may not stay for more than two (2)
weeks. The Resident agrees that his or her family members are not eligible to reside in the apartment unless the Resident is also in continuous residence. The Resident agrees that
he or she must be in continuous residence at the apartment throughout the Term of the Contract unless prior written permission of University Residences is obtained.

Indiana State Law requires a person to be 21 years of age to consume alcohol. The consumption of alcohol is only allowed in the privacy of the Resident's apartment and is not to
be consumed outdoors or in community areas such as the parks or the Community Center. Residents are prohibited from exhibiting disruptive behavior influenced by the use of
alcohol.

Rates Subject to Change. If the Resident rejects the changed monthly payment, the Resident will be permitted to continue to reside in the apartment until the new monthly
payment goes into effect, contingent upon the Resident's payment of the existing monthly payments and upon the Resident's continuing compliance with the other terms and
conditions of this Contract.

Pets. A Resident may not have a pet in the apartment until he or she has provided the required documentation to University Residences and has received prior approval from
University Residences. If approval is granted, the Resident may be required to move to another building where pets are permitted.

Abandonment. Abandoned property is defined as property that is not properly stored. Items found in entryways or outside buildings that are not located in an appropriate storage
facility, i.e., storage space or bike rack, are considered abandoned property. All abandoned property will be removed and taken to the Purdue Village Administration Building to be
disposed of as trash or through the University's salvage and surplus department.
