AFFIDAVIT OF ADVERSE CLAIM

I, RENI B. BULARON, of legal age, widow, Filipino and resident


Block 8 Lot 14, Phase 1 Villa Trinitas Subdivision, Bugo, Cagayan de
Oro City after having been duly sworn to in accordance with law,
hereby depose and say:

That I am the buyer of a real property covered under TCT No. T-


64820 particularly described as follows:

“A PARCEL OF LAND (Lot 14, Block 8, Psd-10-015600, being a


portion of Lot 1-D-2-E-10 (LRC) Psd-96906, situated in the Barrio of
Bugo, City of Cagayan de Oro, Island of Mindanao. Bounded on the N.,
along line 2-3 by Road Lot 1 (10.00 M. wide); on the E., along long 3-4
by Lot 12; on the S., along line 4-1 by Lot 13; on the W., along line 1-
2 by Lot 16, all of Block 8 on the subdivision plan Psd-10-015600.
Beginning at the point marked “1” on the plan being S. 20 deg 40’E.,
3585.60m from BLLM No. 1. Pls-799. THENCE: N. 03 deg. 04’W., 16.06
m. to point 2; N., 86 deg. 37’E., 10.00 m., to point 3; S., 03 deg.
04’E., 16.09 m. to point 4; S. 86 deg. 47’W., 10.00 m., to point of
beginning, containing an area of ONE HUNDRED SIXTY ONE (161)
SQUARE METERS, more or less.”

That the above-mentioned real property was acquired by me by


virtue of DEED OF ABSOLUTE SALE WITH ASSUMPTION OF
MORTGAGE executed by VIRGILIO P. MAHINAY and EVELYN D.
MAHINAY in favor of RENI B. BULARON which DEED was notarized by
Atty. Emmanuel A. Akut and docketed in his notarial registry as
Document No. 296, Page No. 61, Book No. 136 Series of 2016 and
WAIVER OF RIGHTS WITH ASSUMPTION OF MORTGAGE
executed by VIRGILIO P. MAHINAY in favor of RENI B. BULARON
which was notarized by Atty. Emmanuel A. Akut and docketed in his
notarial registry as Document No. 297, Page No. 61, Book No. 136
Series of 2016;

 That the DEED OF ABSOLUTE SALE WITH ASSUMPTION OF


MORTGAGE and WAIVER OF RIGHTS WITH ASSUMPTION OF
MORTGAGE had not yet been registered at the Office of the Registrar
of Deeds of Cagayan de Oro City, as the original copy of the Owner’s
Duplicate of Title of the said property is yet to be surrendered to me

and the requirements thereof is still on the process. In this situation,
the interest of RENI B. BULARON over the property is not well-
protected under the law and there is a great possibility that the
registered owner will dispose, alienate, and encumber the property to
any person before the DEED OF ABSOLUTE SALE WITH ASSUMPTION
OF MORTGAGE and WAIVER OF RIGHTS WITH ASSUMPTION OF
MORTGAGE will be registered.

That this sworn ADVERSE CLAIM is the only means to protect the
interest of RENI B. BULARON under the present circumstances.

 Copy of the DEED OF ABSOLUTE SALE WITH ASSUMPTION OF


MORTGAGE and WAIVER OF RIGHTS WITH ASSUMPTION OF
MORTGAGE is hereto attached and marked as Annex A and made an
integral part hereof.

 That this ADVERSE CLAIM is not executed and intended to be


registered before the Registry of Deeds of Cagayan de Oro City to
harass nor annoy the registered owner or his transferee, but for the
protection of the affiant as having a legal interest over the property
before formal registration of the DEED OF ABSOLUTE SALE WITH
ASSUMPTION OF MORTGAGE and WAIVER OF RIGHTS WITH
ASSUMPTION OF MORTGAGE can be had.
