Case 1: Violates Republic Act 544 – An Act to Regulate the Practice of Civil Engineering in the
Philippines; Section 17 – Suspension and Revocation of Certificates

 On September 10, 2018, at 4:22 pm rappler release an official statement of 10 companies


investigated by the Department of Public Works and Highways that there are 10 firms
that bagged a total of P68.5 billion worth of contracts for the governments. In their cases
of this accused companies, they all share a record of unfinished projects and
unsatisfactory performance, a report by the Philippine Center for Investigative Journalism
(PCIJ) revealed. According to the PCIJ, over 2,200 contractors participated in the bidding
process also this companies that have proven guilty had been arrested and suspended
their authority of being a construction firm. This clearly violates section 17 of Republic
Act 544 where it states that the board shall have the power, after due notice and hearing
to suspend or revoke the certificate of registration for any cause mentioned in the
preceding section.

 The title of the case is about Mayor Richard Gomez Lambasts NHA for low-quality
housing material where the clash between the National Housing Authority and Ormoc
City Mayor Richard Gomez started when a series of video in a Facebook post by Kimmy
Urboda went viral after it appeared last September 24,2018. It showed Mayor Richard
Gomez inspecting the housing units for the earthquake victims. Apparently, Mayor
Richard is not happy regarding the on-going construction. One video showed the mayor
saying that building materials used for the project were substandard, with the soil being
mixed with sand and cement. On July 2017 a 6.5 earthquake hit the Visayas region. The
earthquake damaged 3,600 houses, which left two (2) people dead and 100 injured
according to data from the national disaster office. The NHA oversees building homes in
the villages of Gaas and Dolores in Ormoc City for the Victims. In this case it clearly
violates Republic Act 544; Section 23 preparation of plans and supervisions of
construction by registered civil engineer.

 On December 17, 2020 at 12:00 am a statement was released by the website philstar
GLOBAL that in Legazpi City two workers were buried alive and two others were
injured in an accident at a construction site in this city on Tuesday. Lt. Col. Rodelon
Betita, Legazpi City police chief, said Allan Andes 47 and Rolin Bagacay were declared
dead on arrival in a hospital. According to the witness the two men were installing the
steel frame foundation of a four-story hotel being constructed in Barangay Pinaric when
excavated soil and debris fell on them. Legazpi City Mayor Noel Rosal said he formed a
task force headed by the city’s engineering office to investigate the incident and
determine if there was violation of the building code. City engineer Clemente Ibo said
that they did not issue a building permit because the owner did not submit the
requirement, including an environmental compliance certificate.

 The department of Labor and Employment National Region has issued a work stoppage
order against a construction project of Momentum Construction and Development
Corporation in Sampaloc , Manila following an accident which reportedly led to the death
of worker. According to DOLE, the reported accident involving the death of one worker
happened on July 14, 2019 at the Momentum Construction and Development Corp.
project located at Piy Margal St. corner Dos Castillas St.

 Metro Manila (CNN Philippines, November 21) – has a statement that there is a steel bar
from a portion of the Skyway extension project crashed onto passing vehicles Saturday
morning in Muntinlupa City, leaving a motorcycle rider dead and at least six others
injured. EEI Corporation, the construction company in the Skyway Stage 3 project, said
in a statement that a crane being positioned “tilted and fell” on the steel girder, which
crushed vehicles below it. After the incident the company said that they would commit to
review safety and operating protocols to prevent and further accident. San Miguel
Corporation assured the public there will be a thorough investigation and the victims and
their families will be assisted.
