Explain in no more than 3 sentences.

1. Andrew was set to marry Brenda on April 30, 2021. The week before the wedding,
Andrew was admitted in the hospital for Covid and was still confined on their
wedding day. As he cannot go to the church to exchange vows with Brenda, Andrew
sent his friend, Charlie, to the church to represent him in the wedding. Can Andrew
validly appoint Charlie as his agent in this case? Why?

No, it is stated in Article 3 one of the requisite for marriage ‘A marriage ceremony
which takes place with the appearance of the contracting parties before the
solemnizing officer and their personal declaration that they take each other as
husband and wife in the presence of not less than two witnesses of legal age.” so if
the groom can’t attend the marriage cannot be done

2. Perla appointed Agnes as her agent, with authority to sell her car. Perla allowed
Agnes to drive the car to and from a possible client who wishes to test drive the car.
One day, Agnes drove the car to a personal event. Agnes got drunk at the event and
on her way home, met an accident damaging the car. The car was repaired and
Perla demanded payment from Agnes for the cost of the repair. Agnes refused to
pay alleging that Perla, as the owner, is the one liable. Is Agnes correct?

No, Agnes is liable to pay for the repair due to her negligence. Perla clearly stated
that Agnes can drive the car to and from a possible client for a test drive, since the
accident occur during a personal use, Agnes is therefore liable.

3. Perla authorized Agnes to sell her parcel of land in cash. Agnes had a hard time
selling the property considering its location where floods are a frequent occurrence.
Agnes thought of selling the property in installments instead so as just to be able to
dispose of it. Perla did not agree with Agnes’ decision and is filing a case against her
for breach of obligation. Is Agnes liable?

Yes, their agreement is to sell the land in cash, not installment, this is clearly a
breach of contract. Installment is a written agreement.
