AFFIDAVIT OF ADVERSE CLAIM

         I, CHESS A. MAN, of legal age, Filipino, single and a resident of 4584,


Purok 7, Rawis, Legazpi City after having been duly sworn to in accordance with
law, depose and state:

1. That on July 15, 2018, I have entered into a Deed of Conditional Sale which was
acknowledged on the same date before Notary Public Smiling B. Legend of
Legazpi City and entered in his Notarial Register as Doc. No. 2, Page 2, Book II,
Series of 2018. A copy of the said  Deed is hereto attached as ANNEX “A” and
made an integral part of this Affidavit;

2. That in the said Deed of Conditional Sale, I was the VENDEE of a certain parcel
of land covered by Transfer Certificate of Title No. 111222, more particularly
described as follows:

A PARCEL OF LAND (Lot 20 Blk 54 of consolidation subdivision plan (LRC) Pcs-


13265, being a portion of the consolidation of Lots 4751-A and 4751-B (LRC)
Psd-50533,Lot 3, Psd-100703, Lot 1, Psd-150980, LRC Rec. Nos. Nos. N-27024,
51768, 89632, N-11782, N-13466, and 21071 situated in the Doña Maria
Subdvision, Daraga, Albay, Luzon. Bounded on NE., point 4 to 1 by Road Lot 22,
on...to the point ofbeginning; containing an area of (280) square meters more
or less..."

3. That because I still have a balance on the purchase price in


the amount of P800,000.00 which is payable within one (1) (year) from the
date of signing thereof, it was stipulated in the aforementioned Deed that title
and ownership over the subject property will only be transferred upon full
payment of the same;

4. That the VENDOR in the said Deed of Conditional Sale agreed that upon its


execution, said Deed shall be annotated in the Title with
the Office of the Register of Deeds of Legazpi City;

5. However, since the said Deed of Conditional Sale per se could not be annotated


on the Title with the Office of the Register of Deeds, I am therefore executing
this Affidavit for the purpose of attesting to the truthfulness of the foregoing
allegations and in support of my request for the annotation of an adverse claim
over the parcel of land covered by the Transfer Certificate of Title No. 111222.

     IN WITNESS WHEREOF, I have hereunto set my hand this 6th day

ANNEX “A”

CONDITIONAL DEED OF SALE

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF ABSOLUTE SALE is entered into and executed by and between:

Smiling B. Legend of legal age, single, Filipina, with residence at 5428 ,


Purok 1, Rawis, Legazpi City, Philippines, with the authority to sell parcel of
land without improvements herein represented by their attorney by virtue
of Notarized Special Power of Attorney are hereinafter referred to as the
VENDOR/ TRANSFEROR;

-AND-

Chess A. Man, of legal age, Filipino, single, of legal age, Filipino and presently
residing at 4584, Purok 7, Rawis, Legazpi City, Philippines hereinafter referred
to as VENDEES/ TRANSFEREES.

WITNESSETH:

The VENDORS/ TRANFERORS are the owner of a lot and parcel of land and its
improvements as evidenced by Transfer Certificate Title no: 111222 (Annex
“A”) particularly described as follows:

Owner: Smiling B. Legend, of legal age, single

Address: 5428 , Purok 1, Rawis, Legazpi City, Philippines 


DESCRIPTION OF THE LAND
A PARCEL OF LAND (Lot 20 Blk 54 of consolidation subdivision plan (LRC) Pcs-
13265, being a portion of the consolidation of Lots 4751-A and 4751-B (LRC)
Psd-50533,Lot 3, Psd-100703, Lot 1, Psd-150980, LRC Rec. Nos. Nos. N-27024,
51768, 89632, N-11782, N-13466, and 21071 situated in the Doña Maria
Subdvision, Daraga, Albay, Luzon. Bounded on NE., point 4 to 1 by Road Lot 22,
on...to the point ofbeginning; containing an area of (280) square meters more
or less..."

WHEREAS, the VENDORS desire to sell the aforementioned property and the
VENDEES agree and promises to buy the aforementioned property including the
improvements therein.

WHERAS, the VENDEES are interested to purchase the above described property
subject to the following terms and conditions.

1. A selling price agreed by both parties is Php 600,000.00

2. A down payment of Php 200,000 will be paid by the VENDEES to


the VENDOR upon execution of this agreement and the remaining
amount will be paid thru post-dated checks and as follows:

a. Php 33, 333 on the 6th day of the month for 12 months

3. The initial down payment will be paid by the VENDEES to Vendor’s


Authorized representative in the form of bank check.

4. The VENDEES will issue four (4) postdated checks in favor of VENDEE’s
and/or to his Atty.-in- Fact upon presentation of latest notarized Special
Power of Attorney.

 
5. The VENDORS will shoulder all the payments for Capital Gain Tax,
Documentary Stamp Tax, Transfer Tax, Title Processing and other related
documents pertaining to Transfer of Ownership.

6. The VENDORS shall under take to execute the necessary DEED OF


ABSOLUTE SALE in favor of herein VENDEES upon full payment of the above
stated purchase price.

That the VENDOR complied with the provisions of ART.1623 of the New Civil
Code as well as the Land Reform Code of the Philippines.

IN WITNESS HEREOF, the parties have hereunto set their hands this 6 th day of
November 2018 in the City of Legazpi.

BEFORE ME, appeared the above stated parties showing their Identification
documents as stated below their names and known to me as the parties who
executed this Absolute Deed of Sale and they acknowledged to me as their free
and voluntary act and deed.

This document, consist of three (3) pages including this page where this
acknowledgement is written, with every page thereof duly signed by the parties
including their instrumental witnesses, at the bottom or left margin thereof and
seal with notarial seal, refers to a Conditional Deed of Sale of Real Property.
