Exercise I – Formulation of Investigation Interview Questions to ask the


complainant, the subject of the complaint, and the witness. Ten (10) Question
Each.

A. Complainant (Mr./Ms. Y)
1. Can you narrate to me what exactly happened?
My manager summoned me to his office on October 29, 2021. He stated that it
was critical. I suspected something was wrong with a customer, but it became
worse. He slammed the door and chastised me for failing to fulfill our monthly
objectives. He said that if I had been younger, I would have been able to come
up with new and lovely ideas like the other team.

2. Who committed the alleged age discrimination in the workplace?


My manager is the one that age-discriminated me.

3. What is your relationship with the accused?


The one who discriminated me is my manager.

4. When and where did the incident occur or is it ongoing?


Last October 29, 2021, at my boss's office, I was subjected to age discrimination
by my manager.

5. How did it happen?


My manager just lashed out at me, I guess he was having a bad day. But that
don’t justify his anger at me.

6. How did you react?


I just stood there, silent, and shocked because that was the first time he was so
angry that he crossed the line already.

7. Did anyone else see it happen? Any witnesses? Who? What did they say?
What did they do?
I think his secretary saw and heard what happened. They didn’t do anything
because they would be reprimanded, too.

8. Did the person who discriminated you did that to anyone else? If so, who?
Our team has previously attended meetings in his office, but this is the first time
he has acted in this manner in front of the team.

9. Did you report it to the management? What did they say or do?
I wanted to submit it to human resources so that we could determine where we
stood and whether disciplinary action was necessary. But they just said to let it
pass.

10. What action do you want the company to take?


I want the company to be punished, and my manager suspended. I want what
happened to me that position in the company doesn’t give you a right to
discriminate anyone.

B. Subject of the Complaint (Persons of Interest / Subject) (Mr./Ms. X)


1. What happened? Can you narrate to me the exact scenario?
I don’t know what you are talking about. I didn’t age-discriminate my subordinate.

2. If denied, what motive would anyone have to make these allegations up?
I don’t know. Maybe because she hates me, and want me out?

3. Where were you at the time alleged incidents occurred? Who witnessed
your presence?
I was on my way here. No one can attest to my whereabouts because I was
driving alone.

4. Where and when did it happen?


At my office last October 29, 2021.

5. How did it happen?


I was mad because my subordinate didn’t fulfil her role about our monthly
objectives.

6. How did the complainant(s) respond?


She was just quiet and quite shocked.

7. Are you aware of any other complaints by the complainant(s)?


I don’t think so. I don’t know any.

8. Are there any notes, documents, or other evidence to support your version
of the facts?
I’m afraid there are none.

9. Who else may know relevant information?


I think my secretary know something, she just haven’t interfered.
10. Did you discuss the incident(s) with anyone prior to this interview? If so,
who?
I haven’t talked to anybody about the incident after it happened until this
interview.

C. Witness (Mr./Ms. Y)
1. What did you witness?
I witnessed my boss shouting at someone from the team. She was a lot older
than anyone else in our department.

2. Who was involved?


My boss and someone from the same department.

3. What is your relationship with the complainant and the subject of


complaint?
The accused is my boss; I am his secretary. The complainant is someone from
the department, I have no particular relationship with her.

4. When and where did it happened?


It happened last October 29, 2021, at my boss’s office.

5. What did each person do or say?


My boss was so angry and yelled at her because she failed to reach the monthly
objective.

6. Did anyone else see it happened? If so, who?


I guess I was just the one that witnessed what happened.

7. What did you do after witnessing the incident?


I just listened but I didn’t interfere because I don’t want to be dragged into their
argument.

8. Did you report this to anyone in the management?


I talked to the HR, they just said, I should stay out of it to avoid bigger conflict.

9. Did you talk to anyone prior this investigation?


Yes, I talked to the complainant. I told her I was sorry and I explained why I didn’t
take action.

10. Do you know why the incident happened?


I guess my boss was just really stressed and that he was at his limit. As for the
complainant. I don’t know why she failed to reach the monthly objective.
