Eligibility

Introduction
As a NetApp® Keystone™ Services Certified Partner, you can earn incentives for selling and servicing
your brand of storage as a service that is backed by NetApp Keystone Flex Subscription.
These incentives include discounts to help cover your investment in building and managing your
solution that is powered by NetApp Keystone Flex Subscription. These incentives are subject to the
terms and conditions as outlined in this guide.
This guide explains how to attain NetApp Keystone Services Certified incentives and how you will
receive them.

NetApp Anti-Bribery and Anti-Corruption Policy

NetApp’s policy is to conduct its business activities in compliance with applicable anti-bribery and anti-
corruption laws, including the U.S. Foreign Corrupt Practices Act (FCPA) and other applicable anti-
bribery and anti-corruption laws in countries where NetApp conducts business.
NetApp employees or third parties such as NetApp partners shall not give, offer, promise, authorize,
or accept directly or indirectly anything of value in exchange for obtaining or retaining business or an
improper advantage. NetApp and its employees can be held criminally liable for payments to third
parties such as distributors, resellers, vendors, or other representatives if the person knew or should
have known that the payments will be used by the third party, in whole or in part, to make an improper
payment to a U.S. Government Official, a non-U.S. Government Official, or a private person.
Consequently, NetApp’s channel partners must comply with all applicable anti-bribery and anti-
corruption laws and with their obligations as stated in the underlying Partner Agreement between
NetApp and the partner. Therefore, nothing of value (including, but not limited to, gifts, entertainment,
or travel) should be offered or provided to third parties, such as actual or prospective customers or
others, that is related to any transaction involving NetApp and that is intended to encourage a person
to perform his or her functions improperly or to reward the person for having done so.

Requirements

To receive the benefits associated with your NetApp Keystone Services Certified (NKSC)
Specialization, you must continually meet the requirements for that Specialization. At the end of each
compliance period, your performance will be measured against the applicable criteria set forth in
Annex A: FY’22 Services Certified Specializations Compliance. If you do not fulfill the program terms
that are explained in Annex A: FY’22 Services Certified Specializations Compliance, your NKSC
status will be subject to deactivation.

Discount terms
If you purchase directly from NetApp, discounts are based on your NetApp Keystone Services
Certified capability and an active Keystone Flex Subscription addendum. NetApp bases all discount
criteria on NetApp records. Keystone Lifecycle Services Certified Groups have the same discount
applied across their Group.
Discounts apply to selected part numbers as indicated in the NetApp Quote Tool.
Discounts require deal registration on the opportunity.
Your NetApp Keystone Services Certified Partner capability may change based on your program

Rules of Engagement for NetApp Keystone Flex Subscription purchases

To be eligible for earned NetApp Keystone Flex Subscription benefits, you must register all potential
sales. NetApp reserves the right to approve or to reject any sales opportunities or registrations.
As a NetApp Keystone Services Certified Partner, you may also apply earned discounts to NetApp
Keystone purchases that cover subscriptions that you own and use internally. Approved deal
registration is required.
