Pursuant to the instructions from and on behalf of my client Nirbhay Shankar

Gupta, I do hereby serve you with the following Legal Notice: –

1- That my client is a proprietor under the name and style of M/s Prakash
Corporation

2- That my client is engaged in the business of trading business of the pulses,chana

etc.

3- That against your sample sent to my client, advance payment was made and the
invoice no. 4362000263 dated 26.07.2021 amounting Rs.972180 was raised by you
and delivered at the place of business 52 chaman singh Bag Road Ballia. After
inspection it was found that SNo1 and 3 of the invoice i.e. filter chana and tuvar
dal(arhar dal) was not as per the sample and also eaten by grain weevils. A mail
stating the same was sent to Deepak.srivastava.438@gmail.com dated
05.08.2021( copy attached).

4- That my client contacted the concerned sales officer over phone complaining
about the goods received and for the same officer asked to send the picture of the
grains; which was sent on 06.08.2021 via whatsapp to Mr. Deepak Srivastava Senior
Sales Officer Mobile no. 9919553369(copy attached), although you have
acknowledged the receipt of such complaint and pictures raised by my client, no
action was taken.

5- That aggrieved by the response again on dated 15.08.2021 picture of the grains
was sent via whatsapp to Mr. Devan Yadav and again a reminder message was sent
on dated 23.09.2021 (copy attached). Instead of continuous follow up to resolve the
problem my client is facing financially as well as mentally Mr. Devan Yadav
threatened to block my client ID and bar him from doing further business with
patanjali ayurved ltd.

6- That on dated 30.09.2021, 16.10.2021, 13.11.2021 various mail was forwarded

within the patanjali team ( copy attached) for the above mentioned issue but as a
matter of fact no appropriate action has been taken so far. Looking at the inactivity
of the patanjali team my client tried to sell the grains at the throwaway price and
because of which incurred loss of Rs. 35000 in chana and Rs.19200 in Tuvar Dal
total Rs.54200 apart from that 70 Bags of dal is still in my client stock which is
unsold which would cost Rs.190050. Thus, Rs.244250 is total loss as of today. Also
my client incurred reputation loss due to bad quality of your product which cannot
be measured in monetary terms.

7- That my client requested you several times through telephonic message and by
sending personal messenger to your office either to take back the goods refund the
paid amount, but you have always been dilly delaying the same on one pretext or
the other and so far have not paid even a single paisa.
I, therefore, through this Notice finally call upon you to pay to my client Rs.
244250/-. along with future interest @ 6 % p.a. from the date of notice till actual
realization of the said amount and Rs.50lac compensation for loss of reputation,
together with notice fee of Rs. 10000/- to my client either in cash or by demand
draft or Cheque whichever mode suits you better, within clear 15 days from the
date of receipt of this notice, failing which my client has given me clear instructions
to file civil as well as criminal lawsuit for recovery and other Miscellaneous
proceedings against you in the competent court of law and in that event you shall
be fully responsible for the same.

A copy of this Notice has been preserved in my office for record and future course
of action.
