Pursuant to the instructions from and on behalf of my client Raghvendra Srivastava,


I do hereby serve you with the following Legal Notice: –

1. That my client notice sender and opposite party Sweta Srivastava were
legally married and also lived as husband and wife but as there arose
differences between both of them and was not possible for them to continue
their relationship both of them decided to file divorce.
2. That my client and you had entered into an agreement to dissolve the
marriage by filing the divorce petition by mutual consent and thus in case
no.352/2012 Raghvendra vs Sweta In the court of Additional Principal Judge
Family Court Ballia the settlement and the statement was recorded. Also my
client paid you Rs.500000 Five Lakh DD in your favour as full and final
settlement which is duly enclosed and filed in the case of 352/2012.
3. That as per the process and procedure of law six month cooling period date
was fixed and you were expected to stand before the Hon’ble court. As the
case is still pending in the Family court Ballia and divorce decree is not yet
delivered by the court your marriage has yet not dissolved. As per law until
unless divorce decree is granted by the competent court you cannot remarry.
4. That despite so many reminder you have escaped to stand before the court
and as per information provided from my client you have remarried with
Praveen Kumar Srivastava with whom you are currently living as husband
and wife.
5. That you are advised to appear before the Family court Ballia and get the
decree of divorce failing which would bound me to file civil case for recovery
of money along with interest and criminal case under section 494,406 IPC
and other cases as per law.

I, therefore, through this Notice finally call upon you either to appear before the
family court Ballia and dissolve the marriage by decree of divorce or pay to my
client Rs. 500000/-. along with future interest @ 6 % p.a. from the date of notice
till actual realization of the said amount and Rs.20lac compensation for mental
harassment and breach of trust, together with notice fee of Rs. 10000/- to my
client either in cash or by demand draft or Cheque whichever mode suits you
better, within clear 60 days from the date of receipt of this notice, failing which
my client has given me clear instructions to file civil as well as criminal lawsuit
for recovery and other Miscellaneous proceedings against you in the competent
court of law and in that event you shall be fully responsible for the same.

A copy of this Notice has been preserved in my office for record and future
course of action.
