Sub: Notice of termination of contract and forfeiture of earnest


money/Advance amount

Sir,

Under instructions and authority from my client Shri Paramvir Singh Khanuja,
S/o Shri Haricharan Singh Khanuja, R/o Near Old Gurudwara, Manendragarh,
District Koria (C.G), I serve upon you the following legal Notice:-
 

1. That you the Noticee had executed an agreement to sale dated 6/10/202 with
my client to purchase his property bearing khasra number 351/4, admeasuring
0.202 hectare at village Bhatagaon, Patwari Halka no: 105/60, Tehsil and
District Raipur.

2. That, the agreement to sale dated 6/10/2020 of aforementioned property was


executed between you and my client through Power of Attorney holder of my
client (Shri Maninder Gandhi) acting on behalf of my client.

3. That, the fair market value of my client’s property was around 45 Lacs but due
to financial problems arising out of pandemic, he agreed to sell the property to
you for Rupees 34 Lacs 50,000, therein you were required to execute the sale
deed within four months from the date of execution of the agreement, that is on
or before 10/1/2021 but you deliberately and wilfully failed to execute the sale
deed with my client.

4. That, due to your intentional and deliberate act my client was compelled to
borrow the funds from private financers and ended up paying heavy intrest and
also my client required money for marriage ceremony in his family but due to
your tortuous act he had to borrow money from his friends and relatives, which
has thrown my client into debt trap.

5. You are further informed that my client entered into agreement to sale with you
based on your personal guarantee that you will execute the sale deed as soon as
possible due to which my client lost other offers for his Land.

6. That, you the Noticee is hereby notified that my client has forefeited the
amount of Rupees Seven lacs paid by you to him as advance amount in
accordance with the agreement and law of equity and you are further notified to
not enter in agreement or give power of attorney to any third party for the
aforementioned Land. You are notified that from this date onwards if you enter
into agreement to sale or power of attorney with any third then it would be an
offence U/s 420 of Indian Penal Code.

7. Under the circumstances, you are notified to not enter into agreement of
the aforementioned property with any third party or give PoA failing
which my client reserves right to file complaint against you before the
competent forum and authorities, for which you will be liable for all costs
and consequences. You are also liable to pay a sum of Rs. 15000/- as
necessary cost and expenses of sending the present legal notice to you.

Copy of this legal notice is also kept at our office for further ready
reference it required in future.
