AFFIDAVIT

I, ENGR. RAYFIELD ZIGGY F. AZURIN, of legal age, single, Filipino, and residing at
Brgy. Cabaroan Bantay, National Highway, Bantay, Ilocos Sur, after having been duly
sworn in accordance with law, hereby depose and state:

That I am the Chief Executive Officer and Subdivision Developer of AthAir

Residences located at Brgy. Rizal, Santa, Ilocos Sur;

That last October 14, 2021, I received a letter from the Department of Human
Settlements and Urban Development (DHSUD) dated August 14, 2021, signed
by Atty. Raymundo Foronda. Informing that our company has been offering
for sale the lots within the subject project without the required Certificate of
Registration, License to Sell and Advertisement Approval for the said project;

That because of the afore-mentioned violations, the DHSUD issued a Notice of

Violation and ordered the company to appear before the Adjudication and
Monitoring Division of the DHSUD to explain and submit a sworn statement
the reasons for failure to secure Certificate of Registration, License to Sell
and Advertisement Approval prior to conducting selling activities within the
said project and to submit a report of Sales Status;

That in compliance with the said ORDER, the undersigned affiant humbly offers
the following explanation:

1) AthAir Residences is still in the stage of feasibility study testing the market
if it is viable during this time of pandemic.  A tragic time when we need to
sort other means of economic recovery;

2) In a letter dated October 4, 2021, Atty. Raymundo Foronda has already

approved our advertisement materials, a copy of the letter is hereto
attached and marked as Annex “A” and made an integral part hereof; and

3) AthAir Residences does not have any sales to date and although there are
already inquiries, we have learned and considered that the permits and
license to sell are also our future clients’ utmost concern.

That I am executing this affidavit to declare the truth of the foregoing facts and
for whatever legal purpose it may serve.
