“A RESOLUTION ADOPTING THE ORDINANCE OF IMPOSING CURFEW HOURS
TO BARANGAY CAPILAN, LEBAK, SULTAN KUDARAT FROM 9:00 AM TO 4:00
AM”
WHEREAS, the august council deemed it necessary that individuals shall be regulated
to roam around frequent passing through of motorcycle vehicles in any public places of
Barangay Capilan, Lebak, Sultan Kudarat especially during night time and for the
reasons of recent killing were noy yet solved and incidents of Akyat-Bahay;
WHEREAS, in line with the council’s vision of maintaining peace and order likewise to
perverse the tranquility of the place, adoption of preventive measure is indeed
necessary;
WHEREAS, on motion of Hon. Vicente G. Cerbas, Committee on Environment, and
duly seconded by kagawad present;
NOW THEREFORE, Be it resolved as it is;
HERBY RESOLVED, to enact ordinance, to wit:
ORDINANCE 6
AN ORDINANCE IMPOSING CURFEWHOURS TO BARANGAY CAPILAN, LEBAK,
SULTAN KUDARAT FROM 9:00 AM TO 4:00 AM
Section I. Title- An Ordinance Imposing Curfew Hours to Barangay Capilan,
Lebak, Sultan Kudarat from 9:00 to 4:00 am.
Section II. Definition of terms
1. Curfew hours- a Barangay regulation that keeps of individuals and/or
minors in the street after a designated hour.
Section II. Curfew hour referred to a particular designated hour that is from
9:00 pm to 4:00 am.
Section IV. No individuals and/or strangers are allowed to remain around
during curfew hours in any public places such as disco houses, videoke
houses, beers houses, movie houses and/or any other public places.
Section V. Exception
All individuals are exempted from the provisions of this ordinance in cases
stipulated below to wit:
1. In case of emergency, it is advised to bring and use torches, clear and
flashlights emergency light (except lighter and cellphone pin light and
other less light devices0 for identification.
2. When there is an occurrence of calamity, either natural or manmade.
3. During scheduled schools and religious activities.
4. During fiesta and foundation anniversary celebrations of Barangay , in
which this concerned will secure a permits from Local Chief executive for
temporary suspension of the ordinance in the area of judications.
Section VI. Penalty Clause
1. Any person caught violating provisions of this ordinance shall be
apprehended foe custody of the Barangay authority either to forward at at
PNP station and/or cannot be released without justifiable reasons in the
circumstances.
2. Establishment accommodating individuals during curfew hours will be
penalties with the following to wit:
a. First offense-----100.00
b. Second offense—200.00
c. Third offense-------1, 000.00 or cancellation of business license.
Section VII. Effectively Clause
This ordinance shall take effect immediately upon the date of its approval.
