1 Objective

This SUPPLIER Manual Logistics is to improve the supply relationship between the respective
SUPPLIER and BÜHLER MOTOR and to minimize friction loss. The required material is
supposed to be conveyed in the right quantity and quality to the right destination at the right time
at optimum costs.
The determinations set forth herein form the general binding framework for all BÜHLER MOTOR
plants. If needed, they are complemented by site-specific regulations to fulfill the special supply
requirements of the individual plants.
The delivery of parts to BÜHLER MOTOR has to be organized in compliance with this SUPPLIER
Manual Logistics in its latest applicable version, the attendant individual agreements and
BÜHLER MOTOR’s general terms and conditions of purchasing (AGB). Furthermore, this
SUPPLIER Manual Logistics is to give our SUPPLIERS a better understanding of our
requirements and their responsibilities.

2 Order processing according to procurement concepts

The following procurement concepts are used for order processing:

 The classic call-off order process

 Consignment warehouse

 Individual order
Which concept is applied is determined by BÜHLER MOTOR for the respective article.

2.1 Order handling

The SUPPLIER gets annual call-off quantities as a non-binding preview (see 2.3, Production and
material release). Based on these figures the SUPPLIER ensures that its production capacity is
sufficient for that volume and that its sub-SUPPLIERS are able to deliver the primary material
accordingly.

2.1.1 Call-off

In procurement, the delivery call-off procedure is preferably used. Delivery schedules are
transmitted on a rolling basis. They are updated regularly and usually contain data with a horizon
of at least 12 months.
The call-off order is based on the cumulative quantity process. Cumulative quantities are the
cumulative supplied and received quantities as of a defined point in time. They are the
precondition for an immediate system-aided synchronization between the information systems of
BÜHLER MOTOR and the SUPPLIER. Based on cumulative quantities an exact delimitation can
be carried out between the last recorded goods receipt at BÜHLER MOTOR (at the time the call-
off was generated) and the shipping information kept on the SUPPLIER’s side. The cumulative
quantities include all deliveries positively or negatively recorded at BÜHLER MOTOR from the
defined point in time until the creation date of the current call-off.
The cumulative quantity is changed by the following events:

 The goods receipt effects an increase in the cumulative quantity; the underlying call-off
order is discharged at the same time

 Return deliveries at the SUPPLIER’s expense (for quality reasons, for example) effect a
reduction of the cumulative quantity; the next call-off will be increased to balance the
demand
When the cumulative quantities are synchronized, the difference between the cumulative quantity
on the SUPPLIER’s side and the cumulative quantity of goods receipt at BÜHLER MOTOR
indicates the quantity of the material in transit (MAT). For the delimitation, the call-off order shows
the last delivery note number BÜHLER MOTOR has recorded.
The following applies for the call-off:

 The call-off is automatically transmitted once a week (for all BÜHLER MOTOR plants the
call-off is issued at the same time on the night from Sunday to Monday)

 Transmittion is made by EDI, e-mail or fax

 The last delivery received is also visible

 The delivery dates communicated in the call-off are the arrival dates at BÜHLER MOTOR

 Inventory discrepancies, changes in quantities and dates made by our customers, quantities
based on BÜHLER MOTOR sales plan are taken into account

 The call-off reflects the current demand situation

 Every new call-off supplants all previous ones completely with immediate effect

 The SUPPLIER checks the received call-off for its completeness, correctness and
plausibility (e.g. name of the SUPPLIER, part number, quantity, date, in the event of
anomalies, the SUPPLIER contacts the responsible BÜHLER MO-TOR contact person
immediately

 Call-offs become binding if the SUPPLIER does not object within two working days after
receipt and informs BÜHLER MOTOR that he cannot fulfill the requirements or can only
fulfill them in a different way, an order confirmation is basically not necessary

 In case of problems with delivery quantities or dates, the responsible materials planner /
procurement agent at the BÜHLER MOTOR plant has to be notified in writing immediately

 Deviations without our prior consent will not be accepted. Any costs arising therefrom will be
charged to the SUPPLIER

 Changes (subsequent orders or initial orders of new parts as well as postponements or


cancellations) which the SUPPLIER is informed of by a change in the call-off and delivery
schedule must be entered in the current delivery call-off as long as a new call-off has not yet
been issued
Appendix 8.4 includes an exemplary call-off with comments about the respective fields.

2.1.2 Consignment warehouse

Using a consignment warehouse, SUPPLIER is obliged to maintain the stock in the consignment
warehouse at all times above the specified minimum, but must not exceed the maximum stock.
The SUPPLIER shall be informed of the current state of the consignment stock at regular intervals
(weekly consignment report is sent at night from Sunday to Monday).
The consignment report includes two parts. The first part contains a summary of all material on
consignment, the MIN/MAX volume, the current stock and a summary of all collections and
deliveries for the period under review. The second part contains detailed reports on individual
movements, separately for each material. Appendix 8.5 includes an exemplary consignment
report.

Along with the consignment report, the SUPPLIER receives a delivery plan, which is not binding
for the SUPPLIER, but serves as an indicator of future needs to ensure that the SUPPLIER's
consignment stock is continuously replenished. Only the consignment report is always decisive
for the SUPPLIER in determining specific deliveries.
If the SUPPLIER delivers a quantity greater than agreed in the consignment contract (stock in
excess of MAX), this delivery may be rejected by BÜHLER MOTOR and returned to the
SUPPLIER at the SUPPLIER's expense. BÜHLER MOTOR does not have to reimburse the
SUPPLIER for over-supplied material (e.g. if the maximum period for which the material can be
held in consignment warehouse expires).
Any deviations must be consulted and agreed in advance with the SCM department at BÜHLER
MOTOR.

2.1.3 Individual order

The supplier receives individual orders from Bühler Motor for both project business and series
production. These must be confirmed with the responsible contact person at Bühler Motor. The
communication takes place by e-mail or fax.

2.2 Order tracking

The SUPPLIER tracks the orders internally and continuously. He is always able to inform
BÜHLER MOTOR of the progress made in production. The SUPPLIER also guarantees that there
is a continuously transparent order tracking at its sub-SUPPLIERS.
For the case of deviations, the SUPPLIER has to possess a well-working escalation management
system. Established emergency plans and effective crisis management have to be shown upon
request. For more details see chapter 2.5.

2.3 Production and material release

The production and material release designates the period for which BÜHLER MOTOR
undertakes to buy the ordered part or material. This is specified in the purchase agreement. The
standard time for the production release is four weeks; the standard time for the material release
is further 4 weeks. Unless otherwise agreed, BÜHLER MOTOR shall have no further obligation
to accept delivery beyond these periods.
For call-offs the period of the production and material release starts with the call-off creation date
and applies in daily progression for the given period unless a new call-off comes in. The maximum
released quantity is calculated as the sum of the cumulative goods-receipt quantity by the time
the call-off is created and the required quantities of demand designated during the release period.
The additionally stated demand quantities are only target figures for information purposes. The
mentioned quantity in the production release is a fixed order, but the delivery has to be based
upon the latest call-off. The mentioned quantities in the material release entitle the SUPPLIER to

plan its material requirements, not to start production. If apart from the listed latest deliveries,
other shipments are also in transit to BÜHLER MOTOR, these quantities have to be set off against
the next due delivery installment.
In the case of consignment warehouses, the demands are the basis for the material and
production releases. The time periods agreed in the supply contract also apply here.

2.4 Phasing-in and phasing-out control

During the phasing-in and phasing-out period, BÜHLER MOTOR expects increased flexibility
from the SUPPLIER. This requires capacity planning in order to be able to deliver also small
numbers of units in the right quantity at the right time. This planning has to be coordinated
between BÜHLER MOTOR and the SUPPLIER at an early stage. Within the framework of
phasing-in management the SUPPLIER receives call offs or individual orders. Individual orders
have to be confirmed to the BÜHLER MOTOR contact person (project purchasing or materials
planner / procurement agent).

2.5 Emergency concepts to maintain the ability to supply

The SUPPLIER is responsible for guaranteeing his delivery volumes’ security of supply for the
respective BÜHLER MOTOR site at any time – also in emergencies. The SUPPLIER has to reveal
his entire process chain and to define and implement measures to guarantee the pertinent
processes.
The following regulations on the security of supply are to guarantee the flow of materials along
the process chain for the availability of o.k.-parts and are part of the SUPPLIER management
system.
The production capacity has to be capable to balance demand fluctuations agreed in the supply
contract.
The SUPPLIER has to follow a consistent strategy that, in case of emergencies, guarantees the
supply of BÜHLER MOTOR with o.k.-parts at any time.
Such emergencies can be:

 A delivered batch is not or only partially usable

 Disruptions at sub-suppliers

 A shortage of staff or means of transport

 Insufficient production capacities


Generally applicable to emergencies:

 The SUPPLIER has to make sure that there is a sufficient inventory of purchased goods
corresponding to the issued production and material releases which is available to BÜHLER
MOTOR as a reserve quantity for unexpected production shifts.

 The person causing the problem has to inform all parties involved immediately by phone and
in writing within one hour about the kind of the problem, its possible causes, its impact and
the required problem-solving steps. After being agreed by all parties the steps to solve the
problem have to be realized reliably. If no solution can be mutually agreed upon, the contact
person has to involve higher levels of the hierarchy, including the managing board of the
SUPPLIER.

 In particular in the event of disruptions affecting delivery date or quantity, the SUPPLIER
shall inform BÜHLER MOTOR upon request at least on the following points:
1. Cause of the supply problem
2. Plans to reduce the backlog (dates and quantities)
3. Production capacities for the parts in backlog, machine running times and working hours
(hrs per working day, working days per week)
4. Tested alternative production options (always in accordance with BÜHLER MOTOR
quality standards)
5. Available alternative parts (always in accordance with BÜHLER MOTOR quality
standards)
6. Checking of possible lot splitting or partial deliveries
7. Options to shorten the delivery time by using special transport modes
8. Information and escalation within the SUPPLIER’s organization

 The person causing the problem generally is responsible for solving the problem. All parties
involved undertake to support the problem solving. The costs incurred shall be borne by the
party causing the delay. The liability on the part of the SUPPLIER in case of delayed
delivery is regulated in the corresponding delivery contract.

 From 7:00 to 17:00 h (the receiving BÜHLER MOTOR plant’s local time), the SUPPLIER has
to be accessible throughout. A 24 h contact has to be accessible if there is an emergency.

 All the SUPPLIER’s plants have to be reachable from its reception desk.
The SUPPLIER needs a defined lead time to respond to disruptions in the supply chain. This is
the time span between the SUPPLIER’s notification of BÜHLER MOTOR and the delivery of o.k.-
parts at BÜHLER MOTOR. The SUPPLIER has to inform BÜHLER MOTOR of this lead time,
which has to be proven by the attendant processes and time periods (emergency organization)
and guaranteed by suitable measures.
In conjunction with the SUPPLIER, BÜHLER MOTOR will check if the security of supply requires
a security stock nearby. The parts stored in the security stock have to be accessible 24 hours.

3 Information logistics

A working relationship between the SUPPLIERS and BÜHLER MOTOR is predicated upon open
and swift communication and responses. This requires:

 A full observance and pursuit of all agreements

 A timely and unsolicited notification in the event of changes regarding all facts and
circumstances affecting the supply relationship (agreements, delivery dates, processes etc.)

3.1 Data exchange

3.1.1 Information transfer with EDI

To improve the flow of goods and information to and from its SUPPLIERS, for an electronic data
interchange BÜHLER MOTOR uses the globally common EDI process.
The process uses data telecommunications, namely, a direct data interchange via IP/OFTP2
(Odette File Transfer Protocol) and the VDA standards common in the automotive sector. These
standards are implemented without additional modifications. This concerns the following VDA
document standards for data transfer:

 VDA 4905  Send: Call-off orders

 VDA 4908  Send: Credit note data

 VDA 4913  Receive: Delivery notes

 VDA 4913  Send: Cosignation removal / withdrawal messages


The SUPPLIER should import the order and inventory information sent to the SUPPLIER via EDI
without any further manual registration and processing. The target is an automated import of the
information into the respective production planning system (PPS) of the SUPPLIER. This
includes, for example, the breakdown into bills of materials, the automated generation and
forwarding of orders to sub-SUPPLIERS and the input into the capacity planning and production
control. This system has to be consistent and continuous along the complete planning-,
production- and shipping processes. Media discontinuities have to be avoided; interfaces
between the systems have to be checked on a regular basis in order to ensure a correct and
complete data transfer.
For further questions regarding the set-up of the electronic data interchange procedures, the
SUPPLIER can request appropriate support from the central BÜHLER MOTOR EDI contact
person. If required, BÜHLER MOTOR will send the SUPPLIER a data sheet with the subscriber
codes.

3.1.2 Information transfer via SUPLLIER Plattform

For SUPPLIERS who are not able to realize a fully functional EDI solution (which is understood
as the receiving of delivery call-offs as well as sending of advanced shipping notes including
packaging instructions if it appears on several levels) BÜHLER MOTOR offers the usage of a
SUPPLIER platform as an alternative. SUPPLIER which are getting connected have to take part
at a training. After training supplier get a training documentation and access to the platform.

3.1.3 Information transfer via e-mail

If a connection via EDI as well as via the SUPPLIER platform is not possible, it is a requirement
to exchange information via e-mail.

3.2 Communication SUPPLIER – BÜHLER MOTOR

3.2.1 Contacts

The contact persons of the SUPPLIER, responsible for logistical support, have to be designated
clearly (name of the contact, deputy and superior, each with their e-mail address, phone number
and fax number).
The contacts must have the necessary professional expertise and, if need be, have to be able to
answer all questions. The languages of communication are:

 The language of the country of the BÜHLER MOTOR plant to which the goods are to be
delivered or

 English (as the standard language for international communication)


The respective contact persons of BÜHLER MOTOR are listed in Appendix 8.2

3.2.2 Accessibility

The designated contacts (or their deputies) of the SUPPLIER have to be available every working
day from at least 07:00 a.m. to 05:00 p.m. (supplier local time).
Outside the above time window (or if the plant is closed), there has to be an emergency hotline
operated by a qualified person.

4 Packaging logistics

4.1 Packaging requirements

BÜHLER MOTOR defines requirements for the packaging of the respective parts. Based on these
requirements the SUPPLIER proposes a packaging concept, agrees this with BÜHLER MOTOR
and documents the finalized packaging concept in the packaging data sheet. This has to take
place before the first delivery. Type, dimensions, content volume, costs, and guideline of the
packaging are part of the order or delivery contract, and are obligatory for all deliveries.
If the defined packaging is not used, BÜHLER MOTOR reserves the right to charge the
SUPPLIER for extra costs (e.g. additional handling or repacking costs). Furthermore, a non-
compliance with the agreed packaging may have a negative effect on the SUPPLIER rating.
In justified cases, deviations (e.g. alternative packaging for start of production, extraordinary pre-
production or an insufficient supply with empties by BÜHLER MOTOR) have to be coordinated
with the logistics department of the BÜHLER MOTOR plant (see Appendix 8.2). A corresponding
note (“Alternative packaging!“) must be entered in the delivery note.
When creating the packaging concept, the SUPPLIER must consider the following general
requirements for packaging:

 Predetermined standard dimension for disposable and returnable packaging (cf. chapter 4.2.1
and 4.3.1) has to be adhered

 Total weight limits of large load carriers (e.g. pallet): maximum 500 kg

 Total weight limits of small load carriers (e.g. cardboard box, bin,…): maximum 9 kg

 Undamaged delivery of parts must be ensured (no impairment of quality, attention should be
paid to ESD protection, corrosion protection, climatic conditions, etc.)

 Sufficient transport protection must be ensured, for disposable packaging by use of snap-on
lid and bottom, for returnable packing by use of pallet cover

 All parts must be delivered free of pollution, oils and greases, unless otherwise specified by
BÜHLER MOTOR

 Only undamaged packaging materials may be used

 Packaging has to be designed for an optimized utilization under considering of ergonomic


apsects

 Rational loading units have to be created (cf. chapter 5.1.3)

 In order to reduce transport costs, the shipping units should be stackable 2 high (1+1). The
carrying capacity and stackability of the loading unit must be guaranteed in order to avoid
damages during transport and storage.

 Smooth loading and unloading of the transport vehicles by industrial trucks and easy transport
by industrial trucks must be ensured

 Only pallets which are accessible from 4-sides are allowed to be used

 If returnable and disposable packaging are econocomcially and qualitatively rated equal,
returnable packaing is to be preferred

 Only recyclable materials are allowed (cf. chapter 4.4.1) and the packaging must be designed
resources-efficient
Deviations from the general requirements must be agreed between the SUPPLIER, the BÜHLER
MOTOR logistics planner and the respective BÜHLER MOTOR plant logistics and must be noted
in the packaging data sheet.

4.2 Returnable packaging

4.2.1 Standard load carriers

4.2.2 Procurement

BÜHLER MOTOR sites Europe and USMCA


BÜHLER MOTOR procures the rotating stocks of returnable packaging up to the transfer point as
agreed upon with the SUPPLIER. Further empties needed for the SUPPLIER’s internal production
processes, must be procured by the SUPPLIER. Special arrangements are the exception and
must be agreed in writing with BÜHLER MOTOR.
For its SUPPLIERS, BÜHLER MOTOR assumes an average requirement of empties for six
weeks. In case of any additional requirement the SUPPLIER must justfy (e.g. consignment stock,
process-related production of large lot sizes etc.). The additional requirement must be
coordinated with the respective BÜHLER MOTOR purchasing manager and with the logistics
manager / supply chain manager of the respective plant. The additional requirement must be
agreed in writing.
BÜHLER MOTOR sites Asia
Regularly, the SUPPLIER procures the returnable packaging. It is recommended to use an
average requirement of empties for six weeks. The actual needed quantity must be determined
by the SUPPLIER.

4.2.3 Provision

BÜHLER MOTOR sites Europe und USMCA


The SUPPLIER requests the needed empties in good time (taking into account the transport
times) and in writing from the BÜHLER MOTOR plant’s empties planner (cf. Appendix 8.2). The
call-off quantity is determined by BÜHLER MOTOR on the basis of the due delivery volume. The
maximum to be provided, in full packing units, will be the quantity of empties according to the
agreed bin quota. If the SUPPLIER requires more empties at short notice due to increased
demands, this must be coordinated with the respective BÜHLER MOTOR plant’s empties planner.
BÜHLER MOTOR may also automatically provide the empties to the SUPPLIER in accordance
with the defined quota.
The requested empties are provided by BÜHLER MOTOR at the defined delivery point (according
to the agreed delivery terms) with no costs involved for the SUPPLIER.
If the SUPPLIER fails to request or procure empties or packaging in good time, they have to bear
the resulting additional costs (e.g. cardboard box costs, freight costs, repacking costs).
For Euro-pallets, the local and industry-specific regulations apply. When in doubt, the European
Pallet Association’s regulations apply in Europe (for details see: http://www.epal-pallets.org).

BÜHLER MOTOR sites Asia


The SUPPLIER is responsible to have all needed empties available for the proper supply of
BÜHLER MOTOR. The SUPPLIER is responsible for collecting the empties from the respective
BÜHLER MOTOR plant on time. It is recommended to collect the empties on delivery of goods.
If the SUPPLIER fails to collect empties or packaging in time, they have to bear the resulting
additional costs (e.g. cardboard box costs, freight costs, repacking costs).
If the empties are not collected regularly by the SUPPLIER, BÜHLER MOTOR reserves the right
to return the empties at the expense of the SUPPLIER.

4.2.4 Administration

If returnable packaging (property of BÜHLER MOTOR) is used, an empties account is maintained


by both parties. The SUPPLIER matches the account balances with BÜHLER MOTOR or the
external service provider contracted by BÜHLER MOTOR periodically. BÜHLER MOTOR
determines the form of these reports.
At the request of BÜHLER MOTOR, an inventory of the empties must be done. The result of that
inventory is agreed and settled between the parties involved. A later modification of the agreed
result is not permitted.
Inventory discrepancies or lost empties have to be replaced immediately, following the costs-by-
cause principle.
The SUPPLIER must prepare a report immediately after detecting a defect in the delivered
empties (e.g. differences in quantity or damage) upon receipt of the goods. The complaint must
be forwarded immediately to the responsible empties planner at the respective BÜHLER MOTOR
plant and include the delivery note information and, if applicable, a photographic evidence, as
well as a short description.
If the defect is obvious when the empty is being delivered by the freight carrier, the freight carrier
must confirm the defect on the delivery documents. The unclean receipt must also be submitted
to the BÜHLER MOTOR empties planner, otherwise the defect cannot be acknowledged. Any
further procedure has to be coordinated with the responsible BÜHLER MOTOR empties planner
on a case-related basis.

4.2.5 Storage, repair, scrapping and replacement

After having received the empties from the freight carrier, the SUPPLIER is responsible for a
proper, weather- and environment-protected storage of the empties. They must be stored in such
a way that any damage or contamination before, during or after the production process is
excluded.
BÜHLER MOTOR either repairs damaged BÜHLER MOTOR empties or scraps them if
necessary.

Any scrapping of BÜHLER MOTOR-owned empties require prior agreement of the respective
empties planner in the BÜHLER MOTOR plant. Any breach of that clause means the SUPPLIER
will be charged with the ampunt of the replacement value.
When scrapping such items – especially if there are hazardous substances on the empties – the
local applicable waste disposal regulations must be observed. Recycling always takes
precedence over thermal recycling or waste dumping.
BÜHLER MOTOR adjusts the empties stock to the currently given call-offs at least once a year.

4.2.6 Cleaning

The design of returnable packaging has to ensure a complete emptying, easy cleaning and drying.
The responsibility for cleaning the returnable packaging is defined in the packaging data sheet.
The degree of cleanliness of the empties must take into account the required degree of
cleanliness of the product and comply with the specifications of BÜHLER MOTOR.
Invalid goods-IDs (e.g. stickers, tags) have to be removed from the empties by the SUPPLIER.

4.3 Disposable packaging

In addition to the requirements defined in chapter 4.1, following principles have to be fulfilled:

 Easy opening of the cardboard box without any aids or additional time requirements

 Ensure modular structure

 The costs of damages caused by the inadequate design of disposable packaging have to be
borne by the SUPPLIER

4.3.1 Standards

The standard dimensions for loading units mentioned in Chapter 4.2.1 apply also for disposable
packaging. The disposable small load carriers used (e.g. cardboard box) must be compatible with
these standard dimensions.
For the assembly-friendly design of the disposable packaging the standard VDA 4530
“Disposable Small Load Carrier” must be followed, especially for parts included in the “Ship-to-
Line” concept.

4.3.2 Procurement

In general, the supplier procures the disposable packaging. The costs of procurement of the
disposable packaging are generally borne by the SUPPLIER.

4.3.3 Disposal

BÜHLER MOTOR disposes of the disposable packaging and bears the disposal costs.

4.4 Further requirements and special cases

4.4.1 Material requirements for recycling

The packaging material used must always be recyclable. The materials used must be labeled in
accordance with DIN 6120-1 (icons with abbreviations). The packaging marks must not exclude
a material recycling.
Compound materials
Compound materials are generally to be avoided and require BÜHLER MOTOR’s special
approval.
Plastics for returnable packaging
For returnable packaging the following plastics specifications must be observed:
Approved: ABS, PE, PP (thermoplastics)
Only after release: PC
Not allowed: EPS, PUR, PVC and all thermoset materials
Plastics for disposable packaging
Only PE or PP should be used for plastics for disposable packaging. The variety of materials
should be reduced to allow a selective recycling of plastics.
Paper and cardboard
Paper and cardboard must be free of hazardous substances generated during paper production.
Coatings should be generally avoided (e.g. wax-, paraffin-, bitumen-, oil papers or impregnating
papers and cardboard). They can only be used in justified special cases and after consultation
with the respective plant’s logistics department. Plastic- and textile adhesive tapes, plastic
shipping bags and glass-fiber-reinforced paper adhesive tapes are also not permitted.
Wood
Pallets and boxes must be untreated (not impregnated, painted or coated). Disposable packaging
and packaging parts made of wood require a special release by BÜHLER MOTOR.
For wooden packaging for overseas shipment, the legal regulations applying in the receiving
country also have to be complied with. Compliance with the IPPC standard ISPM 15 for wooden
packaging materials is also mandatory. You can find and download information on IPPC rules

Bags and film tubes


Bags and film tubes must be made of PE only.
Styrofoam
The use of Styrofoam should generally be avoided. In exceptional cases, it may only be used for
shaped parts. In this case, pure white Styrofoam has to be used. Any use of Styrofoam chips is
not permitted. However, packing chips made of corn may be used as a filling material.
Shrink and stretch films
Especially for disposable packaging, shrink and stretch films should be used to secure the load.
Tightening straps
Only PET or PP tightening straps may be used.
Final regulations
Packaging materials which fail to comply with the above-mentioned standards must not be used
in future for the phasing-in of new products. Justified exceptions must be agreed with the
respective BÜHLER MOTOR plant.
In case of non-compliance with the above, BÜHLER MOTOR reserves the right to charge the
SUPPLIER the resulting costs.

4.4.2 Special load carriers (e.g. blister)

Any use of special load carriers must be coordinated with the responsible BÜHLER MOTOR
logistics planner (see Appendix 8.2). The special load carriers are planned and designed by either
the SUPPLIER or BÜHLER MOTOR, after consultation. They are inspected and approved by
BÜHLER MOTOR in coordination with the SUPPLIER.
Intermediate layers or shaped parts for parts protection, inserted in the bins and cardboard
packaging listed in Chapter 4.2.1 and 4.3.1 are also rearded as special load carriers and subject
to the regulations above.
For disposable special load carriers, the guidelines for procurement in chapter 4.3.2 apply, for
returnable packaging see chapter 4.2.2. If special load carriers are procured by SUPPLIER the
cost for the purchase, which are not included in the price for parts, must be agreed with BÜHLER
MOTOR. Furthermore, the eligibility of the special load carrier must be proven via transport test
by the SUPPLIER.
For returnable special load carriers, the guidelines for administration, storage, repair, scrapping,
replacement and cleaning, which are described in chapter 4.2.4, 4.2.5 and 4.2.6, are valid.

4.4.3 ESD packaging

All electronic-sensitive parts and assemblies must be properly packed in approved ESD protective
packaging for storage and transport outside of the ESD protected area.
The outer packaging must be electrically shielding or conductive in accordance with Norm IEC
61340-5-1. The inner packaging must be electrically dissipative or conductive.
Electronic-sensitive parts and assemblies must be marked on their ESD protective packaging
(outer packaging) with the ESD hazard symbol and the note "Handling only by ESD-trained
personnel in the electrostatically protected area".

The outside packaging has to be protected against any unintentional opening (e.g. through
sticker, cable tie, etc.) for the storage and logistics outside of the BÜHLER MOTOR company
buildings.

Packaging of non-electronic-sensitive parts and assemblies handled in ESD protected areas must
be dissipative or conductive in accordance with Norm IEC 61340-5-1.

The specification of the used BÜHLER MOTOR ESD standard bins is describe in appendix

4.4.4 Overseas packaging

Usually, for overseas shipments the SUPPLIER has to use disposable packaging. If returnable
packaging should be used, the SUPPLIER has to coordinate it with the logistics department of
the receiving BÜHLER MOTOR plant.
The shipper has to determine the inner packaging. It must ensure a high-quality delivery of the
parts, with sea transport (container on deck) and a pre-carriage and post-carriage of two weeks
each (outdoor storage and transport by truck) being taken into account. Please ask the receiving
BÜHLER MOTOR plant for details on transport times (sea transport).

The following rules apply for labeling:

 Every loading unit and every load carrier must be provided with a goods label at the front side
(cf. chapter 5.2)

 Particular care must be taken to ensure that the consignee, port of destination and final
destination, part and order number and gross weight are indicated

 The packaging units within one shipment must be numbered consecutively pursuant to the
“labeling for a shipment of packages” in accordance with DIN 55 402 (e.g. 1/3, 2/3, 3/3)

4.4.5 Alternative emergency packaging

The SUPPLIER defines an alternative emergency packaging in case the specified packaging is
not available. The substitute cartons have to fulfil the guidelines described in chapter 4.3.1.

4.4.6 Cleanliness requirements on packaging

Cleanliness requirements have to be considered if the part itself has a special requirements on
cleanliness or/and the part is handled in a cleanroom. Requirements on cleanliness of the part is
defined on the drawing. Special cleanliness requirements for the packaging are defined on the
packaging data sheet.
If these parts are deliverd in cardboard boxes, the inner packaging must be protected from direct
contact with the cardboard boxes (e.g. by using an additional PE-bag).
If parts are deliverd in returnable packaging which is handled in a cleanroom, the cleanliness of
the packaging must be ensured by the SUPPLIER (including visual control, regular cleaning of
the packaging, protection of parts and packaging against pollution during storage and transport).

5 Shipping logistics

Delivery to BÜHLER MOTOR is carried out after the order placement by BÜHLER MOTOR and
in consideration of the processes specified in the Packaging Data Sheet, the supply contract and
described in this SUPPLIER Manual Logistics.
In addition to the classic transport handling via a main service provider (freight forwarder), milk
run concepts can also be used. The following chapter provides details and particularities related
to these delivery modes.

5.1 Shipping processing

The top priority is the punctual, complete and safe supply of BÜHLER MOTOR.

5.1.1 General regulations

The sender has to pack the advised quantities properly for a safe transport (cf. Chapter 4.1), load
them onto/into suitable vehicles, stow them and fix them.
A later modification of the advised quantities requires a prior consultation of the respective
BÜHLER MOTOR plant logistics department.
The freight carrier acknowledges the receipt of the number and kind of the packages and shipping
units he receives, but not their contents, value or weight.
The delivery frequency specified by the respective BÜHLER MOTOR plant must be observed. In
case of non-compliance, the differential costs will be passed on to the SUPPLIER.
Collection times and defined time windows at the SUPPLIER and other individual specifications
are agreed between the SUPPLIER and the transport company or are defined in the framework
of milk run concepts.
All deliveries to BÜHLER MOTOR have to be made on the agreed shipping terms.
The SUPPLIER hands over all shipments to the transport company without any previous costs.
Insurance and packaging contributions, storage and receipt costs and any prior freight costs will
not be accepted. Prepaid services charged in the invoice of goods will be rejected and the cost
amount deducted.
A franked (pre-paid) hand-over of our shipments charged in the invoice of goods will also be
rejected and the given freight costs deducted.
BÜHLER MOTOR bears transport costs as agreed in the terms of delivery. If need be, the main
service provider used passes on the transport costs to the SUPPLIER at the agreed freight costs
rates.
Higher transport costs incurred through a change made to the instructed mode of shipping, e.g.
air freight, express shipping, courier services etc., will only be accepted if BÜHLER MOTOR

specified requested or permitted, and confirmed in writing such mode of shipping for each single
case.
The SUPPLIER may take out an insurance policy for the shipments at its own expense. We will
not accept any invoiced insurance costs.
Shipping processing only refers to the mutually agreed and defined shipping and collection points.
The SUPPLIER has to notify BÜHLER MOTOR of any other places of dispatch. These have to
be released by BÜHLER MOTOR. If other than the agreed places of dispatch are used and higher
transport cost incurred, BÜHLER MOTOR reserves the right to charge these to the SUPPLIER.
The SUPPLIER will exclusively use the transport companies and parcel services specified by
BÜHLER MOTOR. Special arrangements can be made in exceptional cases and require the
written consent of the responsible materials planner / procurement agent in the respective
BÜHLER MOTOR plant.
Any repacking expense caused by a wrong delivery state, insufficient transport securing devices
or unsuitable packaging material is charged to the SUPPLIER. The same applies to an improper
palletizing or if packages exceed the pallet’s basic size.

5.1.2 Special runs

Generally, the SUPPLIER will organize any special run. The SUPPLIER notifies the responsible
materials planner / procurement agent at the BÜHLER MOTOR plant (cf. Appendix 8.2) of the
necessary special / express transports in writing and coordinates the mode of transport / transport
company with him.
The causer bears the costs of such special runs. If BÜHLER MOTOR bears the costs, either it
will also organize the special runs itself or a previous written cost absorption declaration from the
responsible BÜHLER MOTOR materials planner / procurement agent is required.
Special runs are an indicator for process disturbances. According to ISO/TS 16949-ceritification
BÜHLER MOTOR and certified SUPPLIERS are obligated to evalutate these.
For this reason, BÜHLER MOTOR must require its SUPPLIERS to record all special trips (e.g.
under express fare, cab or courier trips) to BÜHLER MOTOR. Bühler Motor keeps open the option
to check the records during an audit.
This requirement is based on TS16949, so it is site-independent and applicable for all BÜHLER
MOTOR locations

5.1.3 Combining shipping units

The SUPPLIER hands over all shipping units to the freight carrier (transport company, parcel
service) in a logistically optimized form. As far as possible, two or more small units have to be
combined to one larger shipping unit in consideration of specified dimensional and weight limits.
When handling the bundling, the packaging, labeling and shipping regulations must be observed.

The combination of packages and the pallets’ make-up has to be order- and article-related. Orders
and articles must not be broken down in partial quantities mixed across more than one pallet or
package.Partial deliveries require BÜHLER MOTOR’s prior consent.
All shipments of one shipping day have to be combined into one shipment. BÜHLER MOTOR
reserves the right to charge the SUPPLIER for costs incurred due to multiple notifications on one
delivery day.
Generally, every shipping unit may only feature one ident number. If for small call-off quantities
no complete shipping units can be formed, load carriers with various ident numbers can be
combined into one combined shipping unit. These load carriers have to be packed in groups of
the same ident number or as single-variety pallets.
Each bin has to be labeled individually (see chapter 5.2). The delivery note has to carry the
comment “combined shipping unit” (Sammelversandeinheit). Only shipments destined for one
and the same delivery point may be combined. Every deviation from this regulation requires the
receiving plant’s written consent.
Individual parcels and shipments have clearly to show the recipient (BÜHLER MOTOR plant) and
sender (SUPPLIER) on the outside when they are delivered.

5.1.3.1 Shipping of pallets

The following shipments are ususually shipped by forwarder:

 Weight over 15 kg per single package

 Shipments in the general cargo range ≤ 2,500 kg, ≤ 2.5 loading meters (national) or ≤ 2,000
kg, ≤ 2.0 loading meters (international)

 Shipments in the partial load range > 2,500 kg, > 2.5 loading meters

 Shipments in the full load range ≥ 19,500 kg, ≥ 11.2 loading meters

5.1.3.2 Parcels

The following shipments can be shipped by parcel services:

 Weight of up to 15 kg per parcel

 Combined length and girth up to 3 m per parcel


(combined length and girth = double width + double height + single length)

 Length of up to 2 m per parcel


Packages of up to a maximum of 15 kg within the parcel services’ maximum combined length
and girth dimensions are generally shipped by using the specified parcel services. All packages
which exceed 15kg and a delivery quantity of minimum 5 packages have to be delivered on a
pallet in line with the Euro (half-)pallet standard’s dimensions.

5.1.4 Return of rejected goods

The SUPPLIER has to collect the rejected goods within two working days upon the notice of
complaint has been sent. Exceptions can be made by the respective BÜHLER MOTOR plants on
their own initiative. If within these two working days the rejected goods have not been collected,
BÜHLER MOTOR will arrange for the return shipment 'ex works' with its service providers.

5.1.5 Delivery regulations

The delivery regulations are agreed between the receiving BÜHLER MOTOR plant and the
respective SUPPLIER for the whole spectrum of parts.
This is done on the basis of the internationally recognized Incoterms in their actually applicable
version, which has to be given in the supply contract, including the place of delivery. At that place
– the transfer point – costs and risk are transferred to the buyer.

5.1.6 Goods-receiving hours

The goods-receiving hours at the BÜHLER MOTOR plants have been agreed with the service
providers as follows:

Fixed delivery days and frequencies are defined by the receiving plant for the individual
SUPPLIERS. Any delivery outside these defined days requires prior written consultation.
BÜHLER MOTOR reserves the right to charge the SUPPLIER the additional costs due to non-
compliance of specified delivery days and/or frequencies.
Particularities
Any delivery of goods to the company headquarters in Nuremberg has to be made by vehicles
and trucks of a permissible maximum weight of 12 t. A delivery by vehicles with trailers or swap
trailers is not possible.

5.2 Labeling of the shipping units

All shipping units have to be clearly labeled in accordance with the specifications given below.
The SUPPLIER labels all shipping units with one master transport label (Master Label pursuant
to VDA 4994).

For heterogeneous shipping units (combined shipping units) the SUPPLIER has to make sure
that for all the BÜHLER MOTOR part numbers included in the packaging unit their respective
total quantity is shown and that they are clearly labeled.
Different revision statuses and production batches have to be shipped in a physically separate
way.
The smallest packaging units always have to bear a barcode label (Single Label). If the supplier
wishes to label the goods with a self created label all contents and possibility of readiness must
be checked and released by BÜHLER MOTOR.
Single packaging units (e.g. single bins or packing units also have to bear a goods label (Single-
Label) pursuant to VDA Standard 4994.

Remaining quantities (if accepted by the plant beforehand) have to be clearly labeled as
remaining quantities.
All old fixing devices (e.g. clips, wires) and labels have to be removed from the load carriers, in
order to avoid a mix-up because of old delivery documents.
The supplier bears all the costs incurred by cleaning the re-usable packaging if the above
regulations have not been complied with.
The master transport labels and the sub-unit labels have to be affixed to the bins in such a way
that they are visible on the front side of the package (its short side), do not protrude from the
outside contours of the packaging and do not overlap one another. On small load carriers, the
goods label has to be inserted into the pertinent document bag.
Elements of the loading unit securing device (straps) must never obstruct the legibility of the
goods label. The goods labels have to be able to withstand environmental impact and damage in
transit so that they are readable both by machines and the human eye at the place of delivery.
Any additional label may only include information for the recipient and the freight carrier (e.g.
change note, dangerous goods mark, safety instructions). These have to be affixed in such a way
that they do not protrude from the outside contours of the packaging.
For bins in USMCA sizes, the label has to be affixed to the pertinent field (Kennedy-Label).

5.3 Transport notification

The SUPPLIER notifies the respective transport company and/or BÜHLER MOTOR of the
shipment in good time and makes sure that the goods arrive at the place of delivery defined by
BÜHLER MOTOR at the right time.
Prior to the transport, the SUPPLIER provides the transport company and/or BÜHLER MOTOR
with all the shipment-relevant data.
This includes the following data:

 Collection address

 The sender’s contact person including phone number

 Collection date and time

 Delivery address: address of the unloading point

 Date / time of arrival

 Number and type of shipping units, if need be loading meters (or package dimensions)

 Gross weight

 Customs status declaration (if applicable)

 Special Health and security requirements for driver (example mask, shoes, etc)

5.3.1 Delivery and transport data notification for use of EDI and SUPPLIER platform

As principle, BÜHLER MOTOR requires all SUPPLIERS to notify the delivery via EDI in
accordance with VDA 4913 in parallel with a delivery. The notification of the delivery via
SUPPLIER platform is carried out according to a specially defined form. These delivery
notifications must contain the following data: Delivery note number and delivery schedule number

 Order number

 BÜHLER MOTOR article number

 Filling- and delivery quantity

 Packaging information (according to Bühler packaging instruction; information is provided


via the supplier platform and does not have to be maintained in the SUPPLIER-system).
BÜHLER MOTOR expects the delivery note and transport data to be transmitted completely and
correctly and as early as possible, i.e. immediately after the goods have been shipped.
Upon receipt, the incoming delivery note and transport data are checked formally and – as far as
possible – in terms of their contents. Any mistakes in the EDI data will be reported to the
SUPPLIER immediately and are subject to a complaint.
The EDI delivery note and transport data aside, the delivery also has to include a VDA delivery
note in accordance with VDA 4912 or a compatible delivery note in accordance with DIN 4994.

This document is required if the goods receipt department does not have the EDI delivery note
and transport data available.

5.3.2 Shipping order registration and transport release

The transport order (forwarding notification) by the SUPPLIER to the transport company
determined by BÜHLER MOTOR is processed via EDI/WebEDI. Until EDI/WebEDI is used, the
advice forms or processes of the respective transport company are used.
A uniform registration procedure has been agreed with the main service providers, which is
binding for all SUPPLIERS to follow. The order registration provides for an electronic registration
via the WEB order system of the main service providers. All registrations are managed via the
WEB order systems.

5.3.3 Access authorization for shipping advice (log-in)

Access authorizations for shipment notification are assigned to the SUPPLIER by BÜHLER
MOTOR (BÜHLER MOTOR responsible for transport logistics see Appendix 8.2).
Every SUPPLIER gets a log-in code and a user password. Only in exceptional cases a
standardized notification form, to be faxed or e-mailed, may be used.

5.3.4 Times / Procedures

The freight carrier will collect the goods within a defined time window or at a time agreed between
the SUPPLIER and the freight carrier.
Shipments of dangerous goods will be separately notified by the SUPPLIER. In such cases, the
SUPPLIER is responsible to provide the freight carrier with all the complete and proper dangerous
goods documentation which is necessary.
The freight carrier has to be notified of components whose condition does not allow any packing
or which are extremely bulky before the transport.
The SUPPLIER informs the transport company in good time if because of a heat or frost sensitivity
a certain temperature control is required.
Any disruption like, for example, postponements of the loading window, have to be reported to
the central order acceptance office of the service provider without any delay and by giving reasons
and the type of disruption. The costs incurred by the disruption will be settled following the costs-
by-cause principle.

5.4 Transport documents

The transport company has to be given proper freight documents and accompanying documents.
These are the following:

 Consignment note

 Delivery note (on the packages)

 Packing list (if applicable)

 Customs documents (if applicable)

 Invoice (if applicable)

5.4.1 Consignment note

The consignment note, with the shipment number and all packaging data, if possible in
accordance with VDA standard 4922, has to be given to the freight carrier for each shipment. It
has to include all the necessary shipment details.
Necessary data are:

 The goods’ designation

 Gross weight

 The packages’ dimensions

 Postage

 The name and address of the SUPPLIER have to be given as the sender

 Loading point

 The name of the BÜHLER MOTOR plant or third party recipient and the address are to be
indicated as the recipient

 Packaging type

 Number of bins
The driver confirms the cargo’s proper condition and completeness by giving his signature.

5.4.2 Delivery note

A VDA delivery note pursuant to VDA standard 4912 or a compatible delivery note pursuant to
DIN 4991, ODETTE or AIAG has to be used. The following data are obligatory:

 Bins, packaging and loading units (except disposable packaging) always have to be listed
including the BÜHLER MOTOR part number and designation.
The delivery documents have to be prepared separately per plant and unloading point.
The goods-receipt department registers the bins by their quantity and bin code and the actual
delivery is compared with the documents. This facilitates the monitoring of the bin movements.
The SUPPLIER has to care for properly completed delivery documents. He bears the costs of
getting any information which is missing in the delivery documents.
The delivery note also serves bin control as the basis for a regular balancing of accounts and as
a control tool for the quantitative and qualitative bin inspection at the goods-receipt department.
Every shipment has to include an original delivery note. The delivery note has to be affixed clearly
visible to the front of the package by means of a delivery note bag.
If a shipment consists of more than one package, every package has to bear a number (e.g. 1/3,
2/3, 3/3). The delivery note always has to be affixed to the first package (e.g. 1/3).

5.4.3 Packing list (outside the EU)

If a delivery consists of more than one package unit or pallet, a packing list with the following
information has to be appended to the delivery note for every transport unit.

5.4.4 Customs documents

General
The SUPPLIER is obliged to provide a written declaration about the origin of the delivered goods.
This includes both the commercial (non-preferential) and preferential origin of the goods to be
delivered to BÜHLER MOTOR. BÜHLER MOTOR must be notified immediately in written form of
any changes in the respective origin. If necessary, the SUPPLIER must prove his information on
the origin of the goods by means of an information sheet confirmed by the customs office.
Cross-border - SUPPLIERS
For cross-border sales of dutiable goods, the SUPPLIER is responsible for the proper preparation
of customs documents according to the current legal situation. The invoice must include all
customs related information and payments according to the applicable Incoterms (e.g. place of
delivery, freight and insurance costs). Costs not included in the price of the goods must be stated
separately on the invoice (e.g. costs for assembly, packaging costs, provision of materials,
commission, license costs).
In case of deliveries which are not based on a purchase transaction (e.g. free deliveries, leasing,
rent, etc.), a proforma invoice / customs invoice accompanying the goods shall be issued,
indicating the customs value of the goods. In the case of free deliveries, the proforma
invoice/customs invoice accompanying the goods should state the reason for this (e.g. sample
shipment).
In case of return delivery after repair, the value of the original goods as well as the invoiced repair
services after material and labor costs shall be indicated.
The SUPPLIER is obliged to enclose all papers, documents or certificates (e.g. proofs of
preference / certificates of origin, declarations of conformity etc.) required for cross-border traffic
with the goods at his own expense or to make them available at the request of BÜHLER MOTOR,
which are necessary for the import of the goods. These documents must be available at the time
of arrival of the goods (partly in the original).
If the goods are delivered from a country with which the country of destination of the goods has
concluded a free trade agreement / preferential trade agreement (FTA), the SUPPLIER shall issue
the proofs of origin / preferential declarations required by the respective FTA for each delivery of
these goods, provided that these goods meet the corresponding value-added criteria (local
content).
Unless otherwise agreed, the SUPPLIER is responsible for the proper export of the goods from
its customs territory including the fulfillment of all legal obligations incumbent upon it as exporter
(Exporter / Exporter of Record).

Unless otherwise agreed, BÜHLER MOTOR shall be responsible for the proper import of the
goods in the country of destination, including the fulfillment of all legal obligations incumbent upon
it as importer (importer of record).
If the SUPPLIER enters into customs obligations in connection with the import of goods in the
country of destination without having been authorized to do so in advance in writing by BÜHLER
MOTOR, the SUPPLIER shall bear all duties and costs associated with the import which BÜHLER
MOTOR incurs as a result of any loss of customs procedures (e.g. customs procedures with
economic significance, customs warehouses, Customs Free Zones, etc.).
BÜHLER MOTOR reserves the right to charge the SUPPLIER for all consequential costs arising
from improperly prepared paperwork for customs clearance.
Deliveries within the EU
Long Term Supplier Declaration
All SUPPLIERS undertake to submit a long-term supplier's declaration on preferential origin in
accordance with the Implementing Regulation (EU) 2015/2447.
In principle, the SUPPLIER receives an annual request from BÜHLER MOTOR to submit the
long-term supplier's declaration for an ongoing business relationship. The SUPPLIER shall
provide the long-term supplier's declaration to BÜHLER MOTOR within 4 weeks after receipt of
the request, at the latest, however, upon the first delivery.
If the delivered goods do not have preferential EU origin within the meaning of the respective
agreements, the SUPPLIER shall certify the trade (non-preferential) origin.
Intra-trade statistics
Unless otherwise agreed, SUPPLIER is responsible for the proper submission of the Intrastat
declaration and related legal obligations.
Unless otherwise agreed, BÜHLER MOTOR is responsible for the proper submission of the
Intrastat declaration and related legal obligations.
The data required to be reported for intra-trade statistics must be indicated by the SUPPLIER on
the delivery documents.
We expect the delivery of preferential goods if the SUPPLIER is domiciled in a country or makes
the delivery of goods from a country that has concluded a corresponding preferential agreement
with the EU.
The SUPPLIER shall be liable for all disadvantages incurred to BÜHLER MOTOR due to improper
or delayed submission of the long-term supplier's declaration or the corresponding proof of
preference.
Goods subject to export control
The export control regulations must be observed for goods that can be used for both civilian and
military purposes (dual-use goods). It is irrelevant whether the supplying and/or receiving
company manufactures products exclusively for civilian purposes.

The SUPPLIER is obliged to inform BÜHLER MOTOR if the supplied goods (including software
and technology) are covered by export control goods lists (e.g. Common Military List, Annex I of
the EC Dual-Use Regulation 428/2009, US Commerce Control List) according to German, EU or
US (re)export control law as well as the national export control law of the country of origin of said
goods. If the goods provided are "US goods"(*) in the sense of the US (re-)export control law (=
items subject to the EAR or subject to the ITAR), the SUPPLIER shall inform BÜHLER MOTOR
about this fact. If the delivered goods contain US parts, the SUPPLIER is also obliged to inform
BÜHLER MOTOR of the value (usual purchase price or current market price) of the US part in
total as well as the applicable export control classification (ECCN XXXXX or EAR99), provided
that this information is available to the SUPPLIER. In order to fulfill the mentioned notification
obligations, the SUPPLIER has to notify BÜHLER MOTOR of the relevant export list numbers
(e.g. position of the German AL or Annex I of the EC Dual-Use Regulation 428/2009, the ECCN
number,...) and, if applicable, the value of corresponding U.S. content in the goods of the relevant
goods positions, indicating the BÜHLER material no. (if available). Various US goods may not be
exported to certain countries without prior approval from the US authorities. When purchasing
goods from the USA, a corresponding reference to the US re-export regulations must be noted in
the delivery documents. This is necessary so that BÜHLER MOTOR can comply with the relevant
US regulations in the event of an export.
The SUPPLIER is obliged to inform BÜHLER MOTOR immediately about all changes in
connection with export control relevant data of delivered goods.

 all goods produced on the basis of US technology

 all goods produced with machinery or equipment imported from the U.S. and requiring a

Compliance - Anti-Terror-Screening
The SUPPLIER is obliged to check its business partners and employees against common anti-
terror lists.
Among others, the C-TPAT regulations have to be observed (for details see internet:
http://www.cbp.gov).
Proof of Preference USMCA Union
All SUPPLIERS from USMCA countries who ship to BÜHLER MOTOR in the USA and Mexico
must provide BÜHLER MOTOR with proof of their USMCA status every 12 months in a USMCA
Certificate of Origin that meets the requirements of US Customs and Boarder Protection (CBP
form) so that BÜHLER MOTOR does not suffer any customs disadvantages. USMCA preferential

status is granted to goods based on rules of origin. All documentation supporting this status must
be kept in accordance with current regulations.
All North American SUPPLIERS delivering to USMCA countries must make the USMCA
certificates available to the respective customs agent or third parties working on behalf of
BÜHLER MOTOR.

5.4.5 Invoicing

The purchaser must be notified immediately of any addresses of the place of dispatch, the
recipient of payment or the invoicing party that differ from the address of the recipient of the order.
Free deliveries shall also be notified by (pro forma) invoice.
Invoices must contain the following information for the purpose of customs clearance:

 VAT ID number BÜHLER MOTOR as well as VAT ID number of SUPPLIER

 BÜHLER MOTOR purchase order number

Special requirements for deliveries to North America
Shipments to the USA must comply with the security requirements of U.S. Customs and Border
Protection, Federal Register 73FR71730. This also applies to deliveries to BÜHLER MOTOR in

Mexico, as the delivery is made via the CEVA LOGISTIC Warehouse in El Paso, TX (see
Appendix 8.1.2).
Analogous to the security requirements of U.S. Customs and Border Protection (Federal Register
73FR71730), the U.S. HTS number (U.S. tariff number) must be printed on the pro forma invoice
or commercial invoice for shipments to the U.S. or for shipments to Mexico that pass through U.S.
seaports or U.S. airports. The SUPPLIER will be provided with the valid US-HTS number with the
master agreement as well as the delivery schedule. The SUPPLIER is responsible for ensuring
that the US-HTS number is correctly included on the commercial invoice or pro forma invoice for
each material number.
All SUPPLIERS shipping goods to the US and or Mexico should be certified by C-TPAT, BASC,
or any other Mutual Recognition Agreements. This certification should be validated annually.
BÜHLER MOTOR in Mexico requires an IRS registration of its SUPPLIERS (this document
verifies the address and legal representative), as well as the submission of a customer list of the
BÜHLER MOTOR business partner.

5.5 Security in the movement of goods – dangerous goods

All regulations pertaining to the transportation of dangerous goods have to be complied with in
full. The SUPPLIER is liable for all damages arising from any non-compliance with pertinent legal
regulations. A different processing or the use of other service providers or modes of dispatch
requires the written confirmation of the ordering party.
The consignor, as the loader or sender, has to comply with all the regulations of the latest
applicable dangerous goods regulation. It has to be ensured that the packaging is marked in
accordance with the applicable regulations.
Data sheets, approval documents etc. have to be made available to BÜHLER MOTOR before the
first shipping. All deliveries of dangerous goods are subject to the following requirements:

 For packaging of limited quantities (LQ), pursuant to ADR (dangerous goods regulation for
road and rail traffic) the preconditions concerning combined packagings and their marking
have to be met.

 For packaging dangerous goods, only a type-approved packaging (e.g. cardboard packaging,
canisters) in accordance with the class-breakdown in the ADR and, for sea cargo, in
accordance with the IMDG (sea cargo dangerous goods regulation) may be used.

 The consignment note or delivery note has to include the relevant data on the dangerous
goods (identification number, dangerous goods class, packaging group etc.) in accordance
with ADR.

 All packages containing dangerous goods have to be visibly marked with the prescribed
dangerous good sheets according to ADR.

 Data on the risk posed to water are obligatory.

 For articles with a limited shelf-life, the delivery note has to include the date of production or
expiry.

 The SUPPLIER is responsible for controlling the transport of dangerous goods.

If need be, the loader in terms of the GGVSE (Dangerous goods regulation rail and road)
has to care that the driver has available all the applicable and valid written instructions (accident
procedures sheets) before starting the transport.
The dispatch of and thus the terms of transport for certain goods are regulated or excluded. If
based upon a BÜHLER MOTOR order a dispatch of such goods should become necessary, a
separate service provider, and thus mode of dispatch, agreed with BÜHLER MOTOR has to be
chosen.

6 Quality standards of logistics

In order to continuously meet our customers’ requirements and our own company’s goals,
BUEHLER MOTOR requires all its SUPPLIERS worldwide to show a very high level of quality
and performance.
To ensure this high quality level, BÜHLER MOTOR rates its SUPPLIERS on the basis of defined
performance criteria. If the defined targets are not attained, measures are initiated as part of the
BUEHLER MOTOR escalation procedure. A detailed description of the evaluation and key figures
used can be found in the BÜHLER MOTOR Manual SUPPLIER Rating.

6.1 Logistics Rating

SUPPLIERS are periodically rated. This rating is based on the performance shown during the
evaluation period.
The evaluation of BÜHLER MOTOR's logistics rating is built on the following criteria:

 Delivery performance (quantity and punctuality)

 Compliance with the specified min. / max. limits for consignment stock

 Number of logistics complaints


Logistcs complaints regarding the following topics are recorded as logistics deviations:

 EDI processing (cf. chapter 3.1.1)

 Packaging (damages or deviations from packaging data sheet (cf. chapter 4)

 Labeling according to VDA guideline 4994 (cf. chapter 5.2)

 Complete delivery documentation (cf. chapter 5.4)


The responsible BÜHLER MOTOR contact person can provide information on details of the plant-
specific logistics result (cf. Appendix 8.2).

Delivery performance

The target specification for delivery fulfillment consists of the exact fulfillment of the delivery call-
offs and individual orders and/or compliance with the specified minimum/maximum limits for
consignment stock.
In case of overdeliveries contrary to the delivery call-off, BÜHLER MOTOR reserves the right to
refuse acceptance of the over-delivered material or to return it to the SUPPLIER freight forward
by general cargo.
In case of underdeliveries contrary to the call-off, BÜHLER MOTOR reserves the right to demand
special trips at the SUPPLIER’s expense (cf. Chapter 5.1.2) and to charge the resulting downtime
costs incurred at BÜHLER MOTOR or at its customers to the SUPPLIER.

6.2 Logistics complaints

A logistics complaint is triggered by a disruption of the processes at BÜHLER MOTOR caused by


the SUPPLIER.
Logistics complaints are recorded and evaluated with regard to the type of the failure and the
resulting costs and will be included in the logistics rating (cf. Chapter Fehler! Verweisquelle
konnte nicht gefunden werden.). In case of non-compliance with a regulation listed in the
logistics manual or a site-specific agreement, BÜHLER MOTOR reserves the right to refuse
acceptance of the shipment. Any resulting additional costs (e.g. storage, repacking, transport,
disposal, return of packaging material, additional handling effort, downtime costs etc.) are
charged to the SUPPLIER.
In case of a logistics complaint, the SUPPLIER is informed promptly and requested to analyze
the error pattern and to initiate measures. The SUPPLIER has to process and document a
BÜHLER MOTOR logistics complaint in compliance with the 8D method. The documentation can
be requested from BÜHLER MOTOR.

6.3 Escalation process

In case of repeated failures, escalated product issues or escalated SUPPLIER development


issues, BÜHLER MOTOR reserves the right to demand urgent measures to improve the logistics
performance.
