machines and are pleased to enclose our order No.PO/35 for 100 automatic washing
machines, code AWM/075 / as per the attached list/ as per catalogue and price list
enclosed with your offer. / as per catalogue No.32/XH, at the price of USD610.00 per
unit, CIF Haiphong port including export customary packing. In addition/ As this is
our first order, we would like to draw your attention to the following points:

Please be noted that if the AWM/075 automatic washing machines are not available in
stock for immediate shipment, you can send us the substitutes, code AWM/356 which

If any of the ordered goods are not available in stock for delivery at the time
stated/specified in the order, please cancel the shipment and do not send substitutes for

Delivery is to be made in one lot by the end of January in time for Lunar New Year

We would like to inform you that we are temporarily satisfied with a 15% trade
discount and a 10% quantity discount you offered for this order. However, we hope
that this term will be reviewed for the next orders./ to get a 20% trade discount in the

For this order, we have decided to accept a 10% trade discount you offered and agreed
to pay by letter of credit at sight, documents against payment. However, we would be
grateful if you could review these two terms /we hope that this term will be reviewed
for the next orders. However, for further orders, we would be grateful if you could
offer a 15% trade discount and accept payment by letter of credit at 60 days’ sight,

We would appreciate it if you could give us a 5% discount on the purchases of such a

The prices should be understood CIF Haiphong port. Payment is to be made by letter
of credit at 30-day sights, ducuments against acceptance. It is essential that the
consignment be insured under All risks term by a first-class insurance company. /We
would like to confirm that Payment is to be made in US dollars, by irrevocable letter
of credit at sight, to be opened through Vietcombank, 15 days before the shipment,
valid for 45 days, to the account of NatWest Bank, London, in favor of the seller for

The specifications are as per catalogue No.MN289. Delivery is to be made in the
middle of February, and we reserve the right to refuse the goods after that time. (quy

A firm condition of this order is that delivery is to be made before 22 December/by the

Re: Consignment of refrigerators and televisons under Order No. 3648

Dear Mr. John,

We are writing with reference to the consignment of 5000 tons of white sugar, packed
in 1000 bags,/ the electronic goods appliances(điện tử)/ electric appliances(điện)
containing 200 M2 fridges, 100 big-size washing machine, model 4488 and 500 color
19 inches televisions, code 5033, under the order/sales contract No…/ signed on 30
December 20..., shipped on board the SS/MV Red Lotus, Germany, which arrived at
Hai Phong port on 20 March 2011.

Upon unloading the goods at Haiphong port, it was found that the consignmen was in
a missing…/
On examination, the consignment was found in a missing and damaged condition. We
asked representatives from Vinacontrol in Haiphong to make a survey report which
indicates:/ Upon unloading the goods with the presence of representatives from
International Inspection Company SOS, we discovered that:
+ The actual consignment contains 190 fridges, 440 color televisions, 60 black and
white televisions and 100 washing machines. (tổng)
+ Against a total of 250 fridges stated in the order and the packing list, only 235 were
delivered, 15 were missing. (giao thiếu)
+ 60 black and white televisions were not ordered (giao thừa)
 Out of 200 delivered laptops, 50 were made in China, not in Japan as specified
in our contract, 2 had broken cases and 5 were seriously damaged beyond repair

 15 other bookcases were not as per the required specifications. (sai quy cách)
 20 bookcases were in light yellow, against the brown colour as stated in our

+ 20 out of 150 cases containing air-conditioners were broken and the air-conditioners
were damaged beyond repair. (vỡ) It appears that this problem arose in transit and
resulted from negligence during packaging./It appears that the packaging was not up to
the quality stated in our contract.

+ 200 colour TV branded Sony which had been ordered weren’t dispatched (thiếu)
We enclose herewith the Survey report (issued by Vinacontrol) and other relevant
documents (our illustrated photos) to support our complaint and must ask you to send
promptly by air the replacements for the broken/damaged air-conditioners/goods and
the missing fridges with all the expenses to your account. It is essential that these items
arrive at Noi Bai airport not later than 15 May as we urgently need them to complete

solutions:

As we urgently need these units for distribution to our local customers. They must be
delivered before 15 June with all the expenses to your account., after that time we will
reserve the right to refuse to take delivery of them and you will have to pay a penalty

Regarding the missing fridges, we will buy them from Thailand with all the expenses
to your account as we urgently need them at the moment. (hàng thiếu mua chỗ khác)
Regarding the televisions, please send us the remaining 60 color televisions as soon as
possible. We also suggest that you reduce the prices by 30% for 60 black and white
televisions, otherwise we can sell them at the highest obtainable prices or have them

We would like to make a claim for USD3,500, in which damages and repackaging
charges make up USD3,200 and inspection fee makes up USD235. (bồi thường)

Viettinbank, on the account number NHCT45289-Hanoi as a compensation at your

Regarding the 200 colour TV branded Sony which we ordered in time for 1 June sales
period, we regret to inform you that we are forced to cancel the contract for this
portion of consignment as today is 29 May and they have not been delivered. We
would like to make a claim for the liquidated damages equivalent to 10% of the

As this incident has delayed the lauch of our representative office in Hanoi which due
to open on 29 April, we would like to make a claim for the liquidated damages which
are 0.5% of the consignment value.

Regarding the wrong-colored bookcases, we can still accept them if you agree to give
us a discount of 15%./ if you agree to reduce the price by 50%, otherwise we will
return them with all the expenses to your account.(vẫn chấp nhận hàng giao sai)

Regarding the 50 flour bags, we will hold them / We will hold this roll of tube steel at
your disposal, or you can send someone to pick it up. Please send someone to pick up
the wrongly-designed bookcases and pay for the storage fees. / Please let us know
what you would like us to deal with the wrongly-delivered components. (xử lý hàng

We enclose herewith the Survey report and other relevant documents to support our
complaint and hope that this sort of problem will not arise again./do hope that this
