Terms of reference

1. INTRODUCTION

The company Portos e Caminhos de Ferro EP, intends to carry out Heavy Maintenance of the
Machipanda Railway, which is in a state of degradation in order to return to acceptable levels
of safety for circulations, reduce transit time and still respond to the demand that has been to
be observed in that market segment. This large infrastructure, part of the Beira corridor, will
be a promoter for growth not only for Mozambique but also for the southern region.

The undertaking that will be financed by the African Development Bank will enable CFM, as
the main user of the corridor, to access a safe and sustainable logistics system, allowing it to
transport minerals, containers, cereals and others at a competitive price.

The Project will consist of the requalification of the entire railway section of about 289 km
from Dondo to Machipanda, since the Dondo section to the Port of Beira benefited from the
rehabilitation during the Sena Line Project, to have a capacity of 20.5 ton / axle.

The purpose of these TOR's is to guide the Consulting Company to be hired through the
Restricted Tender for the preparation of the Environmental and Social Impact Study, with a
view to obtaining of the Environmental License for the implementation of Heavy
Maintenance.

2. OBJECTIVES OF CONSULTING SERVICES

The purpose of consultancy services is to conduct a study of the environmental and social
impact that:
 Allows to identify the positive and negative effects on the environment and

populations

 Propose mitigation measures in order to prevent, minimize or otherwise compensate

for the negative effects on the environment and populations.

 Elaborate an Environmental and Social Management Plan

3. CONTEXT AND DESCRIPTION OF THE PROJECT


The consultant should:
 Describe the local context where the project will be implemented (institutional

regulation.)

 Describe the project including the main components of the project and its progress

(where applicable) with, in particular, the use of maps. The following should be

indicated:

 Location, general map, size, capacity;


 Technical description of the project: industrial process, type of material, etc;
 Pre-construction and construction activities;
 Schedule;
 Allocation of labor and management personnel;
 Equipment and services; operation and maintenance activities; necessary external
investments and life span;
 Methods of removal and resettlement (compulsory lifting and resettlement) of
populations and / or activities,

The project description can be completed by a detailed description and illustrated in the
appendix.

4. DEFINITION OF THE AREA OF INFLUENCE OF THE PROJECT

The Consultant must clearly define the assessment area and illustrate it on a map that must be
attached. To define the evaluation area, all the components of the project necessary for its
implementation, such as roads, water pipes, electrical connections, etc., as well as areas that
may be impacted by the project, must be included.

5. CONTENT OF THE EVALUATION

Based on existing documentation, field visits and meetings with key project stakeholders, the
impact assessment should allow:

 Identify the main impacts of the project on its environment and populations, both
during the implementation and operation phases of the project;

 Present measures to mitigate the negative effects and conditions of its implementation
and monitoring;

When analyzing the environmental and social impacts of the project, the consultant should
consult the documents provided by CFM and the field studies and, consequently, conduct the
following investigations:

 Description of the legislative and institutional context: that applies to the project in
terms of environmental and social aspects.

 Analysis of project alternatives: Describe the options explored during the


implementation of the proposed project and indicate, in particular, the environmental
and social reasons that determined the choice of location (urban, social and technical
design of the project). Compare these options in terms of their impact on the
environment, their investments and operating costs, compatibility with local
conditions and in terms of institutional, training and monitoring needs.

 Description of the baseline data: Collect, evaluate and present reference data on the
relevant components that characterize the environment and the social characteristics
of the assessment area, in order to:

 Understand the sensitivities and potentialities of the relevant territories,


environments and populations,

 Determine natural risks or risks resulting from human activities

 Analyze the situation in terms of standards and conventions or quality objectives.

The Consultant should describe the environmental and social characteristics considering the
factors below. This list is indicative and can be adapted to the environmental and social
context of the project.

a) Physical environment: Topography, geology, pedology, climate, meteorology,


natural hazards, surface and groundwater (hydrology, water quality), marine and
coastal waters, air quality, noise, climate change;

b) Biological environment: (terrestrial, aquatic, marine): ecological analysis of the


entire site (fauna, flora, rare or threatened species, habitats, ecological performance of
the site), landscape analysis, culturally, socially and economically important natural
resources;

c) Human environment:

 Socio-economic activities: urban planning, land use (activities and


population), land tenure, agriculture / livestock, current or planned
development activities
 Population, structure and description of the community (s) present in the place,
gender employment, income distribution, goods and services;
 Working conditions;
 Hygiene and safety, health, public health;
 Access of populations to basic services
 Historical and cultural heritage;
 Transport and travel (accessibility of the area);

 State of pollution and disturbance at the site (waste, noise, air) and, when
applicable, public services for wastewater and rainwater management;
 State of raw materials used, energy consumption, GHG emissions;
 Industrial risks and restrictions
 Climate change.

Determination and description of potential project impacts and mitigation measures for
negative impacts

a) The Consultant must indicate the positive or negative impacts of the project for each of the
main environmental and social areas mentioned above, their importance, direct or indirect,
temporary or permanent.

 Identify inevitable and irreversible effects

 Identify the cumulative impacts of the project, that is, analyze the specific impacts
of the project add to (i) active impacts of the project in the same area and (ii)
short-term impacts of the project expected in the same area.

 Distinguish also between the effects related to the works phase and the phase in
which the facilities are used and, possibly, the phase in which the activity is
interrupted.

 Whenever possible, provide a quantitative description of the impacts in terms of


costs and advantages they represent for the environment and the relevant
populations. As much as possible, give them an economic value.

 Determine which populations are affected by the project using a quantitative


(number of people and communities affected) and qualitative (indicate various
possible impacts by / communities / populations / gender) approach. If the project
affects disadvantaged minorities, identify the project's specific impacts and risks
for these populations.

b) Suggest and describe mitigation measures (elimination, reduction or other compensation)
for the negative impacts of the project. Recommend technically feasible and socially
acceptable measures to prevent or reduce negative effects to acceptable levels. Ensure that the
measures are compatible with each other and do not cause new negative impacts. Identify and
assess residual impacts.

Consultation and participation of interested parties. The Consultant should describe the
methods used to obtain opinions from groups interested in the issue (in terms of regulation or
voluntary) and record, when applicable, information regarding meetings, statements,
observations and how the project owner integrated them.

6. PRESENT LAND USE

The consultant will carry out a complete assessment of the real state of the land and the way
in which the different uses are distributed in the territory. You should carry out a joint
analysis of the different activities carried out on the land and their impact and restrictions, as
well as a brief description of the quantitative data of the available areas.

This information can be detailed according to the uses for the different purposes (housing,
agriculture, livestock, forests, conservation, mining, etc.).

7. EXPECTED RESULTS

The environmental and social impact assessment report will be organized as follows:

 Non-technical summary (presentation of important results and suggested actions)


 Identification and address of the applicant.
 Legal regime of the activity, including resettlement and / or counterbalance, if
necessary, and its insertion in the existing Territorial Planning plans for the direct and
indirect area of the activity.
 Description of the activity and the different actions planned for the rehabilitation,
operation and decommissioning phases.

 Detailed description and comparison of the different alternatives.
 The delimitation and geographical representation of the area of influence of the
activity.
 The characterization of the reference environmental and social situation, including the
qualitative assessment of the services currently provided and the identification of
vulnerability to the effects of climate change.
 The forecast of the future environmental situation with or without mitigation
measures.
 Summary of the environmental and socioeconomic impacts and impacts of the
proposed alternatives.
 Identification and analysis of the impact of the project on health, gender and
vulnerable groups in the affected communities and proposals for mitigation measures.
 Identification and evaluation of direct and indirect impacts, residual and cumulative
impacts and mitigation, improvement and / or compensation measures.
 The Environmental Management Plan for the activity, which includes monitoring
impacts, environmental education programs, communication, emergencies and
accident contingencies.
 Socio-economic survey report as a separate annex when necessary and to be
submitted to CFM and the entity that supervises the resettlement; it must be prepared
in accordance with the Decree on the process of preparing and implementing the
resettlement plan, and include the Public Participation Report containing at least two
public consultations, namely:

i) one to inform stakeholders about the relevance and impact of resettlement


targets;
ii) another to present and discuss alternative areas for resettlement

 The public participation report in accordance with article 15, paragraph 9, of the
Environmental Impact Study Regulation

 Attachments: methods used, list of those responsible for environmental and social
assessment, minutes of interviews, reference documents, etc.

8. REFERENCES AND AVAILABLE DOCUMENTATION

The Consultant must ensure that the project complies with the environmental and social
regulations of Mozambique. In addition, he must apply international due diligence in terms of
project assessment, compensation and impact mitigation, in accordance with World Bank
procedures (see general guidelines (environmental, health and safety guidelines), sectoral
guides or others tabs (to be specified).

9. TEAM COMPOSITION

The assessment should be carried out by a consultant or a team with experience in


environmental and social assessment of railroad rehabilitation projects. A good knowledge of
the specifics of the country (Mozambique) would be an advantage.

10. SUBORDINATION

In carrying out the activities, the Consultant will be subordinate to the CFM and, technically,
will work in coordination with the MTA, Municipalities of Dondo and Chimoio in the
Provinces of Sofala and Manica respectively.

11. REPORTS AND PRODUCTS

 The documents to be prepared are subject to a favorable opinion from the MTA /
CFM / MTC / Financier

 All products developed within the scope of the consultancy will be the property of
CFM

 Partial and final products must always be delivered in five printed originals and two
electronic versions which must be delivered on CD / DVD.

 Most documents should focus on recommended conclusions and measures and should
contain several illustrations.

12. STUDY IMPLEMENTATION SCHEDULE

The time required to conduct the assessment is estimated in the following schedule:
