THIS DEED OF TRANSFER is made this ……… day of ………………… 2021

BETWEEN

MR. FRIDAY ERARHUYI of 9 Ogie Street, Uroho Community (hereinafter referred to as


“the TRANSFEROR” which expression shall where the context so admits shall include his
Heirs, Assigns, Executors, Personal Representatives, Administrators and Successors-in-title)
of the first part.

AND

MR. AJOKU SUNDAY OVIE of Evbuabogun Town Hall, off Sapele Road, Benin City, Edo
State (hereinafter referred to as “the TRANSFEREE” which expression shall where the
context so admits shall include his Heirs, Assigns, Executors, Personal Representatives,
Administrators and Successors-in-title) of the second part.

WHEREAS:

 The Oba of Benin, H.R.H Akenzua II, C.M.G; is the sole Trustee of all lands in Benin
in accordance with Benin native law and custom.
 By an application for Allocation of Building Plot dated 3/09/2012, and made to the
Enogie and Elders of Uroho community in Ikpoba Okha Local Government Area
through the Uroho Development Association Ikpoba Okha Local Government Area in
edo State by the “TRANSFEROR”, which application was duly approved all that
piece/parcel of land measuring 100ft by 200ft lying and situate at Uroho Community
Ikpoba Okha Local Government Area Edo State was allotted to and became owned by
the “TRANSFEROR”.
 The “TRANSFEROR” now desires to sell/alienate/transfer his interest in part of the
said piece and parcel of land, measuring 50ft by 100ft to the “TRANSFEREE”.
NOW THIS DEED OF TRANSFER WITHNESSES AS FOLLOWS:
1. In pursuance of the above recited clause, the TRANSFEREE pays the consideration
sum of N250,000.00 (Two Hundred and Fifty Thousand Naira) only to the
TRANSFEROR (receipt whereof the TRANSFEROR hereby acknowledges upon the
execution of this Deed).
2. The TRANSFEROR now transfers free of encumbrance his title/interest in all that area
measuring 50ft x 100ft earlier cited as lying and situate at Uroho Community, Ikpoba-
Okha Local Government Area of Edo State to the TRANSFEREE.
3. The TRANSFEROR undertakes to obtain all consents as required by law or custom to
the transaction.
4. The TRANSFEROR warrants that there is no dispute whatsoever over or relating to
the said piece of land and undertakes to indemnify the TRANSFEREE for the purchase
sum and all legal fees and expenses incurred by him in relation to this transaction and
the development of the land in case of any adverse claim.

IN WITNESS WHEREOF the parties of the first and second parts have hereunto set their
hands and seals the day and year first above written.
