ORDER
This matter coming to be heard for Prove-Up of Damages on January 10, 2022 and
following entry of Default Judgment before Judge Donnelly on November 22, 2021, proper
notice having been provided, Counsel for the Plaintiff, the Plaintiff (Sarah Manos), the Plaintiff’s
Witness (Dr. Kris Otteman), the Defendant (Mathew K. Berry), and Court Reporter (McGee
Court Reporting Services) being present via Zoom, and the Court being fully apprised of the
matter,

IT IS HEREBY ORDERED that judgment is entered against defendant Mathew K. Berry

for the following amounts:

 Pursuant to Count I, Humane Care for Animals Act (Daisy) and Count II,
Humane Care for Animals Act (Kirby),

o $4,661.32 (veterinary expenses set forth in 12/18/21 Affidavit of Sarah

Manos for dates spanning 05/04/20 – 06/24/20);
o $1,450.00 (purchase prices for dogs Kirby and Daisy set forth in 12/18/21
Supp. Affidavit of Sarah Manos);
o $12,769.48 (mental health services for Plaintiff set forth in 12/18/21 Supp.
Affidavit of Sarah Manos for dates spanning 2020-2021);
o $5,149.48 (attorneys fees set forth in 12/18/21 Affidavit of Anna E.
Morrison-Ricordati); and
o $100,000.00 (for specific acts of intentional cruelty and torture, as set
forth more specifically in the 02/16/21 Verified Complaint, to the dogs
Daisy, ¶¶ 6, 20-21, 22, 23, 24, 25, 28-29 -at least 3 separate instances; and
Kirby, ¶¶ 5, 16, 34-35, 37, 38-39, 40-42, 43, 45, 46, 47, 52, 79-84, 85, 86,
88, 89, 90, 93, 95, 96 – at least 19 separate instances; and as testified to by
Plaintiff and Plaintiff’s Witness on 01/10/22; minimally resulting in range
of mandatory damages pursuant to 510 ILCS 70/16.3 of $9,500 -
$475,000).

  Pursuant to Count II, Intentional Infliction of Emotional Distress,

o $38,308.44 (for the additional emotional damages to Sarah Manos apart

from those resulting from the distress suffered under Counts I and II, and
as set forth more specifically in the 02/16/21 Verified Complaint, ¶¶10,
11, 13, 14, 16, 18, 32, 36, 49, 62, 64, 67, 68, 78, 110-112, 127, and
including need for ongoing and future mental health care as testified to by
Plaintiff on 01/10/22).

Totaling an amount of $162,338.72 for damages under Counts I – III of Plaintiff’s 02/16/21
Verified Complaint.
