ESSAY

With the increasing number of terrorism activities in the past few years in the country, will the
passage of Republic Act 11479 or “The Anti-Terrorism Act of 2020” help in fighting terrorism in the
country? If given a chance what part or specific section of the said law would you revise? (minimum of
300 words)

The Anti-Terrorism law proliferate the definition of terrorism. This comprises broad offenses such as:
“engaging in acts intended to endanger a person's life,” intended to “damage public property” or
“interfere with critical infrastructure,” which intends to subdue the government. For me, instead of
helping the country fight terrorism, it would only offend the freedom and rights of the people, including
the freedom of association, freedom of expression, freedom of speech, and freedom of the press.
Although it is stated that this law is not intended to punish advocacy, protest, dissent, industrial action
and strikes, as long as the people would not bring a serious risk to the safety of public. But the question
is, who will define what is and what is not a serious risk? Especially when this administration defines
terrorism as any form of dissent. In this law, the terrorism suspect could be destined for a period of 14
days without charge, and this could be extended up until 24 days, which will be a violation to the
constitutional provision that a person must be charged within three days of detention. In addition, this
law will leave no chance for a rehabilitation in the sense that, it includes punishment of life
imprisonment without parole. Lastly, this law diminishes the accountability of implementing
organizations through using the term military personnel and law enforcement, which make it seems like
the bill focuses more on individuals rather than on concerned organizations. It would be better if the
terms used are law enforcement, public safety, and security agencies to encompass organizations or

units under the Department of Interior and Local Government, Department of Justice, Department of
National Defense, and the National Intelligence Coordinating Agency.

If given a chance, I would revise Section 15 since I find this as biased in favor of public officials that’s is
accused or found guilty in committing terrorist crimes. In my perspective, the Section 15 should read
that in addition to the punishment for their crimes as terrorists, the public officials in question should
also be charged with administrative offenses and meted with the penalty of dismissal from office and
suffer accessory penalties.
