INTRODUCTION

Registering each child and making sure they have a name and nationality is the

first step to recognising each individual as a human being with rights. These are core

elements of all individuals’ identity. Without them, children remain invisible into

adulthood: they have no legal identity, no voice and are at greater risk of other rights

abuses. This article is not only crucial to children, but also to States because, in order to

develop laws and policies that make sense, they need accurate information about the

number and situation of children in their country.

Even where children are registered, the type of information recorded on

their birth certificate can also violate their rights and lead to discriminatory treatment.

For example, in some countries children’s status as a ‘foreigner’ is recorded and means

they are denied rights enjoyed by other children.

The NSO estimates that about 10 to 15 percent of Filipino children born

yearly whose existence are considered “unofficial” because their births were not

properly documented. The birth certificate of a child is a proof of recognition of the new-
born’s individual importance to the state and his/her status under the law. The right to be

registered at birth is provided for in Article 7 of the United Nations Convention on the

Rights of the Child of which the Philippines was among the 196 nation signatories.

DEFINITION OF ITEMS

To provide clarification of the terminologies used in this study, the following

terms are operationally defined:

Child

A child is every human being below the age of 18 (eighteen) years old and may be 18

(eighteen) years but has no capacity to fully take care of themselves or protect

themselves from abuse, neglect, cruelty, exploitation or discrimination because of a

physical or mental disability/condition.

Parents

A mother or a father, caregiver of their offspring in their own species.


Guardian

Someone legally appointed to manage the affairs of a person incapable of acting

for himself or herself, as a minor or person of unsound mind.

Birth Certificate

A birth certificate is a vital record that documents the birth of a person. The

term “birth certificate” can refer to either the original document certifying the

circumstances of the birth or to a certified copy of or representation of the ensuing

registration of that birth.

Identity

Identity is the qualities, beliefs, personality, looks and/or expressions that make a

person or group. One can regard the awareness and the categorizing of identity as

positive or as destructive. A psychological identity relates to self-image, self-esteem, and

individuality.

Civil Registration

A continuous, permanent and compulsory recording of vital events occurring in

the life of an individual such as birth, marriage, and death, as well as court decrees, and

legal instruments affecting his civil status in appropriate registers as mandated by Act

No. 3753, the Civil Registry Law.

Service Providers
An entity that performs a function on behalf of a public authority, including

public private partnership, shared service or non-government organization (NGO). A

service provider can be a government or non-government.

Statement of the Problem

The purpose of the study was to know the reasons regarding Unregistered

children and why their parents didn’t registered their children in the civil Registration

office after birth and towards the present time. Specifically, the present study aimed to

answer the following queries:

1. What are the reasons for not Applying early For certificate?

2. What are the parents struggles in getting this certificate?

3. What are the responds of the service provider towards Unregistered Children

Scope and Limitation.

This study will only focus on the selected children, care givers and service

providers in Barangay Pindolonan, Saguiran Lanao Del Sur.

METHODOLOGY

This chapter explains the methodology used in the effort to know the reasons why

parents are not able to register there children’s birth certificate as early as possible.

The study was performed by the selected member of Pindolonan Young Leaders

Association(PYLA) with the assistance of GITIB, Inc. Five members were selected to act

as core group for the UNCRC audit. All of the researchers are advanced members of the
organization and participated in various UNCRC-related education seminars conducted

by the organization.

This study was composed of works of children and youth particularly in child

rights monitoring and be able to determine the status of the implementation of the United

Nation Convention on the Rights of the Children.

Research Environment

The present undertaking was done at the comfort of our participants. The

researchers conducted the interview in the community of the participants.

Research Participants

This study was conducted together with ten (10) women, ten (10) caregivers and

ten (10) service providers. The participant lives in Barangay Pindolonan, Saguiran

Lanao del Sur. These participants were asked about their experiences during and after

the Registration of Certificate. The researchers met the participants and informed them

about the purpose of the present study. They were oriented that the data gathered are

confidential and that their identities are kept in private. Further, the participants were

also informed that they can stop their participation in at study any time they want. This

ensured the good relationship with the participants which yielded their trust of the

researchers (Galletta, 2013).

Researchers
Pindolonan Young Leaders Association (PYLA) was organized in 2020 it derived

from the name of the barangay Pindolonan and the Young Aspiring Youths in the

Barangay which aim to unite the Children and youth and everyone in the Barangay.

Pindolonan Young Leaders Association (PYLA) is the first ever Children and Youth

organization advocating the environment, almost all of their activities was Community

Cleaning, Educational assistance and other recreational activities for the Children and

Youth.

As of now Pindolonan Young Leaders Association (PYLA) is still active and

Continue Fighting and calling for the rights of children and youth in Barangay

Pindolonan and extending it’s advocacy to neighboring barangays and communities

Barangay Profile

Barangay Pindolonan was originally named as “LILOD A LUMBAYANAGUE”. It

was later changed into “PINDOLONAN” a maranaw term which means “a place

between two Barangay” .

On 1886 Saguiran was part of DANSALAN now called Marawi City. Out of 19

nineteen (19) clans of families who originally living in marawi city, there were 9 families

lived 8n Saguiran an one of them is “Bauds A Akad”.


During the Spanish regime but the land in the place was used for agricultural

purposes. The people who were yet to live in the place was living on the riverside.

Before the American regime, Pindolonan was part of the municipal district of

sunggod a part of the “LIMA KA AGAMA”.Sunggod municipal district was merge to

Saguiran Municipal district by Presidential Decree No. 431 dated June 9, 1961. Part of

Piagapo was transferred to Municipality of Saguiran through the issuance of

Presidential Decree No.40 June 25, 1963.

When Martial Law Declared, The National Power Corporation (NPC) purchase

Parcel of land of Pindolonan Particularly along the riverside area. People Living in the

area Forced to Vacate their land transferred to the upper part area and made it as

Barangay.

The Barangay Government ensures to promote economic growth and peaceful

Community. Encourage Constituent’s Participation and uphold Righteous and

transparent Leaders.

This chapter discusses the data gathered for the audit regarding corporal punishment. It

presents and discusses the analysis of the data through tabular presentation.

2. Travel issues and lack of nearby offices in rural areas makes the parents feel lazy to travel far

to register their children and lack quality service from Providers affect the parents interest in

registering their children.

3. Financial problem is one of the reasons why parents didn’t register their children early, and the

slow and yet long process of the service providers that affect the interest of the parents.

Conclusions

Based on the findings of the data gathered these conclusions can be formulated: That the

lack of Quality service from the service providers and the other participants in the said offices

can highly affect the applicants. However there are instances that Parents try to make it work for

their children sake but there is still other struggles that they encounter . They also believed that

the BLGU should participate in this case so that it might be easier for them to communicate with

the LGU offices and guide parents no Educational attainment to avoid misinformation in

applying for the birth certificate.
