A BILL TO BE ENTITLED
AN ACT
1 To repeal an Act to provide a new charter for the City of Port Wentworth, approved
2 July 29, 2020 (Ga. L. 2020, p. 3993), so as to provide for transfer of duties and obligations
3 to Chatham County; to provide for transfer of all legal rights, privileges, and assets to
4 Chatham County; to establish a special tax and service district for outstanding bonded
5 indebtedness and other obligations; to provide for transfer of all federal and state permits and
6 licenses; to provide for the transfer of ongoing judicial actions; to provide for the
7 continuation of zoning and land use regulations; to provide for future proceeds of special and
8 regular local option sales taxes; to provide for related matters; to repeal conflicting laws; and
9 for other purposes.
11 SECTION 1.
12 An Act to provide a new charter for the City of Port Wentworth, approved July 29, 2020 (Ga.
13 L. 2020, p. 3993), is hereby repealed in its entirety.

15 Chatham County, Georgia, shall be vested with full authority to provide all governmental
16 services within that area comprising the former jurisdictional boundary of the City of Port
17 Wentworth. All ordinances, rules, and regulations of Chatham County shall apply within that
18 area as they do in other unincorporated areas of the county and the appropriate courts of
19 Chatham County shall have jurisdiction to enforce such ordinances; provided, however, that
20 this transition shall not impact any vested rights accrued prior to the effective date of this
21 Act.
22 SECTION 3.
23 Upon the effective date of this Act, the existence of any local authority created by or for the
24 City of Port Wentworth shall likewise terminate on the same date; provided, however, that
25 any joint authority of which the City of Port Wentworth was a part shall be modified by
26 operation of law to remove the City of Port Wentworth, and that authority shall continue in
27 existence with its remaining members. The assets and liabilities of any authority terminated
28 pursuant to this section shall be treated in the same manner as assets and liabilities of the City
29 of Port Wentworth under this Act.
30 SECTION 4.
31 There is hereby created a special tax and service district to be known as the Port Wentworth
32 Services District which shall correspond to and be coterminous with the corporate limits of
33 the City of Port Wentworth as those corporate limits existed on the effective date of this Act.
34 Upon the completion of the purposes provided in this Act for such service district, the tax
35 and service district may be abolished by resolution of the governing authority of Chatham
36 County.

37 SECTION 5.
38 (a) Except as provided herein, all legal rights, privileges, and assets of the City of Port
39 Wentworth and all records of such assets shall pass to Chatham County without the necessity
40 or formality of a deed, bill of sale, or other instrument of transfer. The assets to be
41 transferred shall include all real property assets of the City of Port Wentworth of any nature,
42 including without limitation freehold estates, easements, life estates, future interests, and
43 co-owned interests; all tangible and intangible personal property assets of the City of Port
44 Wentworth of any nature, including without limitation vehicles, heavy equipment, office
45 equipment, and software; all accounts receivable, rights to payment under contracts fully
46 performed by the City of Port Wentworth, and similar financial assets of the City of Port
47 Wentworth of any nature; and all digital and electronic papers and records of the City of Port
48 Wentworth. Expressly excluded from any such transfer are any rights or assets that derive
49 from executory contracts of the City of Port Wentworth addressed in Section 6 of this Act.
50 (b) Those amounts in any general fund for the City of Port Wentworth shall be immediately
51 transferred to the general fund of Chatham County and segregated by Chatham County for
52 the provision of services within the Port Wentworth Services District established pursuant
53 to Section 4 of this Act.
54 (c) Those amounts in any special fund for the City of Port Wentworth shall immediately be
55 transferred to a special fund of Chatham County and segregated by Chatham County for their
56 designated special purpose.
57 SECTION 6.
58 (a) Except as specifically provided in this Act, neither Chatham County nor the State of
59 Georgia, nor any political subdivision of the State of Georgia shall bear any responsibility
60 or liability for obligations, amounts, claims, debts, causes of action, judgments, or liabilities
61 that have accrued to the City of Port Wentworth or its local public authorities, up to and
62 including the effective date of this Act. Nothing in this Act shall in any manner obligate

63 Chatham County to provide continued employment for any employee of the City of Port
64 Wentworth or any local public authority of the city.
65 (b) Any bonded indebtedness of the City of Port Wentworth shall become the debt and
66 obligation of the Port Wentworth Services District established pursuant to Section 4 of this
67 Act. Chatham County shall be the successor to the City of Port Wentworth for all purposes
68 relating to such bonded indebtedness, including the enforcement of rights and remedies of
69 bondholders. The county shall be authorized but not required to levy a special district tax,
70 fee, or assessment within the Port Wentworth Services District established pursuant to
71 Section 4 of this Act for the purpose of paying the amounts due on such bonded debt.
72 (c) Other than those bonded debts provided for in subsection (b) of this section and
73 Section 11 of this Act, Chatham County shall be authorized but not required to assume the
74 rights and duties of any executory contract of the City of Port Wentworth in effect as of the
75 effective date of this Act. If assumed, any rights and obligations of such contracts that by
76 their nature are personal to the city shall be deemed to apply to the personnel, services, and
77 assets formerly belonging to the city so as to reasonably fulfill the basic purpose and bargain
78 of the original contract. The county shall be authorized but not required to levy a special
79 district tax, fee, or assessment within the Port Wentworth Services District for the purpose
80 of paying the amounts due under such assumed contracts, to the extent that the financial
81 obligations under such contract cannot be fully funded by funds and assets devolved to the
82 county from the City of Port Wentworth.
83 (d) Financial assets and property devolved to Chatham County that are deemed by the
84 county to be excess for purposes of serving the Port Wentworth Services District established
85 pursuant to Section 4 of this Act shall be used to satisfy any obligations and retire any
86 indebtedness of the City of Port Wentworth.

87 SECTION 7.
88 To the maximum extent permitted by law, all federal and state permits and licenses issued
89 to the City of Port Wentworth or its local authorities shall be transferred by operation of law
90 to Chatham County.
91 SECTION 8.
92 Notwithstanding any provisions of this Act to the contrary, on the effective date of this Act,
93 if any person is held in the custody of the City of Port Wentworth Police Department, the
94 staff of the former City of Port Wentworth Police Department shall have authority to retain
95 law enforcement custody until that person may be transferred over to the custody of the
96 Chatham County Sheriff's Office or other appropriate law enforcement agency.
97 SECTION 9.
98 All cases pending in the Port Wentworth Municipal Court shall be automatically transferred
99 to the appropriate court of competent jurisdiction in Chatham County. Any transfer of law
100 enforcement jurisdiction to Chatham County shall not in and of itself abate any pending
101 prosecution of any violation of any ordinance of the City of Port Wentworth, and the county
102 shall be entitled to enforce such city ordinance if a violation occurred while the city
103 ordinances were in effect. As for any other lawsuits involving the City of Port Wentworth
104 in the Georgia judicial system, the city shall cease to exist and therefore shall no longer be
105 a proper party to any legal action.
