ORDER
When this case was called for arraignment and pre-trial via video-conferencing pursuant to SC OCA Circular No. 93-2020, Public Prosecutor John Quincy Carandang and accused Rodolfo Truelda y Almoguera, assisted by Public Attorney Ailex Alexis Villamor, were present in the videoconference.
Due to the state of Enhanced Community Quarantine, the Court presided from her residence in Quezon City while the Public Prosecutor and the Public Attorney entered their remote appearances from Marikina City and Quezon City, respectively, while the accused was accessed from the Custodial Facility in Samson Road, Caloocan City. Accused understood that their arraignment was through videoconferencing.
When the accused were arraigned by reading the Information in Filipino, a language known and understood by him, assisted by their counsel de oficio, Atty. Ailex Alexis Villamor, the accused entered a plea of guilty. When queried, the accused and his counsel informed the court that he fully understood the nature and consequence of his entering a plea of guilty to the crime charged in the Information.
WHEREFORE, judgment is hereby rendered finding the accused Rodolfo Truelda y Almoguera GUILTY beyond reasonable doubt for Violation of Section 1(a)(1) of PD 1602 and is hereby sentenced to pay the fine of ONE THOUSAND PESOS (Php 1,000.00).
Upon payment of the fine, the Station Commander of the Custodial Facility, Caloocan City is hereby DIRECTED to RELEASE the accused Rodolfo Truelda y Almoguera unless he is being held for some other lawful cause/s.
