INFORMATION

The undersigned City Prosecutor of Cagayan de Oro accuses

ALFONSO CUERVO of the crime of "HOMICIDE," committed as
follows:

That on February 25, 2015 at about 1:00 o'clock in the

afternoon at Secret Malate, City of Manila, Philippines, and within the
jurisdiction of this Honorable Court, the above-named accused had a
heated argument with the victim over a pair of shoes in the
Department Store, and armed with a knife and without justifiable
cause or reason thereof, did then and there willfully, unlawfully and
feloniously attack, assault maul and stab one PWERTE DIMALAS
y AGUIZAPATOZ, hitting the different parts of the body resulting
to his instantaneous death.

That as a result of the criminal act of the accused, the heirs of

the deceased suffered the damage of:

Loss of earning capacity------------- Php 500,000.00

Death Indemnity ---------------------Php 50,000.00
Total------------------------------------Php 550,000.00

CONTRARY TO LAW, with the mitigating circumstance of

voluntary surrender.

CERTIFICATION

I HEREBY CERTIFY that I have conducted a preliminary

examination of the record of the above-entitled case in accordance
with Section 7, Rule 112 of the 1985 Rules on Criminal Procedure, as
amended; that the accused herein is a detention prisoner of Cagayan
de Oro PNP Detention Cell; that he refused to waive his right under
Article
125 of the Revised Penal Code; and that based on the existing record,
there is a reasonable ground to believe that the crime herein charged
has been committed and that the accused is probably guilty thereof.
