AFFIDAVIT OF DESISTANCE

I, MICHAEL JOHN CASTILLO y LAURENTE, of legal age, widow, Filipino,

with postal address at #9062 Unit D, Doña Remedios Trinidad Highway, Brgy. Pagala,
Baliuag, Bulacan, after having been sworn in accordance with law, do hereby deposes
and says that:

1. I am the complainant in a criminal case for violation of “Anti Carnapping Act of

1972” defined and penalized under Republic Act No. 6539, Qualified Theft,
Grave threat and Theft against MOISES FILOSOFO y RIOSA, JUN JUN
FILOSOFO y RIOSA and ERICRIS FILOSOFO y BERNARDO, docketed as NPS
DOCKET NO. III-04-INV-211- 02990-02993 pending before the Office of the
Provincial Prosecutor, City of Malolos, Bulacan;

2. After several conferences with respondents, I hereby declare that the same arose
out of pure misunderstanding and misapprehension of facts;

3. Based on the said misunderstanding, misapprehension of facts, I manifest that I

now withdraw my complaint against the respondents and that I am no longer
interested, and I hereby desist, in prosecuting the above-mentioned case;

4. This Affidavit of Desistance should, however, not be understood as a waiver or

relinquishment of any of my rights to pursue any legal action that I may file in
connection with any act or omission that the respondents may commit in the
future;

5. I hereby release the respondents from any and all criminal liabilities and waive
any right of action against the accused in connection with the above-mentioned
case;

6. I fully understand the legal consequences of this Affidavit of Desistance;

7. I am executing this affidavit to attest to the truth of the foregoing statements and
respectfully pray that the aforementioned case against the respondents be
withdrawn and/or dismissed.
