JUDICIAL AFFIDAVIT-COMPLAINT OF EMELY LOAYEN

I, EMELY LOAYEN, 25 years old, single, residing at Dagupan Weste, Tabuk City,
Kalinga, after having been sworn to in accordance with the law, do hereby depose and
state:

That PMSg Joy X Torres is the police officer who conducted and supervise my
examination as a witness at the Tabuk City Police Station, Dagupan Tabuk City, Kalinga;

That I am answering the questions herein fully conscious that I do so under oath
and that I may be criminally liable for false testimony or perjury;

The following are the questions propounded by PMSg Joy X Torres and my
answers thereto in English language;

Questions:
Question 1: Do you swear to tell the truth and nothing but the truth?
Answer 1: Yes Ma’am.

Question 2: Are you same EMELY LOAYEN, the private complainant in this case for
Rape now being investigated by this office?

Answer 2: Yes Ma’am.

Question 3: Do you personally know the suspect in this case, Mr. Roland Bagsic?
Answer 3: Yes Ma’am.

Question 4: Can you tell us why you personally know Mr. Roland Bagsic?
Answer 4: He was my schoolmate during our high school days.

Question 5: Where were you in the evening of November 10, 2021?

Answer 5: Along the rice paddies at Appas, Tabuk City, Kalinga.

Question 6: Who were with you that time?

Answer 6: I was with my friends Noel Caoli and Luis Pulido.

Question 7: What happened during that time?

Answer 7: I and my friends came from a birthday party at San Juan, Tabuk City and
while we were walking along the rice paddies at Appas, Tabuk City when suddenly
ROLAND BAGSIC appeared from behind and assaulted my two-companion using a
double-bladed knife. I was shocked and got nervous of what I saw and I immediately
run away but ROLAND BAGSIC chased and caught me. He forcibly dragged me to a
nearby vacant hut in the middle of the rice field at Brgy Appas.

Question 8: What happened next inside the hut?

Answer: ROLAND BAGSIC poked his knife around my neck, threatened and forcibly
removed my pant and panty. I tried to resist but he was too strong and I am afraid to be
stabbed. Eventually, he immediately removed his pant and forcibly inserted his middle
finger and stiff penis inside my vagina in standing position from behind (dog style).

QUESTION 9: How could you say that it was ROLAND BAGSIC who sexually assaulted
you?

ANSWER: when he assaulted my companion, I pointed my flashlight to his face and I

know him personally since we were batchmates in high school and he was also present
at the birthday party where we came from.

Question 10: Do you have anything else to say, MS. EMELY LOAYEN?
ANSWER: No more Ma’am.

lll. Suspect: Roland Bagsic, 29 years old, born on February 16, 1993, single, and a
resident of, Brgy. San Juan, Tabuk City, Kalinga.
Status: Arrested

lV. Brief Narrative of the Incident:

On the aforementioned date, time and place, elements of this station led by
PLTCOL JOEY JONATHAN B BAGAYAO, COP, together with Pinukpuk MPS
under the supervision of PCOL CHARLES L DOMALLIG, PD, were able to arrest
the above named accused in his brother’s residence by virtue of Warrant of Arrest
(WOA) issued by Hon. Jerson Angog, Presiding Judge, Regional Trial Court,
Branch 25, Tabuk City, Kalinga dated October 1, 2022 for murder and rape,
docketed as Crim. Case No 21-2021-C and 22-2021-C with no bail recommended.

V. Action Taken:
Subject person was apprised of his constitutional rights in a dialect known to
him during his arrest and was brought at the Kalinga Provincial Hospital for
medical examination and was thereafter found to be in good mental and physical
condition. He is now under the custody of this station for proper disposition.

To be presented to the court who issued the warrant.

COMES NOW the undersigned warrant officer/PNCO, Tabuk City Police

Station and unto this Hon. Court respectfully Manifest:

1. That on October 9, 2022 at 10:00 O’clock in the morning the undersigned

together with the Intelligence Division of this station and Pinukpuk MPS under the
supervision of PCOL CHARLES L DOMALLIG , PD, went to serve the warrant
of arrest issued by this Court in the above entitled cases against accused ROLAND
BAGSIC upon receipt of an information that said accused is found staying in his
brother’s house at Brgy Pakawit, Pinukpuk, Kalinga;

2. That the team of the undersigned successfully served the warrant of arrest
against the accused ROLAND BAGSIC and was duly informed of his
constitutional rights, he was brought to Kalinga Provincial Hospital for medical
examination which found him in good mental and physical condition;

3. The accused is currently detained at the Tabuk City Police Station for
proper disposition by this Hon. Court. Tabuk City, Kalinga, this 9th day of October,
2022.
