19 years old and ALEX “KIDLAT” MENDIOLA 20 years old of the Crime of Rape In relation
to R.A. 8353 Sec. 266-B, R.A. 7659 Sec. 11, Art. 335, R.A. 7610 Art. 1 and R.A. 1084 Sec.
267 committed as follows:

That on or about the 12TH day of AUGUST, 2022, at around 08:00 IN THE
MORNING, in Barangay ANUPUL, municipality of BAMBAN, province of TARLAC,
Philippines and within the jurisdiction of this Honorable Court, the above-named accused, taking
advantage of their superior strength, by means of force and intimidation, and with the use of a
dagger or deadly weapon, did then and there willfully, unlawfully and feloniously have sexual
intercourse with MARYGOLD E. FERNANDEZ against her will, to her damage and prejudice.

COMPLAINT-AFFIDAVIT
I, MARYGOLD E. FERNANDEZ, Filipino, of 17 years of age, and with
residence at No. 143 Sitio Mabilog, Brgy. Anupul, Bamban Tarlac, after having been duly sworn
in accordance with law, hereby depose and state that:
This complaint-affidavit is being filed to charge DENNIS “DENCIO” LACSA and
ALEX “KIDLAT” MENDIOLA, both Filipino, and of legal age and with residence at Sitio
Mabilog, Brgy Anupul Bamban Tarlac, of the crime of Rape under R.A. 8353 Sec. 266-B and
with the relation to the R.A. 7659 Sec. 11, Art. 335, RA 7610 Art 1 and RA 1084 Sec. 267,
committed as follows:
a) On the 15th of August 2022, at around 4:30 in the afternoon, I was walking outside of our
street to buy some food to eat when a white van stopped and I suddenly picked into the
van by the two fully covered suspect named Dennis Lacsa 19 years of age and Alex
Mendiola 20 years of age;

b) And headed to a distant place going to the parua river control in Sitio Gumain Bamban,
Tarlac, where no one can find us.

c) When they get to our destination Mr. Mendiola, then suddenly whipped out a fan knife
and a gun and poked it against the me and told me “Huwag kang sisigaw o gagawa ng
ingay, kung hindi papatayin kita!”

d) Mr. Lacsa then asked me to remove all my clothes for him and and told Mr. Mendiola to
hold me from behind. Out of fear for my life, I just followed the suspect orders.

e) While I was removing all my clothes, Lacsa and Mendiola draw their short pants down to
their knees and while they are busy I get the chance to steal the gun from Mr. Mendiola
and poked it to them then quickly run away going to a crowded place.

f) Then got the chance to asked other people for help and report to the nearest police
station.

g) And as I went to the nearest Municipal Police Station in bamban, PS/INSP MIKKO
SORIANO MIRANDA then assist me and quickly response to the crime I was involved
with. The Police took my sworn statement, and made an integral part thereof There after,I
was examined by their medico-legal officer.
 h) Based on the foregoing, it is beyond cavil that respondents DENNIS “DENCIO” LACSA
and ALEX “KIDLAT” MENDIOLA committed the crime of rape punishable under Art.
R.A. 8383 Sec. 266-B and in relation to R.A. 7659 Sec. 11, Art. 335, RA 7610 Art 1 and
RA 1084 Sec. 267. They had sexual intercourse with me even if I was just 17 years old.
This constitutes statutory rape as defined in our laws.
Further, whenever the crime of rape is committed with the use of a deadly weapon or by two
or more persons, the penalty shall be reclusion perpetua to death.
