AFFIDAVIT OF DESISTANCE

I, Angela Cano, of legal age, single, Filipino, and a residence of Cantaongon, Loon ,Bohol, after
having been duly sworn to in accordance with law, hereby depose and state that:

That, I am the complaining witness for RAPE WITH HOMICIDE against Joseph Cruz in case entitled
“People of the Philippines” versus Joseph Cruz “,Criminal case No.12345, Provincial Trial
Court ,Branch No.11 , Province of Bohol.

That, After my sober and soul-searching assessment and analysis of the incident, i have realized
that because I was not wearing my eyeglasses and it was dark, I can not point out, without a doubt
the accused or any other person/s who inflicted harm against me.

That, Since I could not state with certainty and without doubt liability of Joseph Cruz in fairness to
him, I am permanently withdrawing my complaint against him, I clear him of whatever
responsibility of liability to me.

That, I hereby inform the City of Prosecutor of Bohol that I am withdrawing my complaint for Rape
with Homicide in Criminal Case No.12345 entitled “People of the Philippines” versus Joseph Cruz ,
Provincial Trial Court , Branch No.11 ,Province of Bohol.

That, I likewise request the Provincial Trial Court , Branch No.11 , Province of Bohol to dismiss with
prejudice the said criminal case.

REPLY-AFFIDAVIT

I, ROY CHRISTIAN SAYUD , Filipino, of legal age, married, resident of Cantaongon, Loon, Bohol
Philippines, respectfully submit hereunder, my reply to the Counter-Affidavit of respondent
CHRISTIAN JAY RULONA, to wit:

1. I am filing the instant Reply-Affidavit in order to accurately describe the relevant events of March
10, 2024 and account for the actions of MR. CHRISTIAN JAY RULONA that may establish his
commission of the crime charged in the instant case. The following are the unadulterated facts
based on my personal knowledge and observation.

2. My Wife, ANN JEAN SAYUD and I, were invited by MR. CHRISTIAN JAY RULONA, a family friend,
to have a picnic at the Basdacu Beach , Loon , Bohol at 8:00 am on March 10, 2024, to supposedly
celebrate the 1st year anniversary of their being business partners for the "FRUIS SHAKE AND ZIP":

3. My wife and I arrived in Basdacu Beach at 8:15 am, bringing with us a picnic basket with Cake ,
Pepsi Soft drinks, white chocolates, which was a favorite of the respondent;

4. Upon arriving at the Basdacu Beach , respondent was already waiting, with a picnic mat already
laid;

5. Respondent was wearing a plain black t-shirt ", and was wearing blue pants and black shoes:

6. Respondent then asked my husband and I to take a walk around the beach to which we
agreed.

7. The respondent then, suddenly, out of nowhere took out a knife from his front pocket, and
stabbed my wife 2 times on the back, while shouting. "BWESIT KA!";
8. My wife fell immediately, and I ran to him, and noticed that she was already gasping for breath,
and before expiring she said: "I forgive him, thank you, I love you.

9. The respondent then started running, while some concern people chased him;

10. The respondent's alibi that he was in Loon Public Market is false and cannot overcome my
positive identification of his person;

11. With the foregoing facts which prove treachery, I therefore most respectfully pray that criminal
information for murder case be now filed against CHRISTIAN JAY RULONA as there is more than
probable cause for his indictment. I am executing this reply-affidavit to attest the truth of the
foregoing and to support my complaint for murder case against the hearing respondent.

12. I hereby expressly reserve my rights to file supplemental affidavit and additional evidences in
the course of the proceeding
