CONTRACT NO. P&P/DB/PATHADUMBARA/2013, This has reference to your letter no L-KNPIWSP-PD-2021-1887 dated 6 November 2021 regarding above subject. We highly condemn the points that you mentioned in the above letter avoiding liability in accordance with the contract agreement, According to the contract agreement it is clearly mentioned that the contractor shall be responsible for the any damages which occurred as a result of construction work along the roads within construction period and also in two years maintenance period. Further, existing road conditions shall be re-established before handing over of the completion section back to relevant authority. As per the clause 8,2.1.7.1.43 it is clearly mentioned “The contractor obligation shall terminate on completion of the maintenance period as described in clause 1” (for farther detail refer Contract document clause 8.2.1.7.1 for RDA conditions). Also, in clause 8.2.1.7.3 under specifications it is mentioned that “The contractor shall include in his price for all materials and labour which he may bi; e to employ and other expense in reinstating such trenches and surfaces to their original condition to the satisfaction of the Engineer and responsible Authority concerned”, Hence you are not allowed to rectify those damages together with permanent reinstatement work.
