Lesson 3 Republic Act 9275 – Philippine Clean Water Act of 2004

1. What is the legal basis of fines and punishments of R.A. 9275?


ANSWERS:
The Philippine Clean Water Act of 2004 (Republic Act No. 9275) aims to
protect the country's water bodies from pollution from land-based
sources (industries and commercial establishments, agriculture and
community/household activities). Failure or refusal to clean up which results in
serious injury or loss of life or lead to irreversible water contamination of surface,
ground, coastal and marine water shall be punished with imprisonment of not
less than 6 years and 1 day and not more than 12 years and a fine of Php
500,000/day for each day.

2. As a student, how will you help the government in implementing and exercising
R.A. 9275?
ANSWERS:
This Act provides for the abatement and control of pollution from land
based sources, and lays down water quality standards and regulations. As a
student we have to follow the law to prevent pollutions to the water. Because this
the only sources that our Nations should protect since this is one of the priority
needs of people. As youth I will use my voice to implement cleanliness for the
safety of our land.

3. Mostly, violators of this act are not apprehended due to some connections in the
Government. As a future law enforcer, what are the actions to be taken in order
to apprehend these violators?
Answer:
The DENR should take it seriously to focus on these situation since it’s not
worsen. This violators should be given warnings from the Department of
Environment and Natural Resources . As a future law enforcer, I will use my degree to
spread awareness of what will happen in the future if this issue will be neglected
by higher government.
4. What are the actions to be taken by the Department of Discharge and waste
water if the owners or operators of facilities failed to apply for permit?
ANSWER:
All owners or operators of facilities that discharge wastewater are required
to get a permit to discharge from the DENR or the Laguna Lake Development
Authority. Existing industries without any permit are given 12 months from the
effectively of the implementing rules and regulations (IRR) promulgated pursuant
to this Act to secure a permit to discharge.

1. Discuss the violations of RA 8749 and their fines and penalties.


Answer:
Republic Act No. 8749, otherwise known as the Philippine Clean Air Act, is
a comprehensive air quality management policy and program which aims to
achieve and maintain healthy air for all Filipinos.
A fine of not more than P100,000 for every day of violation shall be
charged against the owner of a stationary source, until such time that standards
have been met. For gross violation, the penalty is imprisonment of not less than
six years but not more than 10 years upon the discretion of the court.

2. How can air pollution be solved in the Philippines?


Answer:
The most basic solution for air pollution is to move away from fossil
fuels, replacing them with alternative energies like solar, wind and geothermal.
Producing clean energy is crucial. But equally important is to reduce our
consumption of energy by adopting responsible habits and using more efficient
devices.

Some houses have their own piggery in their backyards. And others don’t practice the
proper way of deterging the cages.

3. Is this act applicable in this case? Explain.


Answer:
Yes, people that are taking care of pigs should liable in this case. They are
responsible to clean their cages, since the smell of their cages might cause ill to
their neighbour if it is not clean.

4. Assume that you are a law enforcer, how can you apprehend the violators of
Philippine Clean Air Act?
Answer:
As long as its not worsen I should confront that violators to help cleaning
maintaining fresh air and clean its cages. Because if they did not follow law might
give them what are they really deserve to pay or punish through law.
Lesson 5 REPUBLIC ACT NO. 9729

1. What are the underlying reasons for enacting the Climate Change act?
Answer:
The Climate Change Act was enacted to protect the right of the people to
a balance and healthful ecology. The law serves as an action plan that lays out
the strategies, initiatives, and activities to prepare the country to the inevitable
effects of climate change.

2. Is it possible to prevent the worst effects of climate change? Explain.


Answer:
Yes , it may not be too late to avoid or limit some of the worst
effects of climate change.  If people would change how they treat our mother
land it will not make worsen the climate to change.
Reducing short-lived climate pollutants gives us our best chance to rapidly
limit global temperature rise and reduce the risks to food security.

3. Discuss the powers and functions of the climate change commissioners.


Answer:
As the lead policy making body on climate change, the Commission
is tasked to coordinate, monitor, and evaluate programs, budgets and action
plans of government relating to climate change both at the national and local
government levels..

4. What actions can you contribute in implementing and exercising this act?
Answer:
Maintaining cleanliness, awareness and taking good care of our mother
nature are my priority in implementing this act
