1.0 DESCRIPTION OF PROJECT :

1.0 INTRODUCTION :

The proposed work envisages the Name of Work:- Desilting & Jungle cutting of group
Checkdam/Bandhara (1) bhuteshwar checkdam (2) Hathab Bandhara in Taluka
Bhavanagar Dist Bhavnagar consists of following principal items.

The proposed work includes

i. Excavation in all sorts of strata and formations including depositing
the unuseful excavated stuff as and where directed including sorting
and stacking useful materials as required and upto lead of all and all
lifts etc. complete, including dewatering.(a) In Overburden including
Hard murrum.
ii. Jungle clearance of specified Catgory and bushes for Canal/dam
work as directed with depositing material etc complete.(excluding
tree of grith above 0.50mt) (a)More than 2 year old

The above information is only a general outline and does not in any way limit

scope for the work under this tender. No claims shall be entertained if any of the

items and individual works is deleted or location or type of structure is changed

after tender is accepted. Location of these structures / works is normally

accessible from the existing roads in the area in fair weather. However the

contractor shall make his own arrangement for suitable approaches to the

locations of structure for carrying the tendered work. Such approaches shall be

planned, constructed maintained at this own cost.The separate tender is not

permissible for any part of the work which should be noted.

2.01 The terms and conditions provided in Gujarat Public Works Contract Dispute
Arbitration Tribunal Act -1992 and order issued by the Government in connection
with this Act will now apply for arbitration.
2.02 The contractor shall along with his application for referring the dispute to
arbitration, deposit with the Government in cash or sum equal to 5 (Five) percent
of the amount of the claim or any amount that may be fixed by the Government
subject to maximum of Rs. 5,000.00 towards the cost of arbitration. The cost of
arbitration shall be shared equally between the contractor and the Government. It
the share of the contractor in respect of the cost of arbitration proceeding exceeds
the amount deposited by the contractor, he shall be liable to pay the difference
and if such share is less, he shall be entitled to the refund of the difference.
(a) The award shall be speaking award in give reasons and details for every
claim/item on which award given. The award of the arbitration shall be final and
bonding on both the parties. (R.&B. G.R. No. TNC/1088/1B/283(i)/C dated 30-11-
88).
(b) The application for referring any dispute to arbitration shall be made by the
contractor with deposit of Rs. 5,000.00 and with the details of matters and dispute
within 90 days of the final bill for the work or within 90 days from the date of the
abandonment of the work.

The contractor as per rules should bring the minerals only after obtaining the
lease of the quarry and will also have to pay the Royalti charges thereof to the
