Dear Resident(s):
We have received your request to Assign your Lease to another party. In order to assign your Lease,
each prospective Assignee(s) and/or Guarantor(s) must submit original, separate, and completed
Application(s) for Lease, and meet the Landlord’s qualification requirements equal to 50x the rent for
lease holders and 80x the rent for guarantors. All Lessee(s) and/or Guarantor(s) remaining on the lease
must submit updated financials in the forms of two (2) most recent paystubs and/or an updated
employment verification letter.
Please note that there is a non-refundable, non-negotiable processing fee of $500 and a non-refundable
$20 credit check fee (for both partial and complete Assignments). In order to process your request for
pre-approval, please complete and return all documents on the enclosed checklist to the Management
Office at the address above in one complete package. Additionally, all rent and other charges on your
account must be current and paid in full.
Please note that the pre-approval process takes up to seven (7) business days to complete, please plan
accordingly. After pre-approval is verified, final riders and the Assignment and Assumption of Lease
document will be sent out for all Assignee(s), Assignor(s), and Guarantor(s) to sign.
Once all original, final paperwork is returned to the Management office, the Assignment and
Assumption of Lease will be reviewed and executed by the Landlord and a copy confirmation will be
sent to you. Please be advised that all Lessee(s) remain fully responsible for all terms and conditions
of the current Lease until you receive a fully executed Assignment and Assumption of Lease from
Management.
Please note that a Lease Assignment does not begin a new lease, but rather is an addendum to the
original lease which also applies to a Lease Assignment at the renewal process. It is also important to
note that the apartment is being assigned in “As-Is” condition and the Assignee will be responsible
for any prior damage to the apartment.
Should your Assignment be approved, you and the Assignee(s) will be responsible for making
arrangements to exchange keys, and turn utilities such as telephone, electric, cable, etc. on and/or off, if
necessary. You will also be responsible for providing a copy of the original Lease to the Assignee(s).
All moves (both in and out) must be scheduled by contacting the Management Office. Assignee(s) will
not be permitted to schedule a move-in until final paperwork has been executed by the Landlord.

By signing below, Applicant acknowledges and agrees that (a) his/her references and tenant screening report
must be satisfactory to Ogden CAP Properties, LLC, as agent for MF Associates of New York LLC and/or
Yorkville Plaza Associates LLC (“Landlord”), in its sole and absolute discretion, (b) no representations or
agreements made by any broker, agent, salesperson or other person or entity will be binding on Landlord
unless included in the written lease (if any) that is executed by Landlord, and (c) in no event will Landlord
be bound, nor will possession be given, unless and until a lease executed by Landlord has been delivered to
the Applicant.
