REQUESTED ACTION:
Adopt amendments to Chapter 110 and Chapter 240, Articles 1 and 3 of the UDO and the
Downtown Chamblee Town Center PUD Pattern Book for TA2022-02 - Taproom UDO
amendment.

SUMMARY:
Businesses have approached the city about opening a taproom; however, they were not able to
open in Chamblee due to our ordinances. Taprooms are spaces dedicated to primarily serving
beer or wine to patrons and differs from a craft brewery or craft distillery in that they do not
produce their own beverages, but instead, offer beer or wine on tap for both consumption on-
site and for package retail sales, which may include the packaging of growlers. Taprooms differ
from brew pubs in that they do not need to have the majority of revenue from the sale of
prepared meals and food.

Therefore, staff is proposing amendments to Chapter 110 and Chapter 240, Articles 1 and 3 of
the Unified Development Ordinance (UDO) and the Downtown Chamblee Town Center PUD
Pattern Book to create a definition and supplemental use regulations for taprooms. Staff is
proposing to allow the taproom use in the Downtown Chamblee Town Center PUD district.

Summary

Businesses have approached the city about opening a taproom; however, they were not able to
open in Chamblee due to our ordinances. Taprooms are spaces dedicated to primarily serving
beer or wine to patrons and differs from a craft brewery or craft distillery in that they do not
produce their own beverages, but instead, offer beer or wine on tap for both consumption on-
site and for package retail sales, which may include the packaging of growlers. Taprooms differ
from brew pubs in that they do not need to have the majority of revenue from the sale of
prepared meals and food.

At this time, City staff proposes permitting taprooms only in the Downtown Chamblee Town
Center PUD district. The definition of taproom will be established in the UDO and the use could
be permitted in other zoning districts in the future outside of the Downtown Chamblee Town
Center PUD district. The supplemental use standards for taprooms will not allow fuel sales on
the same premises and prohibit unenclosed outdoor storage and equipment.

Proposed Amendments to the UDO


As a companion to the recent Alcohol Ordinance Amendment, this ordinance will amend the
Unified Development Ordinance (UDO).

• Title I, Chapter 110: A definition would be added to the UDO to define a taproom
establishment as the following:

Taproom: An establishment dedicated to the sale of beer and/or wine for off-site and/or
on-site consumption that meets the dispensing and hours of operation requirements of
the Alcohol Ordinance.

• Title II, Chapter 240, Article 1: Taproom will be added to the permitted use table

• Title II, Chapter 240, Article 2: Supplemental use standards would also be added for the
taproom use, as follows:
a. Fuel sales are not allowed on the same premises as a taproom.
b. No unenclosed outdoor equipment or unenclosed outdoor storage is permitted.

• Downtown Chamblee Town Center PUD Pattern Book: Staff recommends allowing
taprooms as a permitted use in the Downtown Chamblee Town Center PUD district,
provided the taprooms meet the supplemental use regulations in the UDO.

Section 110-1. - Definitions.

For the purpose of interpreting this UDO, certain words and terms used herein shall be defined as
follows and may be referenced in other titles of this UDO:

Subdivision: The division of a tract or parcel of land resulting in one or more new lots or building
sites.

Taproom: An establishment dedicated to the sale of beer and/or wine for off-site and/or on-site

Section 240-13. - Supplemental use provisions.


(b) The following supplemental use provisions are organized by major use category as presented in
Section 240-1, Table of Permitted and Prohibited Uses. Permitted use table reference numbers are
presented in brackets [#].

(21) Restaurants with outdoor dining [3.2]. Outdoor dining for restaurant service is permitted
subject to the following standards:
a. No outdoor seating shall be used for calculating seating requirements pertaining to the
location of, applications for, or issuance of a liquor license for any establishment nor shall
the additional seats be used to claim any exemption from any other requirement of any
county or state codes or ordinances.
b. Outdoor dining abutting a public sidewalk shall be subject to the following additional
development standards:
1. Outdoor dining areas may not conflict with sidewalk clear zones. They may be
counted toward the required supplemental zone. When located adjacent to a sidewalk
clear zone, the outdoor dining area shall be clearly delineated.
2. A minimum setback of at least 2 feet from the curb line shall be provided adjacent to
on-street parking spaces in order to maintain adequate space for pedestrian access to
motor vehicles.
3. White string lighting may be permitted during operating hours.
4. Outdoor entertainment shall not be amplified and shall cease at 10:00 p.m. Sunday
through Thursday and at 11:00 p.m. Friday and Saturday.

THE CITY OF CHAMBLEE, GEORGIA THAT THE PROVISIONS OF THE “UNIFIED
DEVELOPMENT ORDINANCE” BE AMENDED AS ATTACHED.
It is hereby declared to be the intention of the Mayor and City Council that the sections, paragraphs,
sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree
of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs and sections of this ordinance.
The foregoing was proposed by Council member ____________________ with a motion that the same be
adopted. Said motion was seconded by Council member _________________________. Same was then
put to a vote and _______Council members voted in favor of the Ordinance and _______Council
