D E C I S I O N

Based on the Report submitted by the Broadcast Services Division

(BSD), a Show Cause Order was issued against Pigkawayan Cable TV &
Telephone System for its failure to submit its Audited Financial Statement
(AFS) since 2000, and failure to pay its outstanding Supervision and
Regulation Fee (SRF) for the years 1997 up to 2008 in the amount of One
Hundred Eighty Seven Thousand Nine Hundred Twenty Seven Pesos and
Five Centavos (PhP 187, 927.05).

Upon evaluation of the evidence presented, Respondent has failed to

submit its AFS since 1997, and has not paid its outstanding SRF.

In view of the foregoing premises, Respondent has violated the terms

and conditions of its Provisional Authority and is hereby penalized for such
violation pursuant to Commonwealth Act (CA No. 146, NTC Memorandum
Circular (MC) 04-10-2006 and such other related laws, rules and regulations.

However, based on the Report of Broadcast Services Division (BSD)

dated 21 July 2021, and an Order issued by the Commission for BMC Case
No. 94-289 dated 23 October 2008, Respondent’s Motion for extension of
Provisional Authority was dismissed on the ground that Respondent is no
longer existing.

WHEREFORE, in view of the Report that Respondent is no longer

operational and existing, the instant Administrative Case is DISMISSED
without prejudice to the payment if its outstanding SRF obligation.

The Regional Office No. XII is hereby directed to inspect the current
status of Pigkawayan Cable TV & Telephone System.
