Subject: Request for reconsideration relative to the Show Cause Order

Dear Mr. Cayanan:

We are writing in response to your letter dated 06 June 2022, addressed to this Office regarding
the alleged refusal of our Compliance Officers to be accommodated for inspection last 26 May
2022.

During the said scheduled mandatory random inspection, our Compliance Officers were able to
enter your garage and were met by persons who claimed that they were not authorized to
accommodate the team despite the latter being authorized to inspect your premises for purposes
of the issuance of your applied Environmental Clearance. As added measure to accommodate
you further and despite the presence of your staff who should have already accommodated the
team for inspection, our team tried calling the contact number provided in your application.
However, there was also no one answering the call.

Please be reminded that this act is in violation of SP-2350, S-2014, Chapter II, Section 6, to wit;

“SECTION 6. REFUSAL OF ENTRY AND INTERFERENCE – It shall be


unlawful for any person to refuse entry and to resist or interfere with the conduct of
inspection of any authorized representative of the Department, who shall, after
properly announcing the purpose of his visit through the presentation of the mission
order, have the authority to enter, inspect, investigate, verify, monitor, or take
pictures at any time during operating hours…xxx”

Due Process has been afforded on your part through the Show-Cause-Order dated 31 May
2022. Despite the reasons provided in your letter– may we respectfully inform you that this
Office is acting on behalf of the City in enforcing the Government’s Police Power and the
General Welfare of the City and that as a business owner who is granted the privilege to conduct
your business in this City, there are laws and regulations you must comply with.

Hence, your request is hereby DENIED for lack of merit and you are directed to pay the fines
for the abovementioned violation within five (5) working days from receipt hereof. Failure to
comply shall be basis for further administrative/legal action.
