CONTRACT OF SECURITY SERVICES

KNOW ALL MEN BY THESE PRESENTS:

MADARON SECURITY AGENCY a duly licensed security agency with office address
at 1066 Alfonso Mendoza St., Sampaloc, Manila, represented by its Licensee, MR.
ORLANDO V. BATTA herein after referred to as the AGENCY;

AND

(NAME OF POSTING) duly organized and existing under the laws of the Republic of the
Philippine (ADDRESS OF POSTING) represented by its President,
____________________ herein after referred to as the CLIENT;

W I T N E S S E T H:

WHEREAS, The CLIENT is desirous of engaging the services of the AGENCY for the
purpose of guarding and protecting the lives, properties of the CLIENT against theft,
robbery, pilferages and other unlawful acts that may be committed by any person within the
premises of the CLIENT or in any other place designated by the CLIENT to be protected.

WHEREAS, the AGENCY agrees to render security services to the CLIENT under the
following terms and conditions:

1. That ______ (__) security guard/s duly licensed, well trained and properly-armed in
accordance with the specified of PNP SOSIA security guard/s shall be deployed at
the CLIENT’S establishment for Twenty-four (24) hours every day, including
Sundays and holidays. Each security will render 12 hours duty in accordance
client’s policy.
2. That the AGENCY shall exercise due diligence in the selection and supervision of
guards to be deploy must be 21-45 years of age with pleasing personality, will built
to ensure that its responsibilities and duties under this contract shall be faithfully
complied with, but deployment will depend on approval of Peace & Order
Committee.
3. That the AGENCY shall nor provide/deployed Security Guards at the CLIENT’S
establishment from any Security agencies that previously served / assigned
________________ even one day or a reliever only.
4. Any property of the CLIENT that will be brought out of the premises shall carry
the written approval of the authorized personal of the CLIENT and inspected by the
security/s.
5. An inventory of properties shall be provided to the AGENCY upon the effectivity
of this contract. The CLIENT shall inform the AGENCY in writing of newly-
acquired properties like machines and vehicles that are stored within the premises of
the CLIENT.
6. That the AGENCY shall be held liable for losses or destruction of properties
belonging to the CLIENT, provided however with the following conditions:

a. The loss or destruction is attributed to the negligence of the security guard on duty
and not force majeure or fortuitous event;
b. The loss or destruction took place during the tour of duty of the security guard and
within the premises designated to be secured at ____________________
c. The property involved belongs to the CLIENT if the loss or destruction involves
the personal property of any personnel, client or guest of the CLIENT, the said
property must have been properly indorsed or checked in with, or brought to the
attention of, the AGENCY or the security guard.
d. The property involved is not newly-acquired property which the AGENCY was
not informed about in accordance with paragraph 4 above.
e. The loss or destruction does not involve small items like calculators, pens,
punchers, table clocks and the like, unless these items are placed under the control
of the security guard;
f. The OIC as head security guard, must be the one to report to the AGENCY within
twenty-four (24) hours after its occurrence or discovery;
g. The loss or destruction is reported to the appropriate police or investigation
agency who has been requested to investigate the matter and give its findings to
the parties herein; the findings of the investing authority shall be the basis of the
determining whether or not the AGENCY is liable for such loss or destruction,
unless either party disagrees with the findings in which case the matter will have
to be brought to the court for proper disposition;
h. The CLIENT fully cooperated in the investigation of the loss or destruction of its
property and did not withhold any information or records pertinent thereto or
restrain any of its employees from testifying therein;

7. In consideration of the security services rendered, the CLIENT shall pay to the
AGENCY during the period of this contract the amount of TWENTY-FIVE
THOUSAND PESOS (P 25,000.00) per regular for TWELVE (12) Hours of daily
duty, also the 31st of the month and the Holidays must be paid by the client.
Payment shall be on a semi-monthly basis 15/30 payment except if it falls on
Sundays and Holidays and made immediately after presentation of a Statement of
Account by the AGENCY. Under no circumstances, the CLIENT shall not pay
said amount directly to the security guard/s.
 8. The AGENCY shall exercise effective control and supervision over the
performance of the guards. Any misdemeanor or negligent act committed by a
security guard on duty shall be immediately reported to the AGENCY. Disciplinary
actions shall be imposed against the erring security guard/s only by the AGENCY.
Only the head of the Peace & Order Committee can pre-terminate the services of
the AGENCY.

9. The security guard/s shall not be utilized by the CLIENT for any purpose, other
than to secure the premises of the CLIENT, unless on unpredicted instances or
emergency calls.

10. The AGENCY shall render to the clients’ written reports of unusual incidents and
losses and destruction of property.

11. “Termination. The CLIENT may, at any time, terminate this contract without
providing any reason by providing one (1) month advance notice to the AGENCY
in writing. The CLIENT may terminate this contract without any penalty, and the
AGENCY shall free, relieve and absolve the CLIENT from all its contractual
obligations.”

This CONTRACT will take effect for One (1) Year beginning February 01, 2022 and
will expire on February 01, 2023 it shall be renewed annually if agreement of the party
decides not to renew this contract; it shall inform the other in writing of said intention
within thirty (30) days before the expiration date. Should there is no information in
writing, this contract shall be deemed renewed for the same months/and the succeeding
year. Pre-termination to apply if the CLIENT found not satisfied with the performance
of the AGENCY, but to inform thru written notice 30 days before the affectivity.
