OCCUPATIONAL SAFETY AND HEALTH IN THE PHILIPPINES

Background Information for Learners:


OSH  OSH legislations and enforcement are key components of the government
Legislations program to protect workers from work accidents and illnesses.

Philippine  Article XIII Section 3 of Phil. Constitution


Constitution  The state shall afford full protection to labor ... They shall be entitled to
security of tenure, humane conditions of work, and a living wage.
P.D. 442 The Labor Code of the Philippines, revising and consolidating labor and social
laws to afford protection to labor, promote employment and human resources
development and insure industrial peace based on social justice.

P.D. 626  The State shall promote and develop a tax-exempt employees'
compensation program whereby employees and their dependents, in the
event of work-connected disability or death, may promptly secure adequate
income benefit, and medical or related benefits.
Presidential  Code on Sanitation
Decree 856  To prescribe sanitation requirements for food establishments and refuse
collections and disposal system of cities and municipalities.
RA 11036  The Mental Health Act requires employers to develop appropriate policies
and programs on mental health in the workplace designed to, among
others, raise awareness on mental health issues, correct the stigma and
discrimination associated with mental health conditions, identify and
provide support for individuals at risk and facilitate access of individuals
with mental health conditions to treatment and psychosocial support.
RA 11166  The Philippine HIV and AIDS Policy Act also prohibits the rejection of job
application, termination of employment, or other discriminatory policies in
hiring, provision of employment and other related benefits, promotion or
assignment of an individual solely or partially on the basis of actual,
perceived or suspected HIV status
RA 9165  An act instituting the Comprehensive Dangerous Drugs Act of 2002
repealing Republic Act No 6425, otherwise known as the Dangerous Drugs
Act of 1972, as amended, providing funds therefore, and for other
purposes.
RA 7877  The Anti-Sexual Harassment Act prohibits sexual harassment in the
workplace.
RA 6969  “Toxic Substances and Hazardous and Nuclear Wastes Control Act of 1990”
 Under this act importation, manufacture, processing, handling, storage,
transportation, sale, distribution, use and disposal of all unregulated
chemical substances and mixtures in the Philippines, are regulated.

RA 9003  The Ecological Solid Waste Management Act of 2000, provides the
necessary policy framework, institutional mechanisms and mandate to the
local government unites (LGUs) to achieve 25% waste reduction through
establishing an integrated solid waste management plans based on 3Rs
(reduce, reuse and recycling).
RA 9275  “Philippine Clean Water Act of 2004”
 An Act providing for a comprehensive water quality management and for
other purposes. This Act provides for the abatement and control of
pollution from land based sources, and lays down water quality standards
and regulations.
RA 8749  "Philippine Clean Air Act of 1999”
 The Philippine Clean Air Act is a comprehensive air quality management
policy and program, which aims to achieve and maintain healthy air for all
Filipinos.
RA 11058  “An Act Strengthening Compliance with Occupational Safety and Health
Standards and Providing Penalties for Violations Thereof’ was signed into
law on 17 August 2018.

Standards
