AGREEMENT FOR SALE

THIS AGREEMENT executed at Mumbai on this _______ day of _______ in the


year Two Thousand seven, BETWEEN SHRI SHANKARRAO PARVARRAO
DAMALE, aged about 66 years, adult, Indian Inhabitant of Mumbai, residing at Room/Hut
No. FSMCEN-95-D.A.6, Dabholkar Adda, Jijamata Nagar, Kalachowki, Mumbai – 400 033,
the Owner, hereinafter referred to as “THE TRANSFEROR” (which expression shall,
unless it be repugnant to the contest or meaning thereof, be deem to include his heirs,
executors and administrators) of the FIRST PART AND MRS. LEELABAI SHYAMRAO
KADAM, aged about 64 years, an adult, Indian Inhabitant of Mumbai, hereinafter referred to
as “THE TRANSFEREE” ( which expression shall, unless it be repugnant to the context
thereof, be deemed to include his heirs, executors, assigns, administrators and assigns ) of the
SECOND PART.

AND WHEREAS the party of the First Part is in use, occupation and lawful
possession of the abovesaid Room/Hut No.FSMCEN-95-D.A.6, Dabholkar Adda, Jijamata
Nagar, Kalachowki, Mumbai- 400 033 (hereinafter called the said “Room/Hut”)

AND WHEREAS the Party of the First Part have been vendor is the legal and lawful
owner respect of a The Said Room Premises, and holding Photo Pass No:-
FSMCEN95DA73 and also holding the Identity Card issued by the Municipal Corporation
for Greater Mumbai- Vide No- FSMCEN95DA73, Application No- 1709889 and any other
necessary document proof respect of the Said Room Premises.

AND WHEREAS the vendor has offered The Said Room Premises for sale and the
Purchaser has agreed to Purchase the same, both the parties hereto are desirous of reducing
and recording the time condition of this agreement in writing.

NOW THERFORE THIS INDENTURE HERBY WITHNESSETH THE TERMSAND


CONDITIONS AGREED TO BY AND BETWEEN THR PARTIES HERETO AS
UNDER:-

1. The Vendor has hereby sold and the Purchaser has hereby purchased The Said Room
Premises for a total consideration of Rs.1,50,000/- (Rupees One Lakh and Fifty Thousand
Only) which amount the Purchaser has paid to the Vendor in cash on or before the Execution
of the agreement of which the Vendor both hereunder admit and acknowledge receipt in full
and final settlement.

2. The Vendor hereby relinquishes all his right, titles, claims, and interests in respect if
The Said Room Premises in favor of the purchaser, irrevocably and declares that he has full
rights and power to part with the possession, give away sell The Said Room Premises in the
manner stipulated hereinabove.

3. The Vendor declares and confirms that the said room premises I free from loan,
Debts, demands, charges and encumbrance till the time of execution of this agreement And
that she shall be solely and absolutely responsible for waiving any claim and objection by
any one at her own cost and expenses to the entire satisfaction of the purchaser.
4. The Vendor hereby declares and confirms that she has no objection of whatsoever
Nature if The Said Room Premises be transferred on the name of the purchaser in the books
and Record of the Chawl Committee / Municipals Corporation of GreaterMumbai / Collector
of Mumbai / Tahasildar (Ench.) and / or other concerned authorities for all purpose.

5. The Vendor hereby assures and promises to execute sign and discharge any
document, application, forms, Etc. required for the purpose of transfer of The Said Room
Premises on the name of the purchaser as and when so desired by the purchaser and at the
cost and expenses of the purchaser only.

6. The Vendor hereby declares that he has No Objection of whatsoever nature if the
Purchaser shall use the said room for any purpose as per his choice and requirement in
Conformity with the rules and regulation of collector / Tahasildar / Municipal Corporation
For Gr.Mumbai / BEST Undertaking / Rationing Authority and / Co- op Housing Society or
other concerned authorities

7. The Vendor has hereby handed over the original documents in respect of The Said
Room to the purchaser for her future reference and record.

8. The Vendor hereby declares that The Said Room Premises is free form all encumbrances
and She has not created any third party interest in respect thereof in favor of any one prior to
the execution of the agreement.

9. The Vendor hereby admits and confirms the execution of this agreement out of her free
will, clear mind and without duress from any sourced in whatsoever manner and this is final
and irrevocable.

amount in respect of a Room Premises admeasuring 24’ x 09 x 14’ sq.ft. consisting Ground
Plus upper floor Situated at Dhabolakar Adda, Jijamata Nagar, Kalachowaki, Mumbai- 400
033.

I, SHRI SHANKARRAO PARVATRAO DHAMALE, aged about 66 Years, adult, Indian


Inhabitant of Mumbai. presently residing at Room/Hut No. FSMCEN-95-D.A.6, Dhabolkar
Adda, Jijamata Nagar, Kalachowki, Mumbai- 400 033, do hereby severely State on Solemm
affirmation as under:-

1) I say that I am the legal and surviving heirs of SMT. LEELABAI


SHYAMRAO KADAM, Who is the original owner of Room Premises suited at
Dhabholkar Adda, Jijamata Nagar, Mumbai- 400 033, usring at about 24’ x 09 x 14’ sq.ft.
consisting Ground Plus upper floor and I am Legal Nominee mention in the Photopass issued
by the Muncipal Corporation for Gr. Mumbai in said Room.

2. I say that have No Objection to transfer/sell Said Room from the name of the SMT.
LEELABAI SHYAMRAO KADAM to the name of SHRI SHANKARRAO
PARVATRAO DHAMALE to execute the Affidavit, Power of attorney dated day of
March, 2007, I have No objection of whatsoever nature, also accord the consent for said
transferred / Sell.

3. I say that I making this No Objection Certificate to produce collector / Tahasildar


/ Municipal Corporation For Gr. Mumbai / B.E.S.T. undtaking / Rationing Authority and /
Co- op Housing Society or other concerned authorities.

Whatever is stated hereinabove by me is true and correct to the Best of my


Knowledge, information and belief.

AFFIDAVIT

I, SMT. LEELABAI SHYAMRAO KADAM, an adult, Indian Inhabitant of


Mumbai, Presently Residing at Dhabolkar Adda, Jijamata Nagar, Kalachowki, Mumbai –
400 033, do hereby declare on solemn affirmation as under:-

1. I say that I am legally and lawfully seized and possessed of and entitled to a Room
Premises admeasuring about 24x9x14 sq.ft. consisting Ground Plus upper floor of Dhabolkar
Adda, Jijamata Nagar, Kalachoki, Mumbai-400 033, and holding Photo Pass No:-
FSMCEN95DA6, and also Holding the Identity Card issued by the Municipal Corporation
for Greater Mumbai- Vide No-FSMCEN95DA6 and enjoying all the right, title, claim and
interest in respect of the Side Room.

2. I further say that now I have assigned the said room to SHRI SHANKARRAO
PARVATRAO DHAMALE, an adult , Indian, inhabitant of Mumbai, irrevocably and I
have handed her the vacant and actual possession of the Said Room on the date of execution
of this affidavit, by removing myself, my family member and belongings from the Said
Room. I said that received the cost of repairs and maintenance plus royalty of the Said Room
from her in full and final settlement.

3. I say that I have relinquished and surrendered all my right, title, claim and interest
in respect of the Said Room in favor SHRI SHANKARRAO PARVATRAO DHAMALE,
irrevocably and I have no objection Whatsoever if the Said Room be transferred on SHRI
SHANKARRAO PARVATRAO DHAMALE name in the books and records of the
Brihanmumbai Mahanagarpalika / World Bank Project / Govt. of Maharashtra / Collector of
Mumbai and / Co- op Housing Society Or Other concerned authorities, for all purposes, from
that of my name.

4. I say that I have no objection whatsoever if the Electricity connection of said room
Be installed/ transferred on the name of the said purchaser i.e. SHRI SHANKARRAO
PARVATRAO DHAMALE in the books and record of BEST Undertaking.

5. I say that I have no objection whatsoever if the Rationing Card office issued the New
Ration card on the name of the said purchaser SHRI SHANKARRAO PARVATRAO
DHAMALE in the book and records of Rationing Office.

6. I say that the said room free from lone, debts, demand, charges and encumbrances till
the time of execution of this affidavit and that I have full right, title and power to assign / sell
the Said Room in favor of SHRI SHANKARRAO PARVATRAO DHAMALE , as per my
affirmation herein.

7. I further say that have obtained prior consent of my all family members for
assignment / sell of the Said room to SHRI SHANKARRAO PARVATRAO DHAMALE ,
and vouchsafe against any objection or hindrance from them in enjoyment of the Said Room
by herself and / or her nominee/s.
8. I say that all future levies, taxes, rents, charges, cases etc. relevant to the Said Room
be received from SHRI SHANKARRAO PARVATRAO DHAMALE and appropriate
Receipts for payments in respect thereof be issued in her named.

9. I hereby indemnify and small always keep indemnified all the officers and employees
of Brihanmumbai Mahanagarpalika / Govt. of Maharastra / Collector and / or other
concerned authorities, against all losses, damages, action if any, resulting from the transfer of
the Said Room on the name of SHRI SHANKARRAO PARVATRAO DHAMALE from
that of my name.

Whatsoever stated hereinabove is true and correct to the best of my information, knowledge
and belief.

received consideration amount and / or repairing cost of Said Room Premises from her and I
Have no rights, title, interest and claim in the said room premises in this ____day of March

SUFFICENTLY ENTITLED TO ALL THAT Room Premises bearing at Dhabolkar Adda,
Jijamata Nagar, Kalachowki, Mumbai- 400 033, admeasuring about 24x9x14 Sq.Ft.
consisting Ground Plus upper floor hereinafter referred to as “SAID ROOM” and the Said
Room Consisting ground Plus Upper Floor which is in my exclusive use , occupation and
possession as Occupant / Tent / possessor since long and hence I have staying therein along
with my family members.

AND WHEREAS the concerned authorities have transferred / installed Electricity


Meter of the Said Room.

AND WHEREAS the above said records are stands in my name at the address of The
Said Room and hence the I have been rights, title, and interest in respect of the Said Room
and enjoy its all right title and interest in all respect in all thus except myself no any other
person have any right therein and I hold all relevant documents thereof.

Now by virtue of my possessing the exclusive possession of the said Room Premises
but due to my certain personal constraints difficulties, I have transferred / assigned / sell the
Said room to SHRI SHANKARRAO PARVATRAO DHAMALE by executing an
affidavit and Sale Agreement hence it is not feasible for me to look after and manage all the
affairs of the said room premises hereinafter and as I do hereby irrevocable nominate,
constitute and appoint SMT. LEELABAI SHYAMRAO KADAM, aged about 58 Years,
Indian Inhabitant of Mumbai. To be my lawful Attorney to act for me and on my behalf to do
execute and performed all or any of the following acts, deeds and things pirating to Said
Room Premises. I should confer all my rights, interests, and title concerning and related to
The Said Room on her name and favor.

1. To mange the affairs of The Said Room Premises bearing Dhabolkar Adda, Jijamata
Nagar, kalachowki Mumbai- 400 033 admeasuring about 24’ x 09 x 14’ Sq.Ft. consisting
Ground Plus upper floor and to transfer, sale, Mortgage, Gift and dispose of the Said Room
premises to any manner for which I dispose of the Said Room Premises to any manner for
Which I Possess and own as occupant and possessor of The Said Room Premises.

2. To use occupy and posses The Said Room Premises and to mange and look after the
affairs of the same.
3. To pay the necessary rent, charges, etc. to the authorities concerned in my name, for
me and on my behalf and receive the valid receipt on her name.

4. To sell transfer, dispose of the aforesaid said premises to any other person to
whomsoever my said attorney may fit and proper.

5. To represent me before all concerned authorities for transferring The Said Premises
and each and ever documents in the name of the may attorney and to sign on my behalf in my
name for me to that respect.

6. To carry on correspondence with the Govt. and / or Semi Government authorities


including B.M.C. collector, Tahasildar, BEST Undertaking Rationing Authority, SRA
authority, MMRDA , World Bank Project ar any other competent authorities and to make
the necessary application affidavit, declaration, petitions etc., and to submit the same before
such authorities,

7. To ask, demand use recover and give effectual receipt and discharge dues and out
standing in respect of said premises as referred to above.

8. To make , sing and verify all allocations on my behalf required to be submitted to


chawl, Muncipal Authorities, Govt. or Semi Government Authorities and other authorities
and housing Society proposed and to be formed in future and to avail it’s membership by her
in connection with my Said Room referred to herein.

9. To accept on my behalf receipts, notice, documents and proceedings from any


persons, authorities, courts, Municipalities, Govt., and semi Government authorities and
submit / send replies and attend to these office and officers wherever and wherever necessary
to do in the opinion of my said attorney.

10. To appear for and represent me before the Collector, Sub Divisional Officer,
Thasildar, Municipal Commissioner and all Government and Semi Government Officer in all
matters and things concerned to above Said Room Premises.

11. The power which are vested in the said attorney is empowered to appear for and
represent me in all courts, Civil, Criminal Revenue, Tribunal, Original Revisional or
Appellate, in any Registration office to sign, execute, verify and file Plaints, Written
Statement and Petitions and also to present appeals in any court and to accept service of all
summons, notice and their processes.

12. To appoint, engage on my behalf pleaders, Advocate or Solicitors, whenever my


said attorney think proper to do so and to discharge and / or terminate their appointments as
per the total discretions of my said lawful attorney and to appoint one or more substitute, if
my said attorney deem, fit and proper with limited powers or the same powers hereinabove
and to remove them at his pleasure.

13. To compromise, compound, withdraw cases or be non suited to refer to arbitration


all disputes and differences.

14. To sign verify and file application for execution of decrees or orders of any
courts.
15. To appear before the appropriate authorities and to lodge all the necessary
documents in respect of the said premises and admit execution thereof before such
authorities.

16. To complete the formalities to get the Said Premises transferred on her name in
the books and records of the Brihanmumbai Mahnagarpalika / Government of Maharashtra /
Collectrorate / Tehshildar / World Bank Project and or other concerned authorities as and
when she so desires. Likewise to apply to the concerned authorities and secure photopass in
respect of the said premises in her own name.

17. To enter into agreement with the Developer and obtain and taken paossession of
permanent and alternative accommodation in lieu of the Said Room under slum clearance
Act and any scheme government or private without any further confirmation or writing from
me.

18. To receive any award, order, compensation or judgment from any competent
authority, court of Law in respect of the Said Room Premises.

19. To Pay all charges, levies, taxes, rent, rates, assessment, ceases, compensation if
any in respect or the Said Room Premises to the concerned authorities and received valid
receipts therefore.

20. To receive any alternative premises in exchange of the Said Room Premises if and
when offered by the authorities concerned, in case the Said Room Premises is taken over any
purposes by the Brihanmumbai Mahnagarpalika / Government of Maharashtra / Government
of India / Collectorate / Tahashildar / World Bank Project and or any other competent
concerned authority as the case may be.

21. And I hereby agree and declare that this Power of Attorney and all power
conferred herein to the said attorney and/or substitutes shall be irrevocable for all times.

AND GENRALLY to do all other lawful and necessary acts, deeds, things and matters
pertaining to The said Room Premises bearing Dhabolkar Adda, Jijamata Nagar, Mumbai-
400 033, admeasuring about 24’ x 09 x 14’ Sq.Ft. consisting Ground Plus upper floor
whether specifically hereinabove or not in the manner as I could in my name and all the acts,
done by my said attorney by virtue of these presents shall remain binding upon me. I shall
ratify and confirm the same acts, deeds, things and matters done in good faith by my said
attorney by virtue of these presents.

SCHEDULE OF PROPERTY REFERED TO AS UNDER

The Said Room Premises referred hereinabove for transfer/sell hearing at Dhabolkar
Adda, Jijamata Nagar, Mumbai – 400 033, within the Jurisdiction of “F” ward (south),
Municipal corporation for Grater Mumbai. The Said Room Consisting Ground Plus Upper
Floor.
