DEED OF GIFT

THIS DEED OF GIFT is made at Mumbai on this 23rd day of


November,2022 BETWEEN MR.AKHTAR ALI VALI
MOHAMMED MANIHAR of Mumbai Indian Inhabitant presently
residing at B-201, Sangi Tower A B CHS, pleasant Park, Mira-
Bhayandar Road, Mira Road, Thane -401107; hereinafter referred to
as `THE DONOR’ (which expression unless it be repugnant to the
context or meaning thereof shall deem to mean and include her
heirs, executors and administrators) of the ONE PART;

MRS. JANNUTUNNISHA AKHTAR ALI MANIHAR of Mumbai


Indian Inhabitant presently residing at B-201, Sangi Tower A B
CHS, pleasant Park, Mira-Bhayandar Road, Mira Road, Thane -
401107;hereinafter referred to as `THE DONEE’ (which expression
unless it be repugnant to the context or meaning thereof shall deem
to mean and include his heirs, executors, administrators and assigns)
of the OTHER PART;

WHEREAS
(A) By and under Agreement dated 27th day of April, 2018 the Donor
here in purchased from partnership firm M/S Admire Revive Builder &
Developer , a Flat being situated on 3rd Floor, bearing No.302 in wing
A, admeasuring 54.85 Sq.Mtrs.Carpet Area, in the building known s
‘Royal Greens’ on the plot of land or ground hereditaments and
premises bering survey no.148, hissa no.5, corresponding to CTS No.
1349 (PART), 1349/1 to 14, admeasuring 669.7 sq mtrs , Village
Marol, Talika Andheri, Mumbai suburban district lying being
situiated at Village Marol, Andheri East, Mumbai, 400059
(hereinafter referred to as `the said Flat) and the said Agreement is
registered under Serial No. BDR-15/2187 of 2018 on 27/04/2018 and
the description of the said Flat is more particularly described in the
Schedule hereunder written. The Donor herein purchased the said
Flat for the said Flat paid to the said erstwhile owner and in
payment of Stamp Duty and Registration Charges. Accordingly, the

Donor herein has 100% share in the said Flat under the said
Agreement.
(B) The Donor is Husband of the Donee.
(C) The Donor desires to grant her 50% share out of 100% Share of the
said Flat to the Donee as Gift in consideration of natural love and
affection as hereinafter mentioned.
(D) The Donee has agreed to accept the said Gift as is evidenced by her
executing these presents.
NOW THIS DEED OF GIFT WITNESSETH that the Donor, in consideration
of natural love and affection which the Donor bears to the Donee doth hereby
grant and transfer by way of Gift the 50% share of a Flat being situated on 3rd
Floor, bearing No.302 in wing A, admeasuring 54.85 Sq.Mtrs.Carpet Area, in
the building known as ‘Royal Greens’ on the plot of land or ground
hereditaments and premises bering survey no.148, hissa no.5, corresponding
to CTS No. 1349 (PART), 1349/1 to 14, admeasuring 669.7 sq mtrs , Village
Marol, Talika Andheri, Mumbai suburban district lying being situiated at
Village Marol, Andheri East, Mumbai, 400059 and more particularly
described in the Schedule hereunder written. with all the liberties, privileges,
easement and advantages appurtenant thereto and all the estate, right, title,
interest, use, inheritance, possession, benefit, claims and demand whatsoever
of the Donor To Have And To Hold the same unto and to the use of the
Donee absolutely but subject to the payment of all taxes, rates, assessments,
dues and duties now and hereafter chargeable thereon by the said Society of
the said building and to the Government or Municipality or other Local
Authorities.
AND the Donor doth hereby covenants with the Donee.
(a) That the Donor now has in herself, good right, full power and absolute
authority to grant her 50% share out of 100% share in the said Flat hereby
granted as gift in the manner aforesaid.
(b) The Donee may at all times hereafter peaceably and quietly upon have
occupy, possess and enjoy the 50% share in the said Flat and shall receive
the rents, issues and profits and rents thereof and every part thereof to
and for his own use and benefit without any suit, lawful eviction,
interruption, claim or demand whatsoever from or by the Donor or her

heirs, executors, administrators and assigns or any person or persons
lawfully claiming or to claim by, from, under or in trust for the Donor.
(c) That the said Flat is free and clear and 50 % of the Said Flat is freely and
Clearly and absolutely and forever released and discharged or otherwise
by the Donor and well and sufficiently saved, kept harmless and
indemnified of and from and against all former and other estate, titles,
charges and encumbrances whatsoever, had made, executed, occasioned
or suffered by the Donor or by any other person or persons lawfully
claiming or to claim by, from, under or in trust for the Donor.
(d) AND FURTHER that the Donor and all persons having or lawfully
claiming any estate or interest whatsoever to the said Flat from under or
in trust for the Donor or her heirs, executors, administrators and assigns
shall and will from time to time and at all times hereafter at the request
and cost of the Donee do and execute or cause to be done and executed all
such further and other acts, deeds, things, conveyances and assurances in
law whatsoever for better and more perfectly assuring the 50% share in
the said Flat and every part thereof unto and to the use of the Donee in
the manner aforesaid as by the Donee, his heirs, executors, administrators
and assigns or counsel in law shall be reasonably required.
AND HE the Donor hereby record that the possession of the said
Flat shall remain with the Donor and the Donee equally that both the parties
agrees to pay from the date hereof all the maintenance charges and other
outgoings in respect of the said Flat equally.
THE DONEE has accepted the said Gift and in acceptance thereof
have put their hands and has executed this Deed of Gift AND THIS DEED
FURTHER WITNESSETH that the Donee shall now be entitled to become the
Member of the said ‘Royal Greens’ in as much as she being now the 50%
owner of the said Flat and the Donor and Donee shall execute such papers,
forms, letters etc. as may be required to be submitted to the said Society to
enter the name of the Donee as co-owner in the Shares and also apply for co-
membership of the Society.
IN WITNESS WHEREOF the Donor as well as the Donee (by way of
acceptance of the said Gift) have put their respective hands the day and year
first hereinabove written.
