4159-HIII(5)-2016/1403 DATED 21/01/2016 TO THE HEIRS IN CLASS I AND
ENTRY/CATEGORY I OF CLASS II AS PER SHEDULE ATTACHED TO THE
HINDU SUCCESSION ACT 1956) IN RESPECT OF 100% SHARE OF FREE HOLD
RESIDENTIAL FLAT NO. 3103, CATEGORY B, FIRST FLOOR, BUILT UPON THE
LAND ALLOTTED TO THE PINK ROSE COOPERATIVE HOUSE BUILDING

This Transfer Deed is made at Chandigarh, on this………………….day of


…………..2020 between.

1. Sh. Lal Singh son of Sh. Modan Singh resident of Patti Dhillon, Village
Takhanwad, Near Sr School, Moga, Punjab (hereinafter referred to as
Transferor, which term shall where the context so admits include his heirs,
assignees, executors, legal representatives and administrations) of the one part
of this deed:

2. Smt. Kanwaljit Kaur Dhillon daughter of Sh. Lal Singh resident of Flat no
3103, Pink Rose Society, Sector 49D, Chandigarh (hereinafter referred to as
the Transferee, which term shall where the context so admits includes his heirs,
assignees, executors, legal representatives and administrators) of the other part
of this deed:

And whereas Smt. Manjit Kaur w/o Harnaib Singh was original allottee of Flat No.
3103, 1st Floor, Category B allotted vide allotment Letter No. PRS-139 Dt 24.11.2011
having covered area 1074.18 Sq. Feet i.e. 119.353 Sq. Yards who sold her flat to Dr.
Kanwal Jit Kaur Dhillon w/o Dr. Tara Singh Sandhu. The said flat was transferred to
Sh. Lal Singh S/o Sh Modan Singh, by the society on the basis of GPA vide transfer
letter No: PRS/564 Dated 25.04.2012 and Sub Conveyance Deed has been
registered in favour of Sh Lal Singh S/o Sh Modan Singh with Sub Registrar, U.T.,
Chandigarh at Sr no 7714 Book No 1 Volumn no 280 Page no 152 Dated
06.11.2019. Now, Additional Registrar, Cooperative Societies, U.T., Chandigarh has
issued permission for family Transfer from Sh. Lal Singh S/o Sh. Modan Singh to
Smt. Kanwaljit Kaur Dhillon daughter of Sh. Lal Singh (from Father to Daughter) vide
Memo No: Coop/HB-77-3103/2020/2278 Dated 28.02.2020 and the
Allottee/transferee Members has paid to the Society the total cost of the Dwelling
Unit including the charges/fee, and now the above said Transferor is the absolute
owner with full proprietary rights on freehold basis and the Transferor has agreed to
transfer his/her 100% share in favor of the Transferee.
AND WHEREAS the Society had executed the Conveyance Deed in respect of
the entire land which was duly registered in the office of Sub-Registrar, U.T.,
Chandigarh vide Sr. No. 6735, Bock No.1, dated 29-01-2019.

AND WHEREAS the site underneath is fully paid-up, and its Sub-Conveyance
Deed had already been executed and registered between The Pink Rose
Cooperative House Building (First) Society Ltd., Sector 49-D, Chandigarh &
transferee member at Sr no 7714 Book No 1 Volumn no 280 Page no 152 Dated
06.11.2019 in the office of Sub-Registrar, UT, Chandigarh.
AND WHEREAS the above said property with plot underneath is free all sorts of
encumbrances i.e. sale, gift, claims, demands, charges, lien, attachment, resumption,
mortgage and litigation etc. till to-date.

AND WHEREAS the Transferee is the real daughter of the Transferor, a relative
of Category I/II as per the Schedule attached to The Hindu Succession Act, 1956.

AND WHEREAS the Transferee being the real daughter of the Transferor, the
Transferor has great love and affection for the Transferee and out of this love and
affection, the said Transferor has decided to transfer her residential Flat no 3103,
Category B, First Floor of The Pink Rose Cooperative House Building (First) Society
Ltd., Sector 49-D, Chandigarh in favor of the said Transferee along with its fittings,
fixtures, securities, and electricity meters, parking space and the said Transferee has
also accepted transfer of the aforesaid property from the said Transferor.

NOW, THEREFORE, this transfer deed further witnesses that in consideration of


love and affection the said Transferor has for the Transferee, the Transferor do
hereby Transfers, Conveys and Assigns, all his/her rights, titles, interest, in the said
property i.e. residential Flat No. 3103, Category B, First Floor of The Pink Rose
Cooperative House Building (First) Society Ltd., Sector 49-D, Chandigarh along with
all his/her/their rights, titles, interest, easements, appurtenances IN FAVOUR OF
THE SAID TRANSFEREE, FOR ALL TIMES TO COME ABSOLUTELY AND FOR
EVER TO HAVE AND TO HOLD BY THE SAID TRANSFEREE SUBJECT TO THE
TERMS AND CONDITIONS OF ALLOTMENT LETTER ANS CONVEYANCE DEED
AND THE TRANSFEREE HAS AGREED TO ACCEPT THE SAID PROPERTY.

AND WHEREAS the said Transferor and Transferee have further agreed with
each other on the following terms and conditions:-

Now this deed further witnesses as under:-


1. That the said Transferor has delivered the actual, vacant and physical possession
of the said property, under transfer, to the said Transferee.
2. That the said Transferor has also delivered to the said Transferee, original
documents of titles, of the said property, under transfer, for his records and ready
reference.
3. That the said Transferee shall hereinafter peacefully hold, use and enjoy the said
property as his own property, without any hesitation, hindrances, interruption,
claims, demands, whatsoever by or from the said Transferor or any other person
or person whomsoever through him.
4. That all expenses on execution and registration of this transfer deed i.e.
registration charges have been borne by the said transferee.
5. That the said Transferor have also handed over to the said Transferee,
possession of fittings and fixtures, electricity meters and the securities attached
there to.
6. That the said Transferor hereby agrees and undertakes to execute and sign all
such papers and documents regarding the transfer of ownership of the said
property only (if such necessity arises at any later stage), on the request and cost
of the said Transferee, without any hesitation, demand and delay.
7. That the said Transferor shall pay if anything is found due to the Government,
against the said property till to-date i.e. prior dues, arrears etc., if any, unto the
date of execution of this transfer deed.
8. That the transferor has further assured the Transferee that the said property is not
subject to any kinds of previous agreement/contract of sale/transfer with anybody
else till to date and if any such things shall be found later then that shall be
exclusively the liability of the said transferor, and that shall no effect, in any
manner, on the transfer of rights in the name of present Transferee, in respect of
the said property.
9. That the above said Transferor has transferred the said Property in favour of the
transferee voluntarily, without any consideration, influence or undue pressure of
anybody else, with his/her full senses and sound mind. The transferor has
transferred the said property in favour of transferee out of love and affection.
10. That the said transferee has now become the absolute owner of the said property
i.e. residential Flat no 3103 Category B, First Floor, allotted by the Pink Rose
Cooperative House Building (First) Society Ltd., Sector-49-D, Chandigarh vide
Allotment Letter No. PRS-139 Dt 24.11.2011 and transferred vide society Letter
No. 564 Dt 25.4.2012 the site /land there under, under transfer, in full proprietary
rights, and the said transferee is entitled to apply to the Society/RCS/CHB/Estate
Officer U.T. Chandigarh, and get the ownership of the said property transferred in
his (Transferee) name, in the records of the Society/RCS/CHB/Estate Officer U.T.
Chandigarh .
11. That the transferee member shall be bound by the terms and conditions
contained in the Land Allotment Letter dated 24.01.2002 of the Society issued by
Chandigarh Housing Board & Conveyance Deed executed on 29.01.2019
between the President of India through the Chandigarh Housing Board, U.T.
Chandigarh, Flat Allotment Letter No. PRS-139 Dt 24.11.2011 Sub Conveyance
Deed Executed on 06.11.2019 and the Society registered vide Registration No
392, dated 31-03-1983 (Old Number) and new Registration No. 678, dated
18.05.2004 vide orders of Registrar, Cooperative Societies U.T. Chandigarh
issued vide endst. No. 1810, dated 18-05-2004 under the Punjab Cooperative
Societies Act 1961 as applicable to the Union Territory, Chandigarh.
12. That the transferee member beside discharging all obligations to the Society
under the Punjab Cooperative Societies Act 1961 and the rules framed there
under its bye-laws shall in all respects comply with and be bound by the Punjab
Capital Development and Regulation Building Rules, 1952 as amended from time
to time and the rules made there under.
13. The transferee enjoy the right of possession and enjoyment so long as it pays all
the dues in respect of the site to the Chandigarh Housing Board/Society and so
long as it abides by the terms and conditions of allotment of the Dwelling Unit/flat
and parking space vide Society’s Allotment/Transfer Letter No. PRS/564, Dated
25.04.2012 and the provisions of Capital of Punjab (Development and Regulation)
Act, 1952 and made there under as amended from time to time.
14. The Society shall have full right powers and authority at all times to do through
officers, servants all acts and things which may be necessary or expedient for the
purpose of enforcing compliance with all or any of the terms and conditions and
reservation herein contained and to recover from the transferee member as a first
charge upon the said site the cost of doing all or any such acts and things and all
costs incurred in connection therewith or in any way relating thereto.
15. That the said property has been transferred in accordance with the provision of
Capital of Punjab (Development & Regulation) Act, 1952, and the rules framed
there under from time to time.
16. That permission to execute the transfer deed has been granted by Additional
Registrar of Cooperative Societies, Chandigarh vide letter/Memo No. Coop/HB-
77-3103/2020/2278, dated 28.02.2020, copy letter enclosed herewith.
17. That the transferee shall be bound to pay all recovery of dues, if any found
recoverable at any later stage on account of any discrepancies, error, omissions,
audit adjustment including enhancement of cost of land/construction, occupation
certificate or due to any court case or unavoidable reasons the
society/Chandigarh Administration.
IN WITNESS WHEREOF both the parties have set their hands on this deed at
Chandigarh on the day, month and year first above written, in the presence of under
mentioned witnesses.
