DIRECTORATE OF PUBLIC PROSECUTIONS

The Directorate of Public Prosecutions is a semi-autonomous body under the administrative supervision of the Attorney General established in terms of Section 51 A of the
Constitution of the Republic of Botswana. The main function of the Directorate of Public Prosecutions is to provide the people with an independent and effective criminal
prosecution service that is both fair and just.

The office conducts criminal prosecutions in the Magistrates’ Courts and the High Court of Botswana as well as criminal appeals at the High Court and the Court of Appeal,
from all other courts. This comes out clearly from the provisions of Section 7 of the Criminal Procedure and evidence act, Laws of Botswana (CAP: 08:02) which sets out that
the DPP exists to institute and undertake criminal proceedings against any person, before any court, in respect of any offence alleged to have been committed by that person.
Additionally the Directorate of Public Prosecutions manages a range of other matters such as interlocutory applications as well as Inquests and mine accidents inquiries.

POWERS OF THE DIRECTOR OF PUBLIC PROSECUTIONS (DPP)


The powers vested on the DPP are set out in Section 51 A (3) of the Botswana Constitution. They are as follows:
- To institute and undertake prosecutions of criminal matter on behalf of the State;
- To take over and continue any such criminal proceedings that have been instituted or undertaken by any other person or authority;
- Discontinue at any stage before judgment is delivered, such criminal proceedings so instituted or undertaken by the Directorate of Public Prosecutions or any other per-
sons or authority.

The DPP has various other important functions under various laws, among others, under the Proceeds and Instruments of Crime Act, Corruption and Economic Crimes
Act, Mutual Legal Assistance Act, Children’s Act, Extradition Act and Prisons Act. It must be highlighted that in the exercise of his/her powers the Director of Public Pros-
ecutions is not subject to the direction or control of any person or authority in terms of Section 51 A (6) of the Botswana Constitution.

MODE OF OPERATION OF THE DIRECTORATE OF PUBLIC PROSECUTIONS


In performing its functions, the DPP strives to uphold the Rule of Law and adhere to principles of natural justice, including but not limited to:
-Affording all accused persons, a fair and effective prosecution within a reasonable time;
-Upholding the constitutionally enshrined principle of the presumption of innocence until proved guilty by a competent court of law;
-Availing accused persons with all necessary facilities to prepare their defence;
-Facilitating procurement and presentation of witness depositions before the Court during trial.

In carrying out his/her role and functions, the Director of Public Prosecutions is enjoined to uphold the Constitution of the Republic of Botswana and all applicable laws.

FUNCTIONS OF THE DPP IN RELATION TO THE POLICE AND OTHER LAW ENFORCEMENT AGENCIES
The primary general duties of the Police are to maintain law and order as well as prevention and detection of crime. Be that as it may, the Directorate of Public Prosecutions
bears the duty to give the Police and other investigating authorities legal advice in the discharge of both their statutory and administrative functions in criminal matters to
ensure that they efficiently conduct investigations in order to enhance the prospects of a quality prosecution and a fair and effective trial.

LEGISLATIVE DRAFTING DIVISION

DRAFT LEGISLATION
The core mandate of Legislative Drafting Division is to draft both Primary (Acts of Parliament) and Secondary Legislation (Statutory Instruments, Orders, Government
notices) on behalf of the Government.

PROVIDE LEGAL ADVICE


The division is mandated to offer legal advice on matters brought before it by the various Government ministries on the interpretation of the law. The division is best suit-
ed to carry out this mandate as their primary role is to draft all types of legislation on behalf of the government.

LAWS OF BOTSWANA
The Legislative Drafting Division produces the annual bound editions of the Botswana Statute Law and updates the publication of the Laws of Botswana in loose leaf
through Annual Law Revision Orders (LROs).

ATTEND PARLIAMENT
Legislative drafters have to be present in parliament when a Bill that they have drafted is being presented before parliament by the Minister. The role of a drafter in parlia-
ment is to give advice to the Minister on any legal issues that may arise concerning a Bill, they are also there to take note of any amendments that may come up during the
committee stage of reading of a Bill. A drafter has to be present in parliament until the Bill has been passed.

INTERNATIONAL & COMMERCIAL DIVISION

The ICD is mandated with the responsibility of providing legal advice on international and commercial matters in which the Government is a party or has an interest.
This includes the negotiation and drafting of international and commercial agreements. It is worth noting that in the case of ICD, the drafting function is limited to
drafting of international and commercial agreements which are signed by the Government and not legislative drafting which is meant for Parliament. In addition the
ICD only assists Government Ministries and Departments since the ICD is part of the office of the Attorney General who is the principal legal advisor to the Govern-
ment of the Republic of Botswana.

In order to effectively carry out this mandate, the ICD has seconded legal officers to all Government Ministries who in addition to carrying out this mandate, advise
Ministries on all legal matters and act as liaisons between the office of the Attorney General and the Ministry. In addition, there are two specialised units within ICD,
that is the International Law Unit and the International Trade Unit.

The International Law Unit deals with matters such as international human rights law, environmental law, diplomatic and international humanitarian law, the law of
the sea etc. The unit is also involved in State Party Report writing under various convention and treaties to which Botswana is a party. The International Trade Unit
deals specifically with International Trade Law issues relating to the World Trade Organisation (WTO), Southern African Development Community (SADC), South-
ern African Customs Union (SACU), Africa Caribbean Pacific (ACP), European Union (EU) etc.

INTERNATIONAL AGREEMENTS
With regard to international agreements, ICD provides legal advice to Government in the negotiation and drafting of multilateral and bilateral agreements under
the auspices of: the United Nations (UN) and its specialised organs, the African Union (AU), the World Trade Organisation (WTO), Southern African Development
Community (SADC), Southern African Customs Union (SACU), Africa Caribbean Pacific (ACP), European Union (EU) and those involving individual states. After
successful negotiations and Botswana decides to become party to an agreement the ICD is responsible for drafting the necessary instrument accepting to be party to
the agreement. In addition ICD will provide advice during the implementation of such agreements.

COMMERCIAL AGREEMENTS
The ICD also advises , negotiates and drafts for and on behalf of the Government Commercial Agreements relating to the procurement of goods, works and services,
performance bonds, guarantees and indemnities, financial agreements (loans) including subsidiary loan agreements, the issuance of bonds, stock and other securities,
intellectual property rights, shareholdings and partnerships, competition law issues, privatisation, etc.

CIVIL LITIGATION DIVISION

The Civil Litigation Division is responsible for the institution of all civil court actions by and on behalf of the Government and for the defence of all civil matters
brought against the Government or Government officers by members of the public and other organisations.

This mandate emanates from the State Proceedings (Civil Actions by or against Government or Public Officers) Act CAP: 10:01 of the Laws of Botswana which
authorises the Attorney General to represent the government or public officers in civil matters. Such representation may be before the Magistrate Courts, Industrial
Court, and High Court, Court of Appeal or any other fora such as in liquidations, arbitration and mediation.

ARBITRATION / MEDIATION
The division conducts a lot of arbitration cases which are referred to arbitration by virtue of the many agreements that the government enters into when doing busi-
ness. Most of the arbitrations the division deals with involve disputes over government construction projects and contracts for the supply of goods and services.

LEGAL ADVICE
Members of the division are also heavily engaged in providing legal advice to ministries and departments in a bid to avoid unnecessary litigation and to resolve dis-
putes expeditiously. Ministries and departments are thus encouraged to seek advice from the division before embarking on any exercise that may attract adverse legal
consequences.

WORKSHOPS / TRAINING
The division is also proactive in avoiding disputes by providing training to ministries and departments on guidelines for disciplinary proceedings and on the provision
of full instructions to the division in the event of disputes reaching the courts.

DEBT COLLECTION
The division serves as the agency for the collection of all debts owed to government of whatever nature. To this end the division also hosts a unit of deputy sheriffs who
are charged with the service of court process, the enforcement of court orders and the execution of writs.
