Zambezi Trans-frontier
Conservation Area (KAZA-TFCA)
will conduct the first ever Africa’s
coordinated elephant aerial survey
from August to October.
In an interview on the sidelines of
a week-long preparatory workshop
for a team of experts from the
KAZA partner states, Namibia’s
senior conservation planning
advisor with World Wildlife Fund
(WWF), Dr Russell Taylor, said
the survey would determine the
numbers and seasonal distributions
of elephants and other large
herbivores.
Dr Taylor said the survey,
which was a priority action from
the KAZA Strategic Planning
Framework for elections, was
developed following the 2019
Kasane Elephant Summit.
He said one of the objectives of
the framework was to conserve
and manage KAZA elephants as
one contiguous population across
the KAZA partner states, hence a
synchronised aerial survey was a
priority.
KAZA partner states are Angola,
Botswana, Namibia, Zambia and
Zimbabwe. He said the aerial
survey was an immediate priority
as its implementation was delayed
by COVID-19 restrictions.
Dr Taylor said while individual
countries conducted their own
surveys at different times it was
possible that some elephant were
missed or double counted as
they migrated across the KAZA
landscape and counting them
all at once would get the correct
estimated number.
“Knowing the KAZA
elephant population will inform
management decisions by partner
states and each country will
better manage its animals because
the survey will determine their
distributions. The survey Is
designed to cover all areas where
elephants are, including communal
land, forest land, protected areas,
national parks, game reserves and
safaris,” he said.
Dr Taylor added that during the
survey, all known elephant ranges
in KAZA would be sampled in
proportion to the amounts of
elephants, and intensive sampling
would be done for high density
areas while low density areas
would have less intensive sampling.
He said since elephant population
grew between four to five per cent
per annum, it was advisable not to
do the survey every year but at five
to seven yearly intervals.
“A good time for conducting
wildlife survey is during the
dry season as animals are found
concentrated at water sources
and as leaves have dropped, the
visibility is improved, unlike
during the wet season when the
vegetation is thick,” he said.
He also said in the upcoming
survey use of aircrafts, cameras
and other improved methods
would be used unlike in the past 10
years where 200 telemetry colours
were used on elephants across
the landscape to monitor their
movement.
He said the telemetry colour
survey was done to find out where
the elephants preferred to move
in order to establish longer term
corridors that were respected by
people and elephants.

as the management of KAZA
elephants require a certain level
of detail and understanding,” she

She added that the KAZA

successful co-existence of
people and wildlife and the
outcome of the survey would
assist in achieving such.

GABORONE - The recent
attack on Good Hope Police
Station which resulted in the
theft of guns and ammunition
should not be allowed to recur
because it compromised the
nation’s security.
In addition, it tarnished the
image of Botswana Police
Service (BPS), Minister of
Defence and Security, Mr Kagiso
Mmusi said Friday.
Speaking at the passing out
parade for 499 police constables
at Botswana Police College on
Friday, he however said the break-
in should embolden officers
to serve better. The minister
said issues of public safety and
security were critical for the
creation of an enabling climate
for socio-economic development.
He said current public security
challenges facing the country
included cash-in-transit heists,
rustling, cybercrime, drug
trafficking and Gender Based
Violence (GBV).
If not addressed, the challenges
would impact negatively on social
cohesion and peace, economic
growth and job creation as
well as bilateral relations with
neighbouring countries, said Mr
Mmusi.
The minister said it had
therefore become critical for BPS
to be resourced in order for the
organisation to execute its duties
effectively and ensure a safer
society.
To that end, 1 000 new
positions had been approved for
BPS during the current financial
year, Minister Mmusi said.
He said the 499 new constables
would be followed by a second
intake whose recruitment was at
an advanced stage.

MARRAKECH - Through
participation in the just-ended
US Africa Business Summit,
Botswana seized an opportunity
to widen the investment net with
potential US investors.
President Dr Mokgweetsi
Masisi said this in an interview
post the summit’s 14th edition
held in Morocco July 19-22.
The President, who led a six-
person strong cabinet delegation
to the summit, said Botswana
would derive benefits from
contacts made at the meet.
“America is a first world
country with a big economy and
this puts us in a good space as a
country to always get attracted to
them and hear what solutions they
can offer to widen our investment
paths and grow the economy,” he
said.
The President said US investors
presented a wide array of business
opportunities to be tapped
into while the summit offered
Botswana maximum exposure
and networking opportunities
through its country forum
sessions.
“I believe in competitiveness
and it is important for Batswana
to go all out when doing things,”
he said.
According to Dr Masisi, one
of the key takeaways from the
summit was that for Batswana to
increase exports, they needed to
keep abreast of other countries’
business regulatory frameworks.

and investing in Africa, the
President said it differed from
other business meetings he had
previously attended.
“The summit is also different

go and make it happen,” she said

She explained that its aim was

build stronger US-Africa trade,
investment and commercial ties,
particularly in a post-COVID-19

that allowed attendees to engage
on key US-Africa economic

Youth parliament
calls for immunity
for ex-presidents

GABORONE - The
constitution should assure a
sitting president of the state’s
protection from persecution and/
or prosecution once he/she has
vacated office.
Submitting the African Youth
Parliament’s proposals to the
Presidential Commission of
Inquiry into the Review of
the Constitution on Friday, its
representative Mr Baboloki
Semele said such protection
would ensure that the president
discharged his/her functions
freely, without fear of possible
repercussions in the future.
“The sitting president must be
assured by the constitution that
they will be protected by the state
from persecution and prosecution
event after retirement. This is to
allow the president to govern and
discharge his/her duties without
fear for his/her life in the future,”
he said.
On a different matter, the
African Youth Parliament also
proposed for the criminalisation
of funding of political parties by
external sources, which it said
would likely open up the country
to undue foreign influence.
Instead, it called for the
introduction of political party
funding to level the playing field
for political parties.
Still on politics, he said a set of
incentives must be made available
to political parties who fielded
not less than 30 per cent of youth
for seats being competed for at
both council and parliamentary
levels.
The move, he said would prop
up the country’s efforts to have
youth to in decision-making
positions.
Mr Semele said their
organisation also desired that
a national youth parliament be
established, the mandate of which
would be to introduce them to as
well as nurture them in political
leadership.
Further, he proposed that the
elections day and the president’s
inauguration day be entrenched
in the constitution, and
recommended that October 25
and April 1 be adopted for those
specific purposes.
He also suggested that the two
dates be declared public holidays
to allow citizens the opportunity
to partake in the activities.
The African Youth Parliament
further wanted Botswana’s
national symbols such as the

anthem protected by the

of mature age and sound mind
may propose an amendment to
the constitution of Botswana
by writing to the Permanent

“We also want to promote
bodily autonomy and integrity.
We are saying ‘My body is my
right’, therefore we want to
have that freedom to choose
what we do with our bodies.
For instance, I should not be
heckled by anyone for walking
around dressed skimpily,” she
explained.
Ms Beka had earlier
highlighted the challenges that
sex workers were faced with;
citing among them the stigma
and discrimination meted to
them by health care personnel
particularly in public health
facilities, and the shortage of
medication especially for the
treatment of diseases prevalent
in the sector such as Sexually-
Transmitted Infections (STIs).
She said lack of abortion
after-care services was also
one major challenge that they
had to contend with, and
added that while abortion
remained illegal in Botswana,
there was no hiding from the
fact that people continued to

GABORONE - The law should
enjoin the president to draw cabinet
ministers from both within and
outside the national assembly.
In its submissions to the
Presidential Commission of
Inquiry into the Review of the
Constitution on Friday, the
Botswana Democratic Party (BDP)
said of the 28 cabinet positions, 11
(or 40 per cent) should be drawn
from outside parliament while
the remaining 17 (or 60 per cent)
should be appointed from among
members of the national assembly.
Mr David Magang of the BDP
told the commission that the
development would not only
afford the president a wider and
more diverse pool of candidates to
choose his cabinet from, but would
also enhance the independence
of parliament and give it more
freedom to perform its legislative
functions.
“Limiting the appointment of
ministers to just within parliament
can be a constraint to the president.
The president should therefore have
the power to also pick ministers
from outside parliament, which
will give him a wider pool to select
the most suitable people from,” he
said.
Further, Mr Magang said while
the party saw no need for direct
election of the president, it however
wanted him/her to be endowed
with the freedom to pick the vice
president from either within or
outside the national assembly.
The party, Mr Magang said,
further advocated the upgrading of
sub-districts to full district status,
which he said would spur on the
pace of developments and enhance
service delivery.
In addition, he suggested
districts and government entities
such as land boards should be
renamed, saying they should be
assigned tribally-neutral names in
acknowledgement of them existing
to serve Batswana regardless of
their tribal identity.

worth noting that while there was
a general feeling that a president’s
powers were excessive, there was
sufficient oversight in place to
regulate them. Mr Bogopa told the
commission that Section 47 (3) of

another example of parliament’s
oversight of the president’s powers,
Mr Bogopa said Section 48 (4) gave
the national assembly authority to
regulate the president’s powers
in respect of his function as
commander-in-chief of the armed
forces.
He said as the constitution made
provision for parliament’s oversight
over the president with regard to
his executive powers, the BDP
maintained the view that it was not
necessary to curtail his/her powers.
Regarding the appointment of 40
per cent of cabinet ministers from
outside parliament, Mr Bogopa
said the party’s position was for
that to be starting point that would
see the country gradually move
towards having the entire cabinet

Entrench Ombudsman in

GABORONE - The
constitution must fully capacitate
the Ombudsman for him/

Rabasimane, Thursday, before the
Presidential Commission of Inquiry
into the Review of the Constitution,
National Amalgamated Local,
Central Government and Parastatal
Workers Union, or Manual
Workers Union, as commonly
known, said under the current act
the Ombudsman wielded no power
to issue any binding remedial
action.
He therefore called for the
office of the Ombudsman to be
entrenched in the constitution and
given the capacity to issue binding
recommendations.
“The office of the Ombudsman
should be established under the
constitution with powers to take
remedial action to address issues of
maladministration and governance
lapses. The Ombudsman must be
appointed by parliament and be
accountable to it,” he added.
With regard to the National
Assembly, he said to enhance
the impartiality of its speaker,
only persons who had not been
politically been active for at least 10
successive years should be eligible
for appointment to the position.
That, he said, would enhance the
efficacy of debate in parliament.

an equal basis, all the rights and
opportunities that were enjoyed by
the rest of the citizenry.

Mr Reikeletseng, who is a
member of the Botswana Boer
Goat Breeders Society, said he
sometimes exchanged his bull
dogs for goats.
He decided to specialise
in boer goat due to its meat
qualities.
He said, due to selective
breeding and improvement, the
boer goat had a fast growth rate
and excellent carcass quality,
sufficient milk production as
well as having capability for
multiple births.
Mr Reikeletseng said his
goats were bred according to
South Africa boer goat breeding
standards.
They are inspected on an
annual basis and tagged by the
Botswana Boer Goat Breeders
Society in conjunction with the
Ministry of Agriculture.
He started buying stud and
commercial goats mainly from
Eddy Boer Goats in Letlhakane
and some from Dirk Louw in
Namibia.
His farm sells goats at
annual auctions as a member
of the Future Genetics group of
breeders, which had their first
annual auction in Kgagodi early
this month.
Mr Reikeletseng said they also
sold to individual breeders.
The farm has 70 goats, 40 of
which are breeding females.
He said business was doing
well and he was hopeful for
growth, adding that he wished

should be attained by Vice
President as it had a lot to do
with party reformation and
restoration, thereby canvassed for
their support to ensure that such
tradition continued for the benefit
of the party.

Speaking in an interview after
regaining composure and strength
to share the sad news, Ms Aston’s
25-year-old son, Thato said, “On
Wednesday that week we went
to town with my mum to buy
electrical appliances and she left
me in town.
I arrived home late in the
evening.
I headed straight to the kitchen
to collect my food and went to my
bedroom in the other house in the
yard,” he said.
Thato received an unusual
early morning call from his little
brother, who was in the same room
as his mother.
“He just said batho ba batla
madi ba betsa mama…”
Thato sprang from bed and
headed towards the main house.
He had a spare key of the main
house door and quickly unlocked
it.
He got a shock of his life when
he saw a large inscription ‘277
DIE’ written with blood on the
sitting room wall.
He opened the bedroom door
and found his mother sprawled in
a pool of blood.
“I thought I could rush her to
hospital.
My little brother who had called
me was hiding in the other room.
I rushed to the gate and woke
the neighbours up.
I went back to the kitchen,
through which they had broken
into the house.
I still had hope that she was
alive, but when I saw pieces of
lungs in the kitchen basin I lost
hope.

Keorapetse has tabled a private
members bill seeking to transform
the Directorate on Corruption and
Economic Crime (DCEC) from
a government department to a
statutory corporation (parastatal).
Presenting the Corruption and
Economic Crimes (Amendment)
Bill 2021 for second reading
in Parliament on Thursday, Mr
Keorapetse said the bill wanted to
make the DCEC more autonomous
and to enhance its efficiency and
effectiveness.
He said the amendment bill
sought to achieve that by removing
the DCEC staff from mainstream
public service, and expanding its
composition by including a board
which would oversee the business
of the directorate. He said the
proposed board would have the
power to recommend who should
be appointed the DCEC director
general and the deputy.
“It is intended to introduce a

Tabling the motion, Mr Hikuama
said the intention was to remove
legal provisions and policies that
disadvantaged rural communities
as far as provision of clean drinking
water was concerned. He noted
that although the population was
divided into both urban and rural,
the legal provisions only catered for
the former.
“Botswana’s population is
settling in two types of settlements,
that is rural settlement and urban
settlement, but our laws and policies
for provision of safe and portable
water cover only the population in
urban and gazetted villages at the
exclusion of those in farmlands,
ungazetted settlements and cattle
sense of transparency and fairness
in the process and to remove any
sense of control, real or imagined,
that the now singular power of the
President to appoint this personnel
may have over the directorate,” said
the legislator.
Mr Keorapetse, who is also the
Leader of Opposition (LOO) in
Parliament, said the DCEC would
have the autonomy to employ its
own staff if Parliament passed the
amendment bill.
Through the amendment bill, Mr
Keorapetse also proposed for the
DCEC to be directly funded and
accountable to Parliament.
He said the amendment bill was
necessitated by the realisation that
corruption, nepotism and patronage
had increased in the public sector.
He said the DCEC in its annual
report also noted that cases of
administrative corruption, political
and elite corruption, bribery
and conflict of interest had been
reported in the public sector. He
said it was a source of concern that
few of those cases were prosecuted.
“Corruption has a debilitating

He said the motion was a
reactionary action towards existing
legal instruments, which did not
provide for availing of clean and
portable water in rural areas. He
said it was unacceptable for such
people to be denied access to water
on the basis of legal provisions.
“It is unacceptable for a
democracy to block access or
provision of safe and portable
water to its people through
legislation and policy. It would
give sense if consideration for
access and provision of portable
water to people is on the basis of
resource availability and capacity
not law because access to water
and sanitation are recognised at the
United Nations as human rights,”
he argued.

Mr Kabo Morwaeng opposed the
amendment bill, explaining that
the DCEC was independent in its
operations even though it was a
government department.
He, therefore, said there was no
justification to transform it into a
parastatal as it’s independence was
provided for by the law.
The minister said government
should avoid creating too many
parastatal organisations.
“When establishing a new
statutory body, it's purpose,
financial, legal and staffing status
need careful consideration. It
must be clear that there is need for
statutory powers to be exercised
by a body that is to a large degree
independent of government.
If functional or operational
independence can still be achieved
without the need for the creation of
a statutory corporation, then there
is no need to establish one,” said
Mr Morwaeng.
He said the other issue that
needed to be considered was
whether the entity would be able
to sustain itself financially. He said
if the entity would fully rely on
government for financing, then it
should remain part of government.
He said the current position of
government was that oversight
authorities performing similar
functions as the directorate such
as the Ombudsman, Financial
Intelligence Agency, Office of the
Auditor General, Fusion Agency
and others were part of government
with operational independence.
Nata/Gweta MP, Mr Polson
Majaga was also against the
amendment bill, stating that
the DCEC was operating
independently in its current set-
up. He said there was no evidence
to suggest that operations of
the directorate were at risk of
interference from the head of state
or the executive.
Palapye MP, Mr Onneetse
Ramogapi supported the
amendment bill. He said the
frequent transfers of DCEC staff
carrying high profile investigations
was a clear sign that there was
political interference on operations
of the directorate.
He, therefore, said it was
necessary to make the DCEC

Mr Hikuama further submitted
that most people who lived in
rural settlements and ungazetted
areas were engaged in farming
and therefore contributing towards
poverty eradication. He said such
production areas needed the
necessary support from government
in order to effectively address
challenges such as unemployment,
especially among the youth.
Additionally, he said providing
such people with portable water
would go a long way in enhancing
economic activity in those areas
and reducing the number of
destitute people as well as the rate
of rural-urban migration.
Minister of Lands and Water
Affairs, Dr Kefentse Mzwinila
said he opposed the motion, stating
that even though his ministry had a
responsibility and desire to provide
clean water to all Batswana, it was
constrained by legal provisions and
resource availability.
He argued that the motion
was against the Water Works
Act which made provisions for
availing water only to recognised
settlements. “Provision of water
to unrecognised settlements and
farm lands would mean taking
or providing infrastructure
developments beyond the scope
of the current planning areas,” he
noted.

divergent views regarding the
Corruption and Economic Crime
Amendment Bill of 2021, which
was tabled by Selebi Phikwe West
MP, Mr Dithapelo Keorapetse last
Thursday.
Supporting the bill, Okavango
MP, Mr Kenney Kapinga said there
was need for the Directorate on
Corruption and Economic Crime
(DCEC) to be fully independent for
it to be effective. He said the DCEC
should be government funded, but
should have the independence
to execute its mandate with no
interference.
“The DCEC should be a hybrid
statutory organisation such as other
institutions like the University of
Botswana which are independent
in their operations. There is
nothing wrong with establishing
a government funded body that
is independent, and this does not
absolve such organisations from
accountability,” he said.
Ghanzi South MP, Mr Motsamai
Motsamai also supported the bill,
saying it would not only enhance
democracy but also correct certain
procedures affecting the operations
of the DCEC.
“Institutions such as DCEC
should be given freedom and
independence to conduct their
investigations without fear,” he said.
He also submitted that unnecessary
transfer of DCEC officers should
be avoided to ensure continuity of
investigations and to enhance the
effectiveness of the institution.
Sefhare/Ramokgonami MP, Dr
Kesitegile Gobotswang also spoke
in support of the bill, arguing that
it was aimed at enhancing the

since it advocated for something
that was not sustainable. He said
it was imperative for all countries
to maximise resources to provide
the population with sustainable
services in a fair and equitable way.
“In Botswana, the Sustainable
Development Goals are
implemented within the existing
legal and policy instruments, in
particular, the Water Works Act
and the National Settlement Policy
of 2004.
The National Settlement Policy
states that basic infrastructure
and services shall be provided
to all settlements of a minimum
population of 500 people, and for
rural area dwellers, settlements
with a population of 250 to 499
people,” he said.
Dr Mzwinila said such basic
infrastructure and services
included portable water, primary
schools and a health post. He
argued that the policy encouraged
people to settle in areas where they
could be provided with such basic
infrastructure in a cost effective
manner to ensure sustainability.
He said since there were no
plans to accede to the request,
people who lived in ungazetted
areas could access water through
various programmes offered by the
Ministry of Agriculture. BOPA

effective. He said the bill was
weak and failed to indicate how
the independence of the DCEC

organisations, the DCEC is directly
funded by government and the
director general is the accounting
officer, with no interference from
the minister.
The bill is informed by suspicions
and perceptions which do not hold
water,” he said.
He suggested that instead of
reviewing the legislation, there was
need for all stakeholders, including
communities, to work together with
a common purpose of eliminating
corruption in Botswana.
Mr Fidelis Molao, MP for Shashe
West, also opposed the bill. He
said such submissions should be
left for Batswana to contribute
during the ongoing enquiry into the
constitutional review.
“As the constitutional review
process is ongoing, we should allow
Batswana to discuss such matters
there. It would be better and neater
for such issues to be handled at the
comprehensive process,” he said.

in good faith as it was based on

DIRECTORATE OF PUBLIC PROSECUTIONS

The Directorate of Public Prosecutions is a semi-autonomous body under the administrative supervision of the Attorney General established in terms of Section 51 A of the
Constitution of the Republic of Botswana. The main function of the Directorate of Public Prosecutions is to provide the people with an independent and effective criminal
prosecution service that is both fair and just.

The office conducts criminal prosecutions in the Magistrates’ Courts and the High Court of Botswana as well as criminal appeals at the High Court and the Court of Appeal,
from all other courts. This comes out clearly from the provisions of Section 7 of the Criminal Procedure and evidence act, Laws of Botswana (CAP: 08:02) which sets out that
the DPP exists to institute and undertake criminal proceedings against any person, before any court, in respect of any offence alleged to have been committed by that person.
Additionally the Directorate of Public Prosecutions manages a range of other matters such as interlocutory applications as well as Inquests and mine accidents inquiries.

POWERS OF THE DIRECTOR OF PUBLIC PROSECUTIONS (DPP)

The powers vested on the DPP are set out in Section 51 A (3) of the Botswana Constitution. They are as follows:
- To institute and undertake prosecutions of criminal matter on behalf of the State;
- To take over and continue any such criminal proceedings that have been instituted or undertaken by any other person or authority;
- Discontinue at any stage before judgment is delivered, such criminal proceedings so instituted or undertaken by the Directorate of Public Prosecutions or any other per-
sons or authority.

The DPP has various other important functions under various laws, among others, under the Proceeds and Instruments of Crime Act, Corruption and Economic Crimes
Act, Mutual Legal Assistance Act, Children’s Act, Extradition Act and Prisons Act. It must be highlighted that in the exercise of his/her powers the Director of Public Pros-
ecutions is not subject to the direction or control of any person or authority in terms of Section 51 A (6) of the Botswana Constitution.

MODE OF OPERATION OF THE DIRECTORATE OF PUBLIC PROSECUTIONS

In performing its functions, the DPP strives to uphold the Rule of Law and adhere to principles of natural justice, including but not limited to:
-Affording all accused persons, a fair and effective prosecution within a reasonable time;
-Upholding the constitutionally enshrined principle of the presumption of innocence until proved guilty by a competent court of law;
-Availing accused persons with all necessary facilities to prepare their defence;
-Facilitating procurement and presentation of witness depositions before the Court during trial.

In carrying out his/her role and functions, the Director of Public Prosecutions is enjoined to uphold the Constitution of the Republic of Botswana and all applicable laws.

FUNCTIONS OF THE DPP IN RELATION TO THE POLICE AND OTHER LAW ENFORCEMENT AGENCIES
The primary general duties of the Police are to maintain law and order as well as prevention and detection of crime. Be that as it may, the Directorate of Public Prosecutions
bears the duty to give the Police and other investigating authorities legal advice in the discharge of both their statutory and administrative functions in criminal matters to
ensure that they efficiently conduct investigations in order to enhance the prospects of a quality prosecution and a fair and effective trial.

LEGISLATIVE DRAFTING DIVISION

DRAFT LEGISLATION
The core mandate of Legislative Drafting Division is to draft both Primary (Acts of Parliament) and Secondary Legislation (Statutory Instruments, Orders, Government
notices) on behalf of the Government.

PROVIDE LEGAL ADVICE

The division is mandated to offer legal advice on matters brought before it by the various Government ministries on the interpretation of the law. The division is best suit-
ed to carry out this mandate as their primary role is to draft all types of legislation on behalf of the government.

LAWS OF BOTSWANA
The Legislative Drafting Division produces the annual bound editions of the Botswana Statute Law and updates the publication of the Laws of Botswana in loose leaf
through Annual Law Revision Orders (LROs).

ATTEND PARLIAMENT
Legislative drafters have to be present in parliament when a Bill that they have drafted is being presented before parliament by the Minister. The role of a drafter in parlia-
ment is to give advice to the Minister on any legal issues that may arise concerning a Bill, they are also there to take note of any amendments that may come up during the
committee stage of reading of a Bill. A drafter has to be present in parliament until the Bill has been passed.

INTERNATIONAL & COMMERCIAL DIVISION

The ICD is mandated with the responsibility of providing legal advice on international and commercial matters in which the Government is a party or has an interest.
This includes the negotiation and drafting of international and commercial agreements. It is worth noting that in the case of ICD, the drafting function is limited to
drafting of international and commercial agreements which are signed by the Government and not legislative drafting which is meant for Parliament. In addition the
ICD only assists Government Ministries and Departments since the ICD is part of the office of the Attorney General who is the principal legal advisor to the Govern-
ment of the Republic of Botswana.

In order to effectively carry out this mandate, the ICD has seconded legal officers to all Government Ministries who in addition to carrying out this mandate, advise
Ministries on all legal matters and act as liaisons between the office of the Attorney General and the Ministry. In addition, there are two specialised units within ICD,
that is the International Law Unit and the International Trade Unit.

The International Law Unit deals with matters such as international human rights law, environmental law, diplomatic and international humanitarian law, the law of
the sea etc. The unit is also involved in State Party Report writing under various convention and treaties to which Botswana is a party. The International Trade Unit
deals specifically with International Trade Law issues relating to the World Trade Organisation (WTO), Southern African Development Community (SADC), South-
ern African Customs Union (SACU), Africa Caribbean Pacific (ACP), European Union (EU) etc.

INTERNATIONAL AGREEMENTS
With regard to international agreements, ICD provides legal advice to Government in the negotiation and drafting of multilateral and bilateral agreements under
the auspices of: the United Nations (UN) and its specialised organs, the African Union (AU), the World Trade Organisation (WTO), Southern African Development
Community (SADC), Southern African Customs Union (SACU), Africa Caribbean Pacific (ACP), European Union (EU) and those involving individual states. After
successful negotiations and Botswana decides to become party to an agreement the ICD is responsible for drafting the necessary instrument accepting to be party to
the agreement. In addition ICD will provide advice during the implementation of such agreements.

COMMERCIAL AGREEMENTS
The ICD also advises , negotiates and drafts for and on behalf of the Government Commercial Agreements relating to the procurement of goods, works and services,
performance bonds, guarantees and indemnities, financial agreements (loans) including subsidiary loan agreements, the issuance of bonds, stock and other securities,
intellectual property rights, shareholdings and partnerships, competition law issues, privatisation, etc.

CIVIL LITIGATION DIVISION

The Civil Litigation Division is responsible for the institution of all civil court actions by and on behalf of the Government and for the defence of all civil matters
brought against the Government or Government officers by members of the public and other organisations.

This mandate emanates from the State Proceedings (Civil Actions by or against Government or Public Officers) Act CAP: 10:01 of the Laws of Botswana which
authorises the Attorney General to represent the government or public officers in civil matters. Such representation may be before the Magistrate Courts, Industrial
Court, and High Court, Court of Appeal or any other fora such as in liquidations, arbitration and mediation.

ARBITRATION / MEDIATION
The division conducts a lot of arbitration cases which are referred to arbitration by virtue of the many agreements that the government enters into when doing busi-
ness. Most of the arbitrations the division deals with involve disputes over government construction projects and contracts for the supply of goods and services.

LEGAL ADVICE
Members of the division are also heavily engaged in providing legal advice to ministries and departments in a bid to avoid unnecessary litigation and to resolve dis-
putes expeditiously. Ministries and departments are thus encouraged to seek advice from the division before embarking on any exercise that may attract adverse legal
consequences.

WORKSHOPS / TRAINING
The division is also proactive in avoiding disputes by providing training to ministries and departments on guidelines for disciplinary proceedings and on the provision
of full instructions to the division in the event of disputes reaching the courts.

DEBT COLLECTION
The division serves as the agency for the collection of all debts owed to government of whatever nature. To this end the division also hosts a unit of deputy sheriffs who
are charged with the service of court process, the enforcement of court orders and the execution of writs.

DIS appeals Khama search, seize ruling

GABORONE - The Directorate of
Intelligence Services (DIS)’ appeal of an
application to conduct a search and seizure
at former President Lt Gen Dr Seretse
Khama Ian Khama’s official residence,

The draft consent order, where DIS is
seeking to be allowed to search and seize
properties at State House number four, was
filed and approved on Thursday, before the
CoA bench comprising of Justices Singh
Walia, Tshepo Motswagole and Mercy
Garekwe.
The DIS had previously lost its expedited
appeal application to conduct a search
and seizure at Lt Gen Khama’s official
residence, with the Court of Appeal
ordering that the appeal be made in the
normal course.
The DIS has approached the CoA with
the application challenging a High Court
judgment by Justice Rainer Busang in
November 2021, on the grounds that the
court erred in law by failing to consider
that sealing of a crime scene was not self-
help and unless the sealing had been held
to be without a factual or legal basis, the
remedy of spoliation was not available.

the High Court turned down its request

GABORONE -Oageng Letsholo, the first
accused in the murder of Ms Barulaganye
Auston was on Thursday convicted of
causing grievous bodily harm in another
case.
According to the court reports, Letsholo
has been on the police wanted list as he
was on the run prior to his arrest for the
murder case.
Passing the judgement, Magistrate
Tshepo Thedi of Village Magistrate Court
pronounced Letsholo, who had been on the
run frustrating the arms of justice to take
its course, guilty as charged.
Letsholo was found guilty of causing
grievous bodily harm to one, Ms
Kediemetse Sebobi on October 26, 2014, at
Mmatseta.
Letsholo will appear before the court on
August 2 for mitigation and sentencing.

was not convincingand that the evidence

GABORONE - Three men, facing
charges of theft of motor vehicle, unlawful
possession of arms and ammunition and
entering Botswana at ungazetted point

Gaborone Extension II Magistrate
Court’s Mr Lentlhabetse Willie remanded
the trio of Mogomotsi Thupane, Sipho
Mathangana and Jabu Shabangu in
custody as the matter was still at an early
stage.
He also ordered that the case mention
on August 4 for status hearing.
Advancing reasons for the remand of
accused persons, the prosecutor, Inspector
Seabe Leeme of Botswana Police said the
investigating team was yet to interview
the other two suspects, who were injured
during their arrest and were currently
hospitalised.
Insp. Leeme also told the court that
the nationality of the other two accused
persons: Mathangana and Shabangu was
yet to be established.
He said though having identified
themselves as South African nationals, the
duo’s nationality was yet to be verified,
more so that they had entered the country
at an ungazetted point.
On count one, the three accused persons
residence of former President Khama.
The agency had stated that the house, was
erroneously omitted from the initial search
warrant issued against Lt Gen Khama, and
the omission was only discovered October
23, 2021.
Following a stalemate between former
President Khama and the DIS, which
wanted to search the premises, the agency
approached the High Court on November
19, 2021 for it to sanction the search and
seizure.
However, Justice Busang dismissed the
application, hence the decision to appeal.
The appellant is represented by
Thapelo attorneys, while the responded is

Kenya heightens security ahead of polls

NAIROBI - Kenya police
have heightened security ahead
of the general elections slated
for August 9.
Hilary Mutyambai,
inspector-general of Police,
told journalists in Nairobi,
that a total of 150 000 officers
drawn from partner securities
agencies would be deployed
during the elections to ensure a
safe environment for all to cast
their votes.
“Formed police units have
also been deployed across
the country to offer tactical
support to general duty officers
before, during and after the
general elections,” Mutyambai
said.
He revealed that there
was a further provision for
the deployment of aircraft in
strategic locations to provide
logistical and air support when
and where required throughout
the electioneering period.
The August poll is set to
be tightly contested between
major political alliances, Kenya
Kwanza headed by Deputy
President William Ruto and
Azimio la Umoja, which is led
by former Prime Minister Raila
Odinga.
President Uhuru Kenyatta. who
is serving his final term in office,
has opted to support Odinga, his
former rival for the top post, who
is making his fifth presidential
run, rather than his own deputy.
Mutyambai observed that
as part of preparations for
the elections, they had put in
place elaborate measures and
strategies to ensure that security
was guaranteed throughout
the electoral cycle to enable
the Independent Electoral and
Boundaries Commission (IEBC)
to conduct free, credible and fair
elections.
“To ensure proper coordination
of all activities surrounding the
election, Kenyan police have also
established an election security
secretariat,” he said.
Mutyambai observed that
the police had also developed
election security guidelines
for use by police commanders
to address gaps in operations
experienced during previous
elections.
“The police are aware of
the need to sensitise and train
officers on election security
management to ensure they are
acquainted with their roles and
responsibility,” he said.
He added that the security
agency would also lease
additional vehicles and
operational equipment to ensure
that officers are well resourced
and in a high state of readiness
to handle all forms of threats that
may arise before, during and after

hails
Russia,
Ukraine
grain deal
ADDIS ABABA - African
Union (AU) Commission
chairperson, Moussa Faki
Mahamat has hailed the grain
export deal that Russia and
Ukraine separately signed
in Istanbul on Friday with
Türkiye and the United
Nations.
“The chairperson of the
commission commends all
the parties on this successful
development,” said AU.
The deal, officially called
the Black Sea Grain Initiative,
was first signed by Russia’s
Defense Minister Sergei
Shoigu with his Turkey
counterpart, Hulusi Akar,
and UN Secretary-General
Antonio Guterres and later
by Ukrainie Infrastructure
Minister Oleksandr Kubrakov
with the other two sides.
The AU Commission
chairperson also congratulated
Senegal President Macky Sall,
the current chairperson of the
AU, for having called for the
resumption of cereals from
Russia and Ukraine to global
markets.
Sall’s visit to Russia
and Ukraine last month is
believed to have played a role
in the eventual deal, said the
chairperson.
Russia and Ukraine are
breadbaskets of the world,
producing almost one-third of
the world’s wheat and barley
and half of its sunflower oil.

About P50 million to be collected for creative industry

GABORONE - The implementation of the
Reprographic Rights management will see
an estimation amount of about P50 Million
collected annually from various government
and private institutions for the creative
industry.
The funds will benefit about 5000 active
creatives outside music.
Acting Minister of Trade and Industry,
Beauty Manake said this on Thursday during
the Reprographic Reproduction Rights
Management Seminar by Copyright Society of
Botswana (COSBOTS).
“I wish to encourage your members,
particularly the youths to be innovative and
commercialise their works,”she said.
Manake also said those who stood to benefit
should strive to invest in themselves to better
their lives.
She said the goal of the seminar was to bring
together different users of the reprographic
works and sensitise them on its rights.
Manake also said it would sensitise the
stakeholders on the matter.

RADP pageant

PHUDUHUDU - Twenty-year-
old Gorata Masalela impressed
the judges during the question and
answer session of the Miss RADP
beauty pageant at Phuduhudu in
the Ngamiland District over the
weekend. She got the crown.
The first princess title went to 24-
year-old Gloria Kelaotswe while
19-year-old Ompelege Lelooge
settled for the second princess spot.
In the male category, 22-year-old
Tshepo Majaga outclassed Tapedza
Diabona and Larona Ngwengare to
become Mr RADP while Diabona
and Ngwengare were sashed first
and second prince respectively.
The pageant themed; Unearthing
Natural Beauty and Talents, was
organised by Maun Administration
Authority .
Through the initiative, the
government wants to unearth a
hidden talent so that the young
men and women can identify their
beauty and feel free to participate
in national activities.
After being crowned, Masalela,
a University of Botswana student
admitted that young people from
her community were talented, but
lacked confidence and self-esteem
to develop and nurture their talent.
She urged young people to build
their confidence and participate in
community activities as well as take
advantages of initiatives offered by
the government to improve their
livelihoods.

Marathon

SELEBI PHIKWE - Namibians
dominated this year’s Orange
Phikwe Marathon, winning the
42.2km male and female races on
Saturday.
Matheus Jesaya and his
female colleague, Indileni
Mweshamekange, pocketed P25
000 after winning the 42.2km
races.
Jesaya, who also scooped position
two in the FNB Kazungula Bridge
Marathon early this year, clocked
2:17:25 whilst Mweshamekange
clocked 2:46:56 to win the Phikwe
marathon.
“It was a tough race and I faced
a stiff competition, but patience,
perseverance and ability to go an
extra mile made me victorious,”
said Jesaya.
He also attributed the victory
to his coach who insisted on
vigorous preparations for this race,
adding he was looking forward
to participating in next year’s
marathon.
For her part, Mweshamekange
said she was participating in the
tough and challenging marathon
for the first time.
She was over the moon to have
performed well.

but after my Kazungula marathon

Kiptoo said he got to learn about
the marathon from his Kenyan
friend who participated in the 2019
event.
He said this motivated him to
also participate in the marathon as
a build up for other international
marathons.

Marathon, which has a reputation
of attracting runners from around

This was announced during

Zebras register CHAN draw

FRANCISTOWN - Botswana
and eSwatini senior football
teams played to a goalless
draw in an African Nations
Championship (CHAN) 2023
qualifier at Obed Itani Chilume
Stadium in Francistown on
Saturday.
The duo will meet in the
second leg scheduled for South
Africa on July 26.
The Zebras coach, Mogomotsi
Mpote, is cognizant of the fact
that only a win in the next game
will take them through to the
next stage of the qualifiers.
In Francistown, eSwatini
came with guns blazing,
attacking Botswana from all
angles, but Goitseone Phoko was
outstanding between the goal
posts.
His timing was on point and
he denied visitors at least four
scoring opportunities.
The Zebras too had a number
of chances to score, but failed to
convert.
In an interview, Mpote gave
credit to eSwatini, whom he said
were a better side.
He said eSwatini gave his boys
a tough time.
However, Mpote added ‘I am
happy with the performance of
my boys because they did well.
eSwatini had more chances than
us, it shows how prepared they
were,” he said.
For his part, eSwatini coach,
Dominic Kunene, said a point

adding his team was lucky not

mistakes.
“In football if you get chances
