JUDICIAL AFFIDAVIT OF
ANESTON ICAD

This is the examination of petitioner ANESTON ICAD, of legal age,

married, Filipino citizen and with postal address at Ubodan, Alno, La
Trinidad, Benguet.

The examination was conducted by counsel for the Petitioners, KIZEL

COTIW-AN, at the counsel's office at JC 205 Km. 5 Pico, La Trinidad,
Benguet.

The witness answered the questions asked of him in Ilocano, a language

he fully understands and fully conscious that he does so under oath and
knowing that he may face criminal liability for false testimony or perjury.

The testimony of the witness is being offered to prove the circumstances

surrounding the loss of the owner's copy of TRANSFER CERTIFICATE
OF TITLE NO. T-3533 which is the subject of this case.

JUDICIAL AFFIDAVIT PROPER

The following were the questions asked of the witness and the witnesses'
corresponding answers:

1. Question (Q): Pakibaga ti nagan mo ken dadduma pay nga

inpormasyon panggep ti bagim. (Please tell us your personal
circumstances.)

ANSWER (A): Siyak ni ANESTON ICAD, adaan iti osto nga edad,
Filipino, adda asawak ken agnanaed idjay, Ubodan, Alno, La Trinidad,
Benguet (I am Aneston Icad, of legal age, Filipino, married and
residing at Ubodan, Alno, La Trinidad, Benguet).

2. (Q): Sika metlang kadi daytoy ANESTON ICAD nga nangipila iti
daytoy a petition? (Are you the same ANESTON ICAD who is the
petitioner in this case?)

(A): Wen, ma’am. (Yes, ma’am.)

3. (Q): Apay nga sika ti nangipila ditoy nga Petition? ( Why are you the
one filing the Petition?)

(A) : Natay en dagitoy akin bagi ti lote, ma’am. (The owners of the land
already died, ma’am.) (The witness is being shown Certificates of Death of
PARISTA AGALPAO attached as ANNEX “C” and ANDREA BALANBAN
AGALPAO attached as ANNEX “C-1”).

4. (Q): Mabalin pakikita yu daytuy dokumento nga dagitoy nu isu ti

ibagbaga yu nga mangipaneknek nga natay dan. (Please go over these
documents sir, if these are the ones you are referring to.)

 5. (Q): Idjay ngato ti umuna a dokumento ket nakakabil ti nagan a
PARISTA AGALPAO. Sino kadi daytoy? (On the upper part of the
first document is the name PARISTA AGALPAO. Who is this person?)

(A) : Isuna diyay lolok ma’am, asawa ni lolak nga ni Andrea. (She is my
grandmother ma’am. )

marked as ANNEX “C” be marked as EXHIBIT “C”.

6. (Q): Idjay umuna nga parte daytoy maikaduwwa a dokumento ket

nakakabil ti nagan a ANDREA AGALPAO. Sino kadi daytoy? (On the
upper part of the second document is the name ANDREA AGALPAO.
Who is this person?)

(A): Isuna diyay lolak ma’am, asawa ni lolok nga ni Parista. (She is my
grandfather, ma’am.

ANDREA AGALPAO found at the upper portion of the document previously
marked as ANNEX “C-1” be marked as EXHIBIT “C-1”.

7. (Q): Kaanu-anum jay akin bagi ti lote? ( How are you related to the
owners of the lot?)

(A) : Apo da siyak, ma’am. ( I am their grandson, ma’am.)

8. (Q): Adda ba ti kakadwam nga ag tawid nga aapo wennu aanak

dagitoy akin bagi ti lote nu adda man? (Are there any heirs of the
owners of the lot besides you?).
(A): Adu kami nga agtawid ngem siyak ti inaramid da nga mangi-
representar kinyada. (We are many heirs but I was the one whom they
made as a representative.)

9. (Q): Anya nga dokumento, nu adda, iti mangipaneknek nga sika ti

mangirepresentar kinyada? (What document, if any, do you have to
prove that you are authorized to represent them?)

(A) : Adda iti Special Power of Attorney nga inaramid mi. (We have
executed a Special Power of Attorney.) (The witness identifying the

diyay lote? (What is your proof, if any, that your grandfather and
grandmother own the lot?)

A: Adda ti titulo mi nga nagapu iti Register of Deeds, ma’am. (We

have a title issued by the Register of Deeds, ma’am). (The witness
identifying an electronic copy of TRANSFER CERTIFICATE OF TITLE
NO. T-3533 in the name of Paresta Agalpao married to Andeng Balanban
marked as ANNEX “B”.

With the kind permission of the Court, we pray that the electronic copy
of the TRANSFER CERTIFICATE OF TITLE previously marked as
“ANNEX B” be marked as EXHIBIT “B”.

11. (Q): Manu ti assessed value na dayta nga lote? (What is the assessed
value of the lot?)

(A) : Php 31,300.00 ma’am. (Php 31,300.00 ma’am.) (The witness

identifying a Declaration of Real Property of TCT-3533 issued by the
Municipality of La Trinidad marked as ANNEX “D”)

A : Idi tawwen 1998, idi natay ni lolok, inted ni lolak diyay Owner’s
Duplicate kenni nanang ko nga ni EDITH ICAD, tapnu maidulin nga
usto. Iddi tawwen ti 2014, inpasa ni nanang ko diyay Owner’s Duplicate

 kinyak tapnu idulin ko met. Inalan met diyay kasinsin ko tapnu
usarenna a pang-apply iti BENECO para idjay negosyo na nga poultry.

Ngem idi February 2016, natay diyay kasinsin ko ket amin nga
dokumento na pati diyay Owner’s Duplicate ket naikabil iti maysa nga
karton.

Idi tawwen ti 2017, diyay antik nga ni VIRGINIA VICENTE, nga

agkabawen, ket nilinisan na diyay sigud nga balay mi ket daksanggasat
ket napuurana amin nga nakolektaa nga karton pati diyay naikabilan ti
Owner’s Duplicate.

(Sometime in 1998, when my grandfather died, my grandmother

gave the Owner’s Duplicate to my mother, EDITH ICAD, for
safekeeping. Sometime in 2014, my mother entrusted the Owner’s
Duplicate to me. My cousin got the Owner’s Duplicate so he will use it
to apply to BENECO for his poultry business.

However, in 2016, my cousin died and all of his documents,

including the Owner’s Duplicate were placed in a box.

In 2017, my aunt, VIRGINIA VICENTE, who has trouble recalling

things, cleaned the old house and unfortunately she burnt all the the
collected items, including the box where the Owner’s Duplicate was
placed.

you discover that the title was missing?)

(A): Idi 2021 ma’am. (Last 2021, ma’am.)

14. (Q): Anya inaramid yu, nu adda, idi naamuan yu nga maaw-awan
diyay titulo? (What did you do, if any, after you discovered that the title
was missing?)

(A): Biniru-birok mi ngem awan nga talaga makita mi, ma’am. Isunga
nagpa-aramid kami iti Affidavit of Loss nga insumitar mi idiay Registry
of Deeds ken inpilak daytoy nga petisyon. (We diligently tried to locate it,
but we were not able to find it, ma’am. I executed an Affidavit of Loss
which I filed at the Registry of Deeds and I filed this petition.) (The
witness identifying ANNEX “E” which is his Affidavit of Loss, and the

 annotation of the affidavit at the back of TRANSFER CERTIFICATE OF
TITLE NO. T-3533 at the Registry of Deeds marked as ANNEX “F”.)

EXHIBITS “E and E-1” respectively and the annotation on Page 5 of the
electronic copy of TCT No. T-3533 previously marked as ANNEX “F” be

napukaw nga titulo? ( Who is in present possession of this lot covered by
the lost certificate of title?)

(A) : Dakkami ken ijay pamilyak, ma’am. ( My family and I,

ma’am.)

17. (Q): Anya nga katulagan, nu adda man, iti sabali nga tattao iti
naararamid panggep iti daytoy nga lote nga saksakopen daytoy napukaw
nga titulo? (What transactions, if any, were entered into over the property
covered by the missing certificate of title?

(A): Awan, ma’am. (None, ma’am.)

18. (Q): Anya iti dawdawatem iti korte iti daytoy nga petisyon mo? (What
are you asking the Honorable Court as the petitioner of this case?)

(A) : Dawdawatek nga mapatgan daytoy nga petisyon tapnu mabilin

ti Registry of Deeds nga mangiparuwar iti baru nga kopya iti TCT No. T-
3533 nga kasukat daytoy napukaw. (I pray that this Petition be granted
and the Registry of Deeds be ordered to issue a new owner’s copy of TCT
No. T-3533 in lieu of the missing certificate of title.)
