Special Conditions
1. The material shall be supplied to the consignees as per tender list.
2. The article should be securely packed for rough handling in trans
for lnstitute FREIGHT PAID. Losses or damage in transit will be to
the supplier.
7. The material shall be supplied within 20 Days of the issue of supply order.
8. Any deviation, from tender documents, the material is liable to be rejected and
will be returned at your risk and cost without any financial obligation on the part
of this office.
9. Details specifications and make of ea,ch item should be clearly given supported
by the illustrated pamphlets wherever possible. Bids without specifying the make
and other particulars may be rejected. The accessories included in the
equipment should also be clearly mentioned.
10. The payment will be made after the satisfactory inspection, verification,
installation and demonstration and to our entire satisfaction. No other payment
terms are acceptable.
11. Supplier rates should be legally valid upto 30.09.2022
12.1n case of failure to supply the goods within the prescribed time and in
accordance with the specifications given in the bids, The IMC of lTl shall be free
to cancel the order and make purchases from the next higher bid or from the
open market as the case, may be. ln that case the loss sustained by lTl, shall be
recovered from the defaulting supplier, The ITI will be at liberty to recover the
loss from the permanent earnest money/or any other pending claim of supplier
without prejudice to its general right to affect recovery from the supplier.
13.The undersigned is not bound to accept the lowest bid and may reject any bid or
any part of the bid without assigning any reason thereof.
14. Downloaded tender form can be deposited enclosing DD of tender form fees
without which tender will not be accepted.

CONFLICT OF INTEREST :
The Bidder pafticipating in a bidding plocess must not have a conflict interesl.
A conflict ol'interest is considered to be a situation in rvhich a party has interests that
could irnploperly influence that pafty's performance ol official duties or responsibilities,
contractual obligations, or compliances rvith applicable laws and regulalions.
A Bidder may be considered to be in cor.rflict of interest with one or more parties in a
bidding process il, including but limited to:
a) have controlling paftners/shareholders in common; or
b) receive or have received any direct ol indirect subsidy fi'om any of them; or
c) have the same legal representative fbr purposes ofthe Bid; or
d) have a relationship with each other, directly or tluough common third parties, that puts
them in a position to have access to infonnation about or influence on tlre Bid ofanother
Bidder or influence the decision ofthe Procuring Entity regarding the Bidding prooess; or
e) The Bidder participates in more than one Bid in a bidding process. Participation by a
Bidder in more tlran one Bid will result in the disqualification of all Bids in which the
bidder is involved. however, this does not limit the inclusion of the same subcontractor,
not otherwise participating as a Bidder, in more than one Bid; or

Filing an appeal
If a Biddel or prospective biddel is aggrieved that any decision, action or omission olthe
Procuring llntity is in contraventiorl to the provision to the provision of the Act or the
Rules or the Guidelines issued there under, he may file an appeal kr first Appellate
Authority, as specitied in the Bidding Document within a period often days from the date
of such decision or action, omission, as the case may be, clearly giving the specific
ground or grounds on rvhich he feels aggrieved.
Provided that after the declaration of a Bidder as successful the appeal may be filed only
by a Bidder who has participated in procurernent proceedings.
Provided fufiher that in case a procuring Entity evaluates the Technical Bids before the
opening ofthe Financial Bids, an appeal rolated to the matter ofFinancial Bids may be
filled only by a Bidder rvhose Technical Bid is flound to be acceptable.

ADDITIONAL CONDITIONS OF CONTRACT
01. Correction of arithrnetical errors :
(i) At the tiure of a,'vard of contraot. thc quantity of goods. r,vorks ol services
originally specilied in the Bidding Document nray be increascd or decreased by a
specified percentage, but such increase or decrease shall not exceed twenty
percent, ofthe quantity specilied in the Bidding Document. it shall be rvithout any
change in the unit prices or othef tefms and conditions ol'contract.
(ii) If tl.re Plocuring Entity does not procure any subject matter of procurement or
procures less than the quantity specified in the Bidding Docurrent due to change
in circunrstances, the Bidder shall not be entitled lor any claim or compensation
except othelrvisc provided in the Conditions of Contract.
(iii) ln case of procurenrent o['Goods or selvices, additional quantity may be procured
by placing a repeat ordcr orr the rates and conditions ol tlre oliginal order.
Horvcver, the additional quantity shall not be more than 50% of the value of
Goods of the original contract and shall be within one month fiorn the date of
expiry ol' last supply. if the suppliers fails to do so, the I'rocut'ing Entity shall be
free to arlange fbr the balancc supply by limited Bidding or otherr.vise and the
extra cost incurfed shall be recovered f'rorn the Suppliers.
03. Dividing quantities among morc than one Bidder at the time of alvard (In case of
Procurcmcnt of Goods) :
As a general lule all the quantities of the subject matter ol'procuremeut shall be procurcd
f-r'orn tl.rc Bidder', r'vhose Bid is accepted. Llolvever, rvhen it is considered that the cluantity
ofthe subject rnattcr of procul'ement to be procured is very large and it nray not be in the
capaoity ol the Bidder, lvhose Bid is accepted, to delivcr the entire quantity or r'vlren it is'
consideled that the subject matter ol procuremellt to be procured is of clitical and vital
natule, in suclr cases, the quantity may be divided bctween the Bidder', whose Bid is
