REGULAR EMPLOYMENT CONTRACT

TO ALL TO WHOM THESE PRESENTS SHALL COME, GREETING:

This Contract of Employment is executed, made and entered this _____________ by and between:

___________________, a juridical entity created and existed under the laws of the
Republic of the Philippines with principal business address at Barangay Polo,
Dapitan City, Zamboanga del Norte, Philippines, represented in this act by its sole
proprietor, Mr.______________, hereinafter referred to as the EMPLOYER;

-AND-
 
Mr./Ms. ___________________________, of legal age, Filipino, single/married, and
with current address at Barangay____________________, City/Municipality of
____________________, Province of ___________________, Philippines, hereinafter
referred to as EMPLOYEE;

WITNESSETH;

WHEREAS, the Employer is engaged in the construction business particularly within the
Province of Zamboanga del Norte and nearby provinces;

WHEREAS, the Employee manifests and guarantees that he/she possesses the requisite qualities
and competencies needed by the Employer in the conduct and course of its business;

NOW THEREFORE, for and in consideration of the foregoing premises, mutual covenants and
conditions contained herein, the parties hereby agrees as follows:

I. Appointment:

The employment commences on _______________, 2021, provided that the following pre-
employment requirements have been accomplished and submitted prior to the 1 st day of
work: NBI Clearance, Birth Certificate and Medical Certificate. Unless otherwise directed,
the ordinary working hours shall be from 8:00 o’clock in the morning up to 5:00 o’clock in
the afternoon, with one (1) hour meal break. The ordinary work days shall be from
Monday until Saturday except as otherwise instructed.

II. Compensation:

2.1. Employee will receive a daily wage of ___________________ Pesos (P_________),


Philippine currency, subject to withholding tax, SSS, Pag-Ibig contributions, and other
government-required deductions to be borne by Employee. In addition, Employer will
pay the mandatory 13th month pay salary at the end of each calendar year and
EMPLOYER may at its discretion provide midyear or performance bonuses. Annual and
incremental salary adjustments and merit increases may be effected on a case to case basis
and upon the recommendation of the immediate manager and upon approval of
management.

III. Duties and Responsibilities

4.1. The employee hereby consents to be assigned primarily the following duties and
responsibilities: _____________________, without being limited thereto. The Employer
reserves the right to appoint the Employee to other tasks and responsibilities.

IV. Place of Work

Employee’s place of work will be at its primary office at Barangay Polo, Dapitan City subject to
wherever the construction venue may arise during the course of employment and when his
services is desirable and in need. Employee agrees that the Employer may transfer him/her to
any other location as may be required and in the exigencies of the business and the capabilities of
the Employee to aid other area of business/construction of the Employer which may arise from
time to time.

V. Decorum

7.1. Employee shall observe and comply with all company rules and regulations, within or
otherwise. Employee shall devote his/her entire working time to the Employer and shall
have no direct or indirect interest in any company, whether profit or not, directly in
competition with or offering the same services as the Employer nor shall Employee take
any interest that is conflicting or inimical to Employer.

VI. Termination and Resignation

8.1. It is understood and expressly agreed that the employment may be terminated at any
time when the Employee commit or omit to do an act constituting a just and valid cause
for termination of employment. The company reserves the right to suspend or terminate
the services of the Employee at any time for just and valid causes including, but not
limited to, the following, viz:

a. Inefficiency
b. Malingering
c. Tardiness
d. Unauthorized absences (as stated in 6.5 and 6.6)
e. Disobedience of lawful orders or instructions of supervisors
f. Working, acting or doing business against or in conflict with the interest of the
Employer or its officers, and/or damage to their name, properties and/or its
employees
g. Violation of any company policies, rules and regulations
h. Fraud or willful breach of trust
i. Breach of confidentiality and non-disclosure
j. Just and authorized causes enumerated in Article 282, 283 and 284 of the Labor
Code; and
k. Such other analogous causes as provided by law or regulation

8.3. Employee hereby agrees that should the he/she desires to resign, he/she shall give a
notice or a resignation letter 15 to 30 days prior to the effectivity of the resignation. This is
to provide the company the opportunity to clear the liabilities, dues and other obligations
as well as accountabilities of the Employee.

VII. Non-Competition

If the Employee has been separated, resigned or terminated from his/her employment for
whatever reason, he/she shall not seek employment with local or foreign company doing
business offering similar services of the Employer within one (1) year from separation,
termination or resignation, without the prior notice to Employer. This section is only applicable
to office personnel and not to those workers in the field, i.e. construction workes, welders,
masons, truckmen, laborers.

VIII. Non-Disclosure

Employees agree, acknowledge and confirm that this contract must remain confidential. Except
as may be legally required by competent authority or applicable statutes, the parties in this

contract shall not make any unauthorized disclosures of the terms and conditions embodied in
this contract.

IX. Confidentiality

11.1. In order to safeguard the interest of the company as well as the confidentiality of its
business and affairs, Employee agrees that during the term of his employment and from
and after the actual cessation of his employment, he shall maintain strict confidentiality
and shall not disclose any technical, business, financial or commercial information,
methods or processes, inventions including but not limited to: customers, customer lists or
requirements, price lists, pricing structures, marketing and sales information, business
plans or designs, dealings, financial information, product line research, formulae whether
authored by Employee or otherwise- to those of any other person, company, business
entity or other organization whatsoever.

11.2. During and after Employee’s term with the company, he shall at all times practice good
discretion, ask permission and seek prior approval from the company with regards to any
document or information belonging to the company.

11.3. Employee must declare that he has properly tendered his resignation from his previous
employer and is free from any obligation to them.

X. Acceptance of Terms and Conditions of Employment

The employee hereby agrees and consents to the terms and conditions stated in company
policies, which are incorporated herein for reference and made integral part hereof.

Employee’s affixing of his signature on the herein Employment Contract means that the
Employee has read and fully understood the terms and conditions hereof and accepts the same;

ACKNOWLEDGMENT

BEFORE ME, this ___________ in Dipolog City, personally appeared the PARTIES with their
proof of identities written below their names, known to me the same persons who executed the
foregoing instrument, an EMPLOYMENT CONTRACT consisting of two (2) pages, including this
page on which this acknowledgment is written, signed, by them and their witnesses and sealed with
my notarial seal, and hereby acknowledge to me that the same is their free and voluntary act and
deed.
