MOTION FOR EXTENSION OF TIME

TO FILE COUNTER-AFFIDAVIT

RESPONDENT, by the undersigned counsel, and unto this

Honorable Office, most respectfully states, That:

1. Respondent have just recently engaged the services of the

undersigned Law Office in relation to this complaint filed by the
Complainant before the Honorable Office of the Provincial
Prosecutor;

2. On August 16, 2022, Respondent received the subpoena

dated August 10, 2022 directing him to submit his Counter-Affidavit
on the above-mentioned complaint within ten (10) days from receipt
of the said summon as prescribed by Section 3, Rule 112 of the 2000
Revised Rules of Criminal procedure, or until August 26, 2022;

3. To be very candid, as mentioned above, since the counsel

was just recently engaged, the undersigned will not be able to meet
the said deadline considering that he is attending to an equally
important undertakings vis-a-vis, he suffered severe side-effects of his
second booster of COVID-19 vaccine since August 22, 2022;

4. As such, the undersigned counsel is constrained to

request for an additional period of ten (10) days reckoned from 26

August 2022 or until 05 September 2022 within which to submit
Respondent’s counter-affidavit and other supporting documents and
evidence for the protection of their causes. Further, this additional
time will be utilized by the undersigned counsel to interview the
Respondents and their witnesses, if any, as well as for the production
of documentary evidences; and

5. This Motion is not intended to delay the proceedings of

this Honorable Office but rather solely based on the foregoing
reasons.

PRAYER

WHEREFORE, premises considered, Respondent, through the

undersigned counsel, most respectfully prays of this Honorable
Provincial Prosecutor’s Office that they be given an additional period
of TEN (10) DAYS reckoned from 26 August 2022 or until 05
September 2022 within which to submit their respective counter-
affidavits and other documentary evidence.

Other remedies and reliefs deemed just and equitable under the
premises, are likewise prayed for.

 EXPLANATION
(Pursuant to Sec.11 of Rule 13, 1997 Revised Rules of Court)

This Motion is served to the complainant through registered

mail due to distance constraints and lack of messengerial staff
coupled with the extraordinary circumstance brought about by
Corona Virus (COVID) 19 Pandemic, which render personal service
impractical.
